PURPOSE: The purpose of this agenda item is to present to the Commission the recommendation of the Districting Commission as it relates to the redistricting of the City and to request approval of the second reading of Ordinance No. 2004-27. APPLICABLE CODE AND LAW: Section 4.02. Commission districts; adjustment of districts. (a) Number of districts. The City Commission of the City of Winter Springs, Florida, shall by separate ordinance divide the City into five (5) geographical commission districts. (b) Districting commission. By the first day of February, 1991, the first day of February, 1992, and every three (3) years thereafter, the City Commission shall appoint seven (7) city electors determined from the registration of the last regular election, one (1) to be appointed by each commissioner from his/her respective district, and two (2) appointed by the mayor from the City at large, who shall comprise the districting commission. Electors chosen shall not be employed by the City in any other capacity. The initial districting commission, creating and establishing the first commission districts, shall be appointed by each commissioner and the mayor from the City at large. (c) Report; specifications: The districting commission shall file with the official designated by the city commission a report containing a recommended plan for establishment or adjustment of the commission district boundaries. The June 14,2004 PUBLIC HEARING AGENDA ITEM 402 Page 2 initial districting commission, creating and establishing the first commission districts, shall file such report within ninety (90) days of appointment. Thereafter, such reports shall be filed within one hundred twenty (120) days of appointment to the districting commission. The Commission district boundaries shall comply with the following specifications: (1) Each district shall be formed of compact contiguous territories, and its boundary lines shall follow the center lines of streets insofar as practical or possible, or other boundaries available. (2) The districts shall be based upon the principle of equal and effective representation as required by the United States Constitution and as represented in the mathematical preciseness reached in the legislative apportionment of the state. (3) The report shall include a map and description of the districts recommended and shall be drafted as a proposed ordinance. Once filed with the designated official, the report shall be treated as an ordinance introduced by a commissioner. (d) Support. It shall be the responsibility of the city manager to provide staff assistance and technical data to the districting commission. (e) Procedure. The procedure for the city commission's consideration of the report shall be the same as for other ordinances, provided that if a summary of the ordinances is published pursuant to this Chapter and general law, it must include both the map and a description of the recommended districts. (f) Failure to enact ordinance. The city commission shall adopt the redistricting ordinance at least one hundred twenty (12) days before the next city election. If the City commission fails to either accept or reject the redistricting ordinance, the report of the districting commission shall go into effect and have the same effect of an ordinance. The proposed redistricting ordinance may not be rejected for any reason except for failure to comply with the specifications listed in section 4.02( c) of this Charter or failure to comply with other local, state or feder'allaw. (g) Effect of enactment. The new commission districts and boundaries as of the date of enactment shall supersede previous commission districts and boundaries for all purposes; provided all incumbent commissioners shall continue to hold office for the entire term to which elected notwithstanding any change in commission district and boundaries. June 14, 2004 PUBLIC HEARING AGENDA ITEM 402 Page 3 (1) There shall be five county commissioners' districts in each county, which shall be numbered one to five, inclusive, and shall be nearly equal in proportion to population as possible. DISCUSSION: The population per commission district is depicted in the table below. The January 31,2001, population (basis for the 2001 districting map is depicted as the revised estimated population for January 31, 200 l) has been adjusted to January 31, 2004, by the same methodology used by fonner Current Planning Coordinator Don LeBlanc. The district boundaries have been adjusted to accommodate the population changes with as little population variation as possible among the districts. Mr. LeBlanc had estimated the January 31, 2001, population at 32,515. The bottom line (labeled "percentages") represents the percentage of that revised district of the total estimated January 31,2004, City population. The perfect district size identified by Mr. LeBlanc for this population was 6,503 (32,5l5/5=6,503). The University ofPlorida estimated that the April 2003 City population was 32,572. Staff estimates the January 31, 2004, City population at 33,893 (the perfect district size, based on this estimate would be 6,779). The process of setting district boundaries should try to adhere to obvious boundaries and to try to provide as equitable a population distribution as possible. Approximately Y2 ofTuscawilla, Parcel 90 (SE comer of power easement and Tuskawilla Road) was moved from District 2 into District 3; b. The portion of the Town Center on the north side ofSR 434, including the Orange Avenue annexations, was moved from District 5 into District 2; c. Parkstone was moved from District 5 to District 4; and d. Seibert Manor, Bahama Ranches, Moss Road Ranches, and a portion ofFoxmoor were moved from District 5 into District l. June 14,2004 PUBLIC HEARING AGENDA ITEM 402 Page 4 FINDINGS: 1) The Districting Commission was appointed by City Commission action of December 8, 2003, and January l2, 2004. 2) The one hundred twenty (120) day requirement for report filing expires May 11, 2004. A report can be filed prior to the one hundred twenty (120) day period. 3) The only portion of Florida State Statutes which approximates the "mathematical preciseness reached in the legislative apportionment of the state" is that found in Florida Statutes Section 124.01 which reads "shall be as nearly equal in proportion to population as possible". The Staff recommendation presented to the Districting Commission has a difference of one hundred forty four (144) persons between the proposed highest populated district (District 3) and the proposed lowest populated district (District 5). The goal that the previous Commission had established was to have no more that a one percent (1%) population difference between districts. The recommendation presented has a difference of less than 0.5 percent (0.0046618 of the total population) between the most populated and the least populated districts. 4) The City Commission does not have to accept the Districting Commission's recommendation. 5) The Districting Commission recommendation as being presented to the City Commission allows all present City Commissioners to remain in their respective districts. 6) The Districting Commission recommended district map has followed street rights of way, power easements, streams, etc., as much as possible. CHRONOLOGY: May 11, 2004 - Districting Commission meeting - staff presented the proposed boundaries & the Districting Commission recommended approval of the boundaries as presented to the City Commission. May 24, 2004 - City Commission approves first reading of Ordinance No. 2004 - 27. RECOMMENDATION: The recommendation is that the City Commission approve proposed Ordinance No. 2004-27, adopting Commission District boundaries as required by the City Charter.
