REQUEST: The Public Works Director presents to the City Commission for the second and [mal reading Ordinance No. 2004-24 amending Chapter 9, Article IV, Division 2 of the City Code, creating a new section 9-206 entitled "Right-Turn Deceleration Lanes." PURPOSE: The purpose of this ordinance is to establish regulations for the creation of right-turn deceleration lanes . APPLICABLE LAW AND PUBLIC POLICY: 1. Florida Municipal Home Rule Powers Act. CONSIDERA TIONS: 1. Public Works Director believes that the City should adopt guidelines for right-turn deceleration lanes. Page 1 of 2 . . . ORDINANCE NO. 2004-24 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA AMENDING CHAPTER 9, ARTICLE IV, DIVISION 2, OF THE CITY CODE, BY CREATING A NEW SECTION 9-206, ENTITLED RIGHT-TURN DECELERATION LANES; PROVIDING FOR INCORPORA TION INTO THE CODE, REPEAIJ OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Commission is granted the authority, under Section 2(b), Article vrn, of the State Constitution, to exercise any power for municipal purposes, except when expressly prohibited by law; and WHEREAS, based on the recommendations of the City Public Works Director and traffic engineer, the City Commission fmds that it is in the best interest of promoting traffic to establish regulations regarding deceleration lanes; and WHEREAS, the City Commission of the City of Winter Springs, Florida, hereby finds this Ordinance to be in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS HEREBY ORDAINS, AS FOLLOWS: Section 1. Recitals. The foregoing recitals are true and correct and are fully incorporated herein by this reference. Section 2. Code Amendment, Chapter 9, Article IV, Division 2. The City of Winter Springs Code, Chapter 9, Article N, Division 2, is hereby amended as follows: (underlined type City of Winter Springs Ordinance No. 2004-24 Page 1 of 4 . . . indicates additions and strik-cout type indicates deletions, while asterisks (* * *) indicate a deletion from the Ordinance of text existing in Chapter 9. It is intended that the text in Chapter 9 denoted by the asterisks and set forth in this Ordinance shall remain unchanged from the language existing prior to adoption of this Ordinance). Chapter 9. LAND DEVELOPMENT *** ARTICLE IV. REQUIRED IMPROVEMENTS *** DIVISION 2. STREETS AND BRIDGES * * *' , Sec. 9-206. Right-turn deceleration lanes. Right-turn deceleration lanes at proposed development access points shall be provided if they are warranted and feasible as determined from the Traffic Study. The warrants include, but are not limited to the following criteria: ~ For two-lane roadways with posted speed limits greater than 45 mph. the projected right- turning volume is equal to or greater than 30 right turns per hour. (Ql For two-lane roadways with posted speed limits of 45 mph or less. the "roiected right-turning volume is equal to or greater than 80 right turns per hour. @ For four-lane roadways with posted speed limits greater than 45 mph. lane. the right turning volume is equal to or greater than 40 right turns per hour. ll!l. For four-lane roadways with posted speed limits of 45 mph or less. the proiected right -turning City of Winter Springs Ordinance No. 2004-24 Page 2 of 4 . . . volume is equal to or greater than 110 right turns per hour. & For all six-lane facilities. right turn deceleration lanes are only warranted at locations with a very high number of right turning vehicles. {fL Other factors which must be considered in the warrant evaluation process include: ill Percentage of trucks. recreational vehicles. and buses turning right at a specific location. ill Gated entrances where there is limited queue distance between the gate and the edge of the outside through lane. ffi Accident history including vehicular. pedestrian. bicyclist traffic. ffi Sight distance. ~ Right-of- W ay requirements. *** Section 3. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent ordinances and resolutions adopted by the City Commission. or parts of prior ordinances and resolutions in conflict herewith, are hereby repealed to the extent of the conflict. Section 4. Incorporation Into Code. This ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph number or letter and any heading may be changed or modified as necessary to effectuate the foregoing. Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall City of Winter Springs Ordinance No. 2004-24 Page 3 of 4 . be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portions of this ordinance. Section 5. Effective Date. This Ordinance shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City Charter.
