LIABILITY ARISING FROM AXIS'S OR ANY THIRD PARTY'S COMPARATIVE, CONCURRENT,
CONTRIBUTORY, PASSIVE OR ACTIVE NEGLIGENCE OR THAT ARISES AS A RESULT OF ANY
STRICT OR ABSOLUTE LIABILITY, OR WHICH CREATES INCIDENTAL OR CONSEQUENTIAL
DAMAGES, SHALL NOT EXCEED THE TOTAL RATE PAID BY CUSTOMER UNDER THIS
AGREEMENT.
13.1bis Agreement cannot be assigned or transferred without the prior written consent of aXis. The validity,
construction and effect of this Agreement shall be governed by the laws of the State of Florida and venue
shall be set in Orange County.
14.It is hereby noted and agreed that aXis Events will add City of Winter Springs, as an additional insured to
their Comprehensive General Liability Policy, but only with respect to work, activities and/or Services done
for City of Winter Springs by aXisPro Events, and only with respect to losses that arise out of aXisPro
Event's activities, services, and/or work done and/or provided on behalf of City of Winter Springs.
CUSTOMER, in signing this Agreement, acknowledges his/her authority to do so and assumes liability for the
conditions stated above.
