PUBLIC HEARINGS AGENDA 400) 840 son Dr – Accessory Dwelling Unit (Conditional Use) Senior Planner Rabon opened and gave the staff presentation of the Accessory Dwelling Unit (ADU) at 840 Dyson Drive (CADU-2026-0004) providing background information, a site plan overview, the project rendering with the fioor plan and staff recommendation of approval subject to the execution of a Declaration of Restrictions, which includes the following conditions the ADU shall not be sold or conveyed separately from the principal residence; the ADU is restricted to the approved size of 738 square feet; the use permit for the ADU shall remain in effect only so long as either the principal residence or the ADU is occupied by the owner of record as their principal residence; the ADU shall not be used for commercial purposes other than being leased for residential use; and any residential lease of the ADU shall be for a minimum term of six months. Chairperson Mah opened the floor to the applicant, Mr. Dan Smolik, briefly addressed the Board and stated the intention for the ADU is for it to be for his elderly mother-in-law. Clariflcation was sought on the residential lease term within the Declaration of Restrictions and ADU's square footage making sure it flts within the Code appropriately. Senior Planner Rabon clarifled square footage is deflned by the livable space. Concerns were raised about potential future garage conversions and Assistant City Attorney Kristin Eick noted that such changes could necessitate a conditional use expansion if connected to the ADU or require evaluation as an accessory structure. Chairperson Mah opened the Public Hearing for Item 400. Micheal Panela, Winter Springs stated that he does not oppose the ADU application but requested the applicant consider replanting or adding landscaping along the shared property boundary to restore the privacy that had existed prior to the removal. Chairperson Mah closed the Public Hearing for Item 400. Chairperson Mah asked for clariflcation on the side setbacks. Senior Planner Rabon conflrmed the structure meets all required setbacks. FUNDING SOURCE RECOMMENDATION Staff recommends that the Planning & Zoning Board hold a Public Hearing and recommend approval of Ordinance 2026-07 to the City Commission. 8 Ordinance No. 2026-07 City of Winter Springs Page 1 of 4 ORDINANCE NO. 2026-07 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AMENDING SETBACK REQUIREMENTS IN THE CITY OF WINTER SPRINGS TOWN CENTER DISTRICT, T5 TRANSECT (URBAN CENTER ZONE); PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS, SEVERABILITY, INCORPORATION INTO THE CODE, AND AN EFFECTIVE DATE. WHEREAS, the City is granted the authority, under Section 2(b), Article VIII of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, the City Commission previously adopted the Town Center District Code to govern the development of certain property along and neighboring the State Road 434 and Tuskawilla Road corridor, known as the Winter Springs Town Center; and WHEREAS, the T5 Transect (Urban Center Zone) of the Town Center District comprises the core of the Town Center, functions as the City’s central business district, and is designed to consist of a higher intensity mix of uses including retail, office, and residential; and WHEREAS, the City previously, via Ordinance No. 2020-02, adopted setback standards applicable to all principal structures, regardless of use, in the T5 Transect, thus establishing 25- foot-minimum and 50-foot-maximum front setbacks, and 3-foot-minimum and 100-foot- maximum side setbacks; and WHEREAS, “Residential, single family (attached)” uses, i.e., townhomes, are permitted uses in the T5 Transect, and the City desires to update the setback requirements for townhomes in the T5 transect, as the current applicable setbacks make the development of townhomes in the transect impracticable; and WHEREAS, relaxing the setback standards for townhomes in the T5 Transect will not only make the development of townhomes possible in the Transect, but will also bring the T5 Transect standards in line with the T3 and T4 Transect standards, thus providing clarity and consistency in the Town Center Code; and WHEREAS, the City Commission also desires to clarify the applicable front/principal plane setbacks for all structures in the T5 Transect as well, which reflects the intent of Ordinance 2020-02 to create and maintain sustainable streetscapes along State Road 434 and Tuskawilla corridors and to form the visual image of Winter Springs as an attractive and sustainable city; and WHEREAS, on the _____ day of _____________, 2026, the City’s Land Planning Agency reviewed the proposed amendments to the Town Center District Code and has recommended approval of the proposed amendments to the City Commission; and 9 Ordinance No. 2026-07 City of Winter Springs Page 2 of 4 WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this Ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. The foregoing recitals are hereby fully incorporated herein by reference as legislative findings of the City Commission of Winter Springs. Section 2. Town Center District Code Amendments. The City of Winter Springs Code of Ordinances Chapter 20, Zoning, Article III, Establishment of Districts, Division 12, Town Center District Code, is hereby amended as set forth below. (Underlined type indicates additions and strikeout type indicates deletions, while asterisks (* * *) indicate a deletion from this Ordinance of text existing in Division 12. It is intended that the text in Division 12 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this ordinance). All other lot types shall maintain a five-foot side setback. * * * Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph, number or letter, and any heading may be changed 11 Ordinance No. 2026-07 City of Winter Springs Page 4 of 4 or modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may be corrected and additions, alterations, and omissions, not affecting the construction or meaning of this Ordinance and the City Code may be freely made. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 6. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter. Accessory Dwelling Unit Requirement: An accessory dwelling unit (ADU) is an ancillary or secondary dwelling unit that is clearly subordinate to the principal dwelling, which has a separate egress/ingress independent from the principal dwelling, and which provides complete independent living facilities for one (1) or more persons and which includes provisions for living, sleeping, eating, cooking, and sanitation. It is located on the same parcel or lot as the principal dwelling and shall be subject to the required setbacks of the principal structure and may be either attached to or detached from the principal dwelling. Accessory dwelling units (ADUs) must conform to the following standards as outlined below: Accessory Dwelling Unit criteria set forth in Sec. 6-85 are as follows: a. Zoning district. Owner occupancy required; declaration of restrictions. The property owner shall occupy either the principal structure or the ADU. Prior to the issuance of a building permit for construction of an ADU, an applicant shall record in the public records of Seminole County a declaration of restrictions containing a reference to the legal description of the property and the deed under which the property was conveyed to the present owner stating that: 1. The ADU shall not be sold or conveyed separate from the principal residence; 2. The ADU is restricted to the approved size; 3. The use permit for the ADU shall be in effect only so long as either the principal residence or the ADU is occupied by the owner of record as their principal residence; 4. The declarations shall run with the land, shall be binding upon any successor in ownership of the property and that noncompliance shall be cause for code enforcement and/or revocation of the conditional use permit; 5. The deed restrictions shall only be removed with the express, written approval of the city, but shall lapse upon removal of the accessory unit; and 6. The ADU shall not be used for commercial purposes other than being leased for residential purposes. e. Number of ADU’s per lot or parcel. Only one (1) ADU shall be allowed for each lot or parcel. f. Setbacks. The ADU shall meet the front, side and rear yard regulations for the zoning district in which it is located. g. Building height and stories. The ADU shall meet the building height regulations for the zoning district in which it is located. h. Lot coverage. The sum of the principal dwelling and the ADU shall meet the lot coverage regulations for the zoning district in which they are located. i. Parking and access. A minimum of one (1) parking space shall be provided on- site for the ADU in addition to the required off-street parking spaces required for the principal residence. The ADU shall be served by the same driveway as the principal dwelling. j. Water and wastewater services. An ADU is required to connect to the central water and sewer system where available. An ADU may be separately metered for utilities subject to all applicable ordinances and utility policies. Other code requirements. The ADU shall comply with all applicable building codes. l. Lot size, minimum; principal residence minimum . A minimum lot size of six thousand six hundred (6,600) square feet is required and the principal residence shall be a minimum of one thousand three hundred fifty (1,350) square feet of air conditioned area. m. Unit size. The living area of the ADU shall be a maximum of thirty (30) percent of the air conditioned area of the principal residence or eight hundred (800) square feet, whichever is less. However, the ADU shall contain no less than four hundred (400) square feet of air conditioned area. ADUs that utilize alternative green construction methods that cause the exterior wall thickness to be greater than normal shall have the unit square footage size measured similar to the interior square footage of a traditional frame house. n. Design. The ADU shall replicate the design of the principal dwelling by use of similar exterior wall materials, window types, door and window trims, roofing materials and roof pitch. The design is subject to the minimum community appearance and aesthetic review standards to ensure residential compatibility and harmony (see section 9-600 et. seq.). o. Privacy. Privacy and screening of adjacent properties is of utmost importance in the orientation of the ADU. Entrance and windows of the ADU shall face the interior of the lot and/or public street as much as possible. Windows which do face the adjoining property shall be designed to protect the privacy of neighbors. Landscaping shall be used to further provide for the privacy and screening of adjacent properties. p. Expiration. As with all conditional use approvals, if a building permit has not been issued within two (2) years for the ADU, the approval becomes null and void (see section 20-36). q. Approval process. The conditional use/aesthetic review approval of an ADU is subject to a public hearing. A notice will be sent to all property owners within one hundred fifty (150) feet of the subject property. An ADU will not be approved if prohibited by the declarations, covenants, conditions and restrictions of a homeowners' association. The city commission may impose reasonable conditions of approval to the extent deemed necessary and relevant to ensure compliance with applicable criteria and other applicable provisions of the city code and comprehensive plan (see section 20- 27 and section 20-33). 31 P U B L I C H E A R I N G S A G E N D A I T E M | T H U R S D A Y , S E P T E M B E R 3 , 2 0 2 6 | P A G E 5 O F 10 In evaluating the standards outlined above with regard to the subject property, Staff has determined that the applicant’s request is in harmony with the applicable ADU standards. The property is located in a planned unit development zoning district and already contains a single-family home, making the property appropriate for development of a detached ADU. The property owner will, as a condition of approval, execute a Declaration of Restrictions requiring owner- occupancy and other restrictions, as required by City Code Section 6-85. The ADU will be the only ADU located on the property. The location of the proposed ADU meets minimal setback requirements for the zoning district in which it is located and further meets applicable lot coverage standards. Water and sewer systems are available on the property and will service the ADU. The ADU’s 662 SF living area is approximately 15.27% of the primary structure’s 4,335 SF living area, well below the 800 SF or 30% living area maximum codified in Section 6-85 of the City Code. The ADU will also meet the building height regulations for the zoning district in which it is located. Parking is available at the ADU through the driveway and parking area which already serves the main house. The building in which the ADU is located has already been constructed to match the existing primary residence in color and materials and will maintain such aesthetic consistence with the primary structure once converted into an ADU, and the ADU will be appropriately screened from neighboring properties. Conditional Use Requirements: The criteria for all conditional use recommendations and final decisions shall be based on the following criteria to the extent applicable. Conditional uses criteria set forth in subsection 20-33(d) are as follows: 1. Whether the applicant has demonstrated the conditional use, including its proposed density, height, scale and intensity, hours of operation, building and lighting design, setbacks, buffers, noise, refuse, odor, particulates, smoke, fumes and other emissions, parking and traffic-generating characteristics, number of persons anticipated using, residing or working under the conditional use, and other off-site impacts, is compatible and harmonious with adjacent land uses, and will not adversely impact land use activities in the immediate vicinity. Analysis: Staff find that the proposed ADU meets requirements of being compatible and harmonious with adjacent uses in terms of its design, height, setbacks, materials, and buffers. As an ADU, the structure does not increase residential density. Additionally, the building has been designed to replicate the design of the principal dwelling’s materials and colors. The structure is within lot setbacks and has additional landscape buffering on either side of the property. The ADU is not anticipated to cause a burdensome increase to emissions, parking, traffic, or other negative impacts to the surrounding neighborhood. Whether the applicant has demonstrated the size and shape of the site, the proposed access and internal circulation, and the design enhancements to be adequate to accommodate the proposed density, scale and intensity of the conditional use requested. The site shall be of sufficient size to accommodate design amenities such as screening, buffers, landscaping, open space, off-street parking, safe and convenient automobile, bicycle, and pedestrian mobility at the site, and other similar site plan improvements needed to mitigate against potential adverse impacts of the proposed use. Analysis: Staff find that the site has more than sufficient area to provide for the ADU, access, density, and internal circulation. The property has sufficient screening from either adjacent parcel that the ADU is not visible and does not create other adverse impacts. 3. Whether the proposed use will have an adverse impact on the local economy, including governmental fiscal impact, employment, and property value. Analysis: Staff finds that the proposed ADU proposed ADU would have no adverse impact on property values. The accessory structure has existed on the subject property since 1989. Conversion to an ADU would enhance the property value of the subject property, as well-designed ADUs that are architecturally consistent with principal structures are desirable and can potentially increase property values. 4. Whether the proposed use will have an adverse impact on the natural environment, including air, water, and noise pollution, vegetation and wildlife, open space, noxious and desirable vegetation, and flood hazards. Analysis: Staff have found that the proposed use will have no adverse impact on the natural environment. The proposed structure will not generate any pollution and will be located on a previously developed and maintained portion of the property. While a portion of the proposed structure is located within a flood zone, the ADU is elevated to mitigate the risk of flooding, as noted by the Elevation Certificate. 5. Whether the proposed use will have an adverse impact on public services, including water, sewer, stormwater and surface water management, police, fire, parks and recreation, streets, public transportation, marina and waterways, and bicycle and pedestrian facilities. Analysis: Staff find that the proposed use will have no adverse impact on the related public services. 7. Whether the traffic report and plan provided by the applicant details safe and efficient means of ingress and egress into and out of the neighborhood and adequately addresses the impact of projected traffic on the immediate neighborhood, traffic circulation pattern for the neighborhood, and traffic flow through immediate intersections and arterials. Analysis: Not applicable as this is not a traffic projecting-related use. 8. Whether the proposed use will have an adverse impact on housing and social conditions, including variety of housing unit types and prices, and neighborhood quality. Analysis: Staff finds that the proposed ADU will not create any adverse impacts on housing and social conditions, and may have a positive impact on housing due to adding an additional residential structure to the neighborhood thus increasing the types of housing available in the area. 9. Whether the proposed use avoids significant adverse odor, emission, noise, glare, and vibration impacts on adjacent and surrounding lands regarding refuse collection, service delivery, parking and loading, signs, lighting, and other sire elements. An incomplete application will not be processed and will be returned to the applicant. The application shall be reviewed per Chapter 20–Zoning Sec.20-33 and Chapter 6–Sec.6-85.
