REQUEST: The Community Development Department requests the City Commission
validate the staff recommendation finding Heritage Park Townhomes built in
substantial accordance with the Final Engineering and to accept the potable
water and sanitary sewer infrastructure for ownership and maintenance.
PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the
staff recommendation finding Heritage Park Townhomes to be built in substantia]
accordance with the Final Engineering per Section 9-178 and to accept the
potable water and sanitary sewer infrastructure for ownership and maintenance in
order for Certificates of Occupancy to be issued.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on
lots; exceptions.
(c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans. such as
withholding occupancy, the building official may issue building permits upon
advising the developer that all or partial occupancy will be restricted until
satisfactory completion of the improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are
accepted by the city commission.
FINDINGS:
]) All City agencies have found the work to be acceptable.

2) The potable water and sanitary sewer improvements are to be dedicated to the City
for ownership and maintenance. The 2-year maintenance bond has been received and
an additional performance bond for additional paving.
3) An agenda item has been prepared for this City Commission meeting to address
differences between the rear yard building setbacks set forth in Exhibit "C" of the
Wagner's Curve Development agreement and the product proposed by Centex on a
majority of the lots that Centex platted as Heritage Park. The amendment would
change the rear yard building setback from 20 feet to 15 feet, to accommodate the
building product on lots that were platted 85 feet long. The amendment would not
affect the proximity of one building to another.
4) The only remaining site development issue is the completion of the gazebo and its
handicap accessibility ramp. Centex' commitment to deliver, install and complete
the gazebo and its handicap accessibility ramp is on or before June 11, 2004.
RECOMMENDATION:
Staff recommends that the City Commission validate the staff
recommendation finding Heritage Park T ownhomes built in substantial
accordance with the Final Engineering per Section 9-178, accept the potable
water and sanitary sewer infrastructure for ownership and maintenance,
contingent upon the delivery and installation of the accessories necessary to
complete the gazebo and its handicap accessibility ramp.
