REQUEST:
The City Clerk requests that Deputy Mayor Rick Brown make an
Appointment/Reappointment related to the Terms of Office which will be expiring in
July 2010 — specifically regarding a Member of the Code Enforcement Board; and that
Commissioner Gary Bonner make an Appointment related to the Terms of Office which
will be expiring in August 2010 — specifically regarding a Member of the Oak Forest
Wall and Beautification District Advisory Committee.
SYNOPSIS:
The purpose of this Agenda Item is for Deputy Mayor Rick Brown and Commissioner
Gary Bonner (depending on the applicable Advisory Boards and Committees) to make
Appointments /Reappointments for the remaining Advisory Board and Committee
Members whose Terms of Office will be expiring in July 2010 and August 2010.
CONSIDERATIONS:
This year, due to the timing of Ordinance 2010 -14, I had advised the Mayor and City
Commission that I would need to send out information to the City's Board and
Committee Members later than in previous years, (due to what might officially be
approved or not approved in Ordinance 2010 -14). Due to timing and with concern for
costs, I sent out emails this year to the City's Board and Committee Members, advising
them of their upcoming Reappointment status.

Some of the applicable Appointments /Reappointments were made at the June 28, 2010
Regular Meeting of the City Commission. Two (2) Appointments/Reappointments
remain:
CODE ENFORCEMENT BOARD:
• James B. Pitts — Is interested in being Reappointed and has submitted a new
Application as requested — [Seat Two Appointment]
The Code Enforcement Board is a seven (7) Member Board which typically meets on the
third Tuesday of each month, beginning at 7:00 p.m.
The Term of Service for this Board (only) remains at three (3) years per Florida Statutes;
and Terms end in July.
Pursuant to Ordinance 2010 -14, "(1) Each city commissioner shall appoint one member
to the seat on each city board or committee that corresponds to the city commissioner's
seat. Appointments shall be made within thirty (30) days of the expiration of the prior
term for that seat. If an appointment is not made within such thirty (30) day time
period, the appointment shall be made by a majority vote of the commission.
The city commission may accept appointments made by any commissioner or the mayor
regardless of seat number."
As the Code Enforcement Board has specific criteria noted about its membership, the
following information is included for your review:
FLORIDA STATUTES:
162.05 Local government code enforcement boards; organization.- -
"(1) The local governing body may appoint one or more code enforcement boards and
legal counsel for the enforcement boards. The local governing body of a county or a
municipality that has a population of less than 5,000 persons may appoint five- member
or seven - member code enforcement boards. The local governing body of a county or a
municipality that has a population equal to or greater than 5,000 persons must appoint
seven - member code enforcement boards. The local governing body may appoint up to
two alternate members for each code enforcement board to serve on the board in the
absence of board members.
(2) Members of the enforcement boards shall be residents of the municipality, in the
case of municipal enforcement boards, or residents of the county, in the case of county
enforcement boards. Appointments shall be made in accordance with applicable law and
ordinances on the basis of experience or interest in the subject matter jurisdiction of the
respective code enforcement board, in the sole discretion of the local governing body.
The membership of each enforcement board shall, whenever possible, include an
architect, a businessperson, an engineer, a general contractor, a subcontractor, and a
realtor."

The following is an excerpt from Ordinance 2010 -14:
"Sec. 2 -56. Creation. The city does herewith and does hereby create a code enforcement
board pursuant to the terms of F.S. Ch. 162."
"Sec. 2 -57. Membership; appointment; qualifications. The code enforcement board
shall consist of seven (7) members to be appointed by the city commission to seats
numbered one (1), two (2), three (3), four (4), five (5), six (6) and seven (7) in
accordance with Section 2- 42(d). Appointments to the board shall be on the basis of
experience or interest in the fields of zoning and building control. The membership of
the code enforcement board shall, whenever possible, include an architect, a
businessperson, an engineer, a general contractor, a subcontractor and a realtor or as
otherwise provided by law."

OAK FOREST WALL AND BEAUTIFICATION DISTRICT ADVISORY
COMMITTEE:
There is an outstanding Appointment from a recent vacancy:
• Vacant Seat — [Seat Three Appointment]
The Oak Forest Wall and Beautification District Advisory Committee is a five (5)
Member Committee, which typically meets on the second Thursday of each quarter,
beginning at 7:00 p.m.
The Term of Service for this Committee is now four (4) years; and Terms end in August.

to the seat on each city board or committee that corresponds to the city commissioner's

FISCAL IMPACT:
There is no fiscal impact to this Agenda Item. Additionally, as a courtesy reminder, with
the Adoption of Ordinance 2010 -14, twenty-five dollar ($25.00) payments to Board
Members have been repealed.
COMMUNICATION EFFORTS:
The Board and Committee Members referenced in this Agenda Item have been notified.
Additionally, copies and /or access to this Agenda Item have been provided to the Mayor
and City Commission, City Manager, City Attorney, Department Directors; placed in
Press Packets; placed in the Lobby Binder; and is available on the City's Website,
LaserFiche, and the City's Server.
RECOMMENDATIONS:
Deputy Mayor Rick Brown and Commissioner Gary Bonner are requested to make their
respective Appointments /Reappointments regarding the Board and Committee Members
that are noted in this Agenda Item - with consideration that Board and Committee
Members will be needed for quorums for Meetings in July and onwards.
Individuals being Appointed would begin no earlier than July 2010, depending on the
Board or Committee.
The City Commission is respectfully requested to make individual Motions for each
Seat, on each Board /Committee.
