KNOW ALL ~mN BY THESE PRESENTS, that
WHEREAS, DUNMAR CORPORATION, a Florida corporaticfDrC' E\VED
heretofore.has filed covenants and restrictions, toge~
with a first addendum to said covenants, on Dunmar
Estates, lying and situated in Seminole County, Flbrida,
and
WHEREAS, fifty-one percent (51%) of the property owners ...,
of Dunmar Estates have met and approved a second adaendum
to the covenants and restrictions, designed and inte~~ed
to protect the .integrity and value.Qf each and every
lot in Dunmar Estates.
.NOW, THER;fEfORE, in consideration of the premises,
and in accord with the procedures outlined in the covenants
and restrictions heretofore record~d, the property ownerS
do hereby adopt and amend and thereby decla?e all of said
real property described as Dunmar ~states to be subject
to the following restrictions, reservations and
conditions, the same to be binding on the Developer and
upon each and every person, both real and corporate,
and who have which shall acquire hereafter said real
property or any part thereof, and their respective heirs,
personal representatives, successors and assigns, said
restrictions., reservations and conditions being as
follows:
Paragraph 3 of the initial covenants and restrictions
recorded on October 6, 1978, in O.R. Book 1191, Page 0279,
be and the same shall be deleted in its entirety and
substituted therefore shall be the following:
3. BUILDING TYPE. No dwelling shall be constructed on
a lot having an area of less than five (5) acres and the
construction is in conformance with the existing zoning
ordinance of the local governing body at the time of
construction. A lot shall be defined as an area of not
less than five (5) acres consisting of one owner and
one dwelling per lot. Each lot owner shall be a member of
the Dunmar Estates Homeowner's Association and shall pay fees
for the support of the Homeowner's Association as ab~essed
by the membership of said Homeowner's Association. The
failure of a property owner to pay the assessment by the
Homeowner's Association shall subject the property owner's
property to a lien for the assessment, together with any
fees and costs incurred in enforcing said assessment.

Estates in individual lots and' is desirous of placing certain
covenants and restrictions upon the use of each and all of said
lots shown on said map, and that such covenants and restrictions
shall run with the title to said lots and each of them, and. is
further desirous of reserving certain easements affecting said
lots, all as hereinafter set forth.
NOW, THEREFORE, in consideration of the premises, the
Developer and the property owners do hereby declare all of said
real property duscribed above to be subject to the followinq
restrictions, reservations and condit.i.ons, binding upon said
Developer and upon each and every person, bot.h real and corporate

changes, or the subject property comes und(~r another qoverning
entity with different zoning regulations, the existing zoning

4. BUILDING LOCNl'ION. No building shall be locat(!d on or

5. LIVESTOCK AND ANIPffiLS. No animals, livestock or poultry ~

kept, provided that they are not kept, bred or maintained for
any commercial purpose.
6. SIGNS. No sign of any kind shall be displayed to the

of not more than one square foot, one sign of not more than five
square feet advertising the property for sale or rent, or Signs
used by a builder to advertise the property during the construction
and sules period.
7. GARBAGE AND REFUSE DISPOSAL. No lot or property shall

9. NUISANCES. No noxious or offensive activity shall be
carried o.n upon any lot, nor shull anything be done thereon which
may be or may become an annoyance or nuisance to the neighborhood.
All clotheslines shall be placed at the rear of and within the
area encompassed by the rearward extension of the residence, and
the clotheslines shall not be placed in an area that would be
unsightly to udjacent land owners. No inoperative cars, trucks,
trailers, or other types of vehicles shall be allowed to remain
either on or adjacent to any lot or property in excess of forty-
eight (48) hours, provided however, this provision shall not
apply to such vehicle being kept in an enclosed garage. There
shall be no major repair performed on any motor vehicle on or
udjacent to any lot or property in the Estates. Recreational
vehicles, such as campers, boats on trailers and motor homes,
shall be kept out of view of adjacent property owners.

map heretofore referred to, is a co~non private ingress-egress
easement, the property owners of the respective lots owning to
the center lint.:: of DunMar Circle and the other easement shown
on said map. DunMar Circle is (or the private use of the
property ownen, dnd the public utili ty compdny serving the said
lots and property, ilnd may illso be used by emerqency vehicles,
such as fire, police and rescue units. All other inCJn~ss and
eqre~;s easern(~nts shown on the llldP, Llnd more particularly those
30 foot private eas(;ments sh~111 likewise be maintained equally
by all property owners subject to these restrictions. It is
understood no governmental entity is responsible for the con-
struction, reconstruction or maintenance of any of the private
road easements referred to in this Paragraph or shown on the map
of DunMar Estates.
11. HAINTENANCE OF EASEMENTS. It shall be the sole re-
sponsibili"Eyof the respective property owners to share in the
maintenance, construction, upkeep and reconstruction of said
private road easements on a pro rata basis. The maintenance
of said private ectsements shall be the responsibility of the
Al"chitectural Control Conuniltee. The> respective property
owners will be sent a statenH.mt for thc>ir portion of the main-
tenance cost on a regular basis after any such maintenance or
reconstruction has taken place. The failure of a property
owner to pay the assessment by the Arcllitectural Control Committee
shall subject that property owner's property to a lien for the
mil in tenance 0 f sa id road, tOCJe tlh' r with any fees and cas ts in-
curred in enforcing said lien and collecting the maintenance
costs. In .the event a qovernrnuntal entity will allow il special
tax district for the maintenance, construction or reconstruction

in the future, the Architectur"l Control Committee shall have the
authority to execute all necessary documents to effectu~te a

51% of the property owners.
12. OIL AND f'.lINING OPEHA'1'IONS. No oil dri11inq, oil

owners of a majority of the lots and property shall have the
power, through a duly recorded written instrument, to chanqe the

may change these covenants in whole or in part by executing

Covenants are recorded, after which time said covenants shall

ADDENDUM '1'0 COVENANTS AND

ESTATES, SEMINOLl~ COUNTY, FLOHIDA
KNOW ALL MEN BY THESE PRESENTS, that DUNMAR CORPORATION, a
Florida corporation, heretofore has filed covenants and restric-
tions on Dunmar Estates, lying and situate in Seminole County,
Florida, and
\vHEREAS, is has become necessary to amend the covenants and
restrictions to provide for necessary utility easements.
NOW, THEREFORE, in consideration of the premises and in
accord with the procedures outlined in the covenants and restric-
tions heretofore recorded, that property owners do hereby adopt
and amend and thereby declare all of said real property described
as Dunmar Estates to be subject to the fOllowing restrictions,
reservations and conditions, the same to be binding on the
Developer and upon each and every person, both real and corporate,
and who of which shall acquire hereafter said real property or
any part thereof, and their respective heirs, personal represen-
tatives, successors and assigns, said restrictions, reservations
and conditions being as follows:
19. In addition to the easements set forth in Paragraph 10
of the covenants and restrictions for public utility use, a five
(5) foot strip along the side and rear lot lones of the respective
lots is hereby reserved for purposes of providing a respective lot
or lots with utility service. Upon request by appropriate utility
authority, the respective property owner or owners shall grant to
said utility authority, the right to utilize said five (5) foot
strip for the sole purpose of providing utility service to lots
situated in Dunmar Estates.

I apologize in my delay in responding to your telephone call of
several weeks ago regarding the Architectural Committee for Dunmar
Estates. Please revise your records to reflect that the Architectural
Control Committee consists of Charles Ashley, Tom Drake and myself.
I appreciate the City checking with the Architectural Control
Committee before permits are issued. It may not be "legally enforc-
able" as far as the holding of the building permit, but it sure could
prevent alot of problems in the future for the C~mmittee and possibly,
the City.
