HomeMy WebLinkAbout2004 06 14 Regular 512 COMMISSION AGENDA ADD-ON ITEM 512 CONSENT INFORMA TIONAL PUBLIC HEARING REGULAR X June 14,2004 Meeting MGR lk-IDEPT9-t1 Authorizatio~ REQUEST: Police Department Code Enforcement Bureau requests the Commission to review information regarding the related enforcement of damage being caused by skate boards, roller skates, roller blades, in commercial zoning areas. PURPOSE: This agenda item is needed to provide information to the Commission in order to enact an ordinance that is reasonable and warranted to abate destruction of public and private property and to enhance the safe movement of pedestrian and vehicular traffic within the commercial areas in the City of Winter Springs. CONSIDERATIONS: The Code Enforcement Bureau and City Hall have received requests from various business owners for assistance with skateboarders, freestyle bicycling, and rollerblading in commercially zoned areas. Currently, there is no specific City Ordinance prohibiting these actions. Commercial areas quite often attract this type of nuisance for several reasons such as, handrails, benches, water features, landscaping, and large paved parking lots. The Winter Springs commercial areas are continuing to develop as well as the number of visitors to them. The City's overlay districts were designed to provide enhanced areas for shopping, relaxation and entertainment. In particular, skateboarding has been a problem because pedestrians have difficulties moving about when handrails and architectural features are used for jumping by skateboarders. Elderly residences and young children are especially vulnerable. We are recommending an Ordinance be added to Chapter 13, Nuisances. We are suggesting the below listed style Ordinance. Section 13 - Riding of skate boards, scooters, and freestyle bicycling on designated sidewalks and other public premises prohibited where posted. June 14,2004 Regular Agenda 5 Page 2 of2 (a) No person shall ride skateboards, coasters, scooters, toys of similar devices on any sidewalk or in any public parking lot or any parking garage or on any premises of any public building within the Commercial Zoned Districts of the City of Winter Springs where such activity is prohibited by a posted sign. (b) Property owners shall notify the Chief of Police that the property has been properly posted with signs relating to this prohibition and requesting enforcement for violations of this section. The enforcement of violations would be a civil citation issued in accordance with City of Winter Springs Code of Ordinances Section 2-69.1 Citation Procedures. This procedure is to issue a warning for the first offense, then a civil infraction for each subsequent offense with a fine starting at $50.00. RECOMMENDATION: It is recommended that the Commission provide staff with whatever direction it deems appropriate. IMPLEMENTATION SCHEDULE: hnmediately upon approval by Commission.
