Not Used CITY OF WINTER SPRINGS, FLORIDA MINUTES CODE ENFORCEMENT BOARD REGULAR MEETING – APRIL 28, 2026 PAGE 2 OF 4 PUBLIC HEARINGS: REPEAT CASES 400) Case #2026CE000542 Address: 31 N Cortez Ave Respondent(s): Roanld G Lesage and/or Corey A Folan Violation: IPMC Section 308.1 – Accumulation of Rubbish or Debris Note: The Respondent was present Code Compliance Inspector Carlos DeFoe introduced the case, offered testimony on the procedures of notice and the violation, and showed photos from the “Presentation.” The Board accepted the packet as published into evidence as well as additional photos presented by Inspector DeFoe without objection. Inspector DeFoe recommended a fine of up to $500 per day for the repeat violation that was present from March 3, 2026 to April 28, 2026. Mr. Ronald Lesage, Respondent testified and submitted photographs showing the current status of the property. He further testified about difficulties he had encountered and his desire to work with the Code Inspector to avoid further violations. Discussion followed on the current status of the property, action needed to avoid further repeat violations, and an appropriate fine amount. I MOVE TO FIND THAT BASED ON THE PHOTOGRAPHS, THE TESTIMONY FROM THE CODE OFFICER, AND TESTIMONY FROM THE RESPONDENT SHOW THAT THERE WAS A LOT OF GARBAGE AND DEBRIS ON THE PROPERTY AND THAT THIS IS A REPEAT VIOLATION OF IPMC SECTION 308.1 - ACCUMULATION OF RUBBISH OR TRASH. THE PROPERTY IS NOW IN COMPLIANCE AND A FINE IN THE AMOUNT OF ONE HUNDRED AND FIFTY DOLLARS ($150) PER DAY PER REPEAT VIOLATION SHALL BE IMPOSED FOR THIS VIOLATION COVERING THE PERIOD OF MARCH 3, 2026 TO APRIL 28, 2026. Code Compliance Inspector Carlos DeFoe introduced the case, offered testimony on the procedures of notice and the violation, and showed photos from the “Presentation.” The Board accepted the packet as published into evidence as well as additional photos presented by Inspector DeFoe without objection. Inspector DeFoe recommended a compliance date of May 28, 2026 and a fine of up to $250 per day per violation if this was not met. Discussion followed on communication with the respondent, appropriate timelines for compliance, and appropriate fines. “I MOVE TO FIND THAT THE PHOTOGRAPHS AND TESTIMONY OF CODE INSPECTOR CARLOS DEFOE CLEARLY SHOWS THERE IS SUFFICIENT SUPPORT TO SUBSTANTIATE THE ISSUES PRESENT WITH THE PROPERTY AS IT RELATES TO A VIOLATION OF WINTER SPRINGS CITY ORDINANCE 13-2(B), PROHIBITIONS; WINTER SPRINGS CITY ORDINANCE 20-434, AUTHORIZED COMMERCIAL VEHICLES IN RESIDENTIAL AREAS; AND IPMC SECTION 304.7, ROOFS AND DRAINAGE, AND ORDER THAT THE RESPONDENTS BE GIVEN UNTIL MAY 28, 2026 TO ESTABLISH COMPLIANCE. IN THE EVENT THE VIOLATIONS ARE NOT CORRECTED, A FINE OF TWO HUNDRED DOLLARS ($200.00) PER VIOLATION PER DAY SHALL BE IMPOSED UNTIL COMPLIANCE IS REPORTED TO AND VERIFIED BY CITY CODE ENFORCEMENT.” MOTION BY BOARD MEMBER GALLO.
