HomeMy WebLinkAbout2004 09 20 Regular 505 COMMISSION AGENDA ITEM 505 CONSENT INFORMATIONAL PUBLIC HEARING REGULAR X ::p September~ 2004 Meeting MGR~T~ Authorization REQUEST: The Finance Department is requesting the City Commission adopt Resolution No. 2004-41, establishing a recycle bin policy. PURPOSE: The purpose of this Agenda item is to request the City Commission adopt Resolution No~ 2004-41, establishing a recycle bin policy. CONSIDERATIONS: Currently, new residents to the City of Winter Springs complete utility service initiation paperwork and pay all associated fees (utility deposit and application fee) to become a water, sewer, storm water and solid waste customer. The City provides all the mentioned services with the exception of solid waste, which is contracted out. Waste Services of Florida holds an exclusive franchise for the collection, transportation and disposal of residential solid waste and recyclable materials within the City limits. Waste Services of Florida provides neither the solid waste (garbage) container nor the recycle bin. The City provides each customer with a recycle bin, pick-up information and solid waste/recycle service guidelines upon initiation of services. The customer is responsible for providing their own garbage container. In prior years, the City has received grants to purchase and provide recycle bins free of charge to our customers. However, the recycling grant program sponsored by Seminole County is no longer available and we have not been able to find additional grants to supplement this revenue source. As a result, City staff is recommending two fee options to the Commission for consideration. FUNDING: The two (2) fee options for consideration are: (a) OPTION 1: When Resident initiates a utility account with the City, they will receive one (1) free recycle bin, if needed. The recycle bins would be paid for from the Solid Waste Fund and incorporated in the solid waste rates. Regular Agenda Item 505 September 13,2004 Page 2 of2 Additional bins could be purchased by the customer at a cost of $4.00 per recycle bin. The price could vary as the City replenishes stock. Revenues from the sale of these additional recycle bins would be recorded in the Solid Waste Fund to offset the cost of purchasing these additional bins. Upon discontinuance of utility services with the City, the customer would keep recycle bin or leave for new owner/resident. (b) OPTION 2: When Resident initiates a utility account with the City, they would purchase one (1) recycle bin, ifneeded, at a cost of$4.00. Additional bins could be purchased by the customer at a cost of $4.00 per recycle bin. Revenues from the sale of all recycle bins would be recorded in the Solid Waste Fund to offset the original purchase in that same fund. As a result, there would be no net effect to the solid waste rates for the purchase of recycle bins. Upon discontinuance of utility services with the City, the customer would keep recycle bin or leave for new owner/resident. RECOMMENDATION: It is recommended that the City Commission approve Resolution No. 2004-41 and approve a funding source for providing recycle bins to each residence. If Fee Option 1 is selected: Motion that each residence would receive one (1) free recycle bin at service initiation and could purchase additional bins at a cost of $4.00 per recycle bin. All revenues received for recycle bin sales and all expenses for recycle bin purchases would occur in the Solid Waste Fund, the net effect being the cost of the free recycle bin incorporated into the solid waste rates. If Fee Option 2 is selected: Motion that each residence would purchase one or more recycle bins at a cost of $4.00 per recycle bin. All revenues received for recycle bin sales and all expenses for recycle bin purchases would occur in the Solid Waste Fund, but there would be no change to the solid waste rates as the revenue received for each bin should offset the cost of each bin. ATTACHMENTS: Resolution No. 2004-41 COMMISSION ACTION: RESOLUTION NO. 2004-41 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, ESTABLISHING A RECYCLE BIN POLICY FOR THE RESIDENTS OF THE CITY; PROVIDING FOR A FEE FOR A RECYCLE BIN; PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT RESOLUTIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Winter Springs encourages all residents to recycle material to reduce the amount of solid waste entering our landfills as well as to conserve natural resources; WHEREAS, the City desires not to impose an economic hardship on the City for the provision of recycle bins, which are distributed to each resident upon initiation of utility account with the City; WHEREAS, from time to time replacement recycle bins are requested by City residents for lost or worn out bins; and WHEREAS, in recognition of the above issues, the City desires to adopt a uniform policy for the sale and distribution of recycle bins to our residents; and WHEREAS, the City Commission of the City of Winter Springs deems that this Resolution is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section 2. Recycling Bin Policy. The following policy is adopted regarding the distribution and sale of recycling bins for utility customers. 2.1 Recycling is encouraged by all residents of the City of Winter Springs. A recycle bin, pick-up schedule and recycle guidelines will be provided to each customer at the initiation of utility service. All single family residential dwellings shall have at least one recycle bin for recycling authorized material. This bin should be placed at curbside on the specified pick-up day. All revenues received for recycle bin sales and all expenses for recycle bin purchases would occur in the Solid Waste Fund. Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of the conflict. Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective Date. This Resolution shall become effective immediately upon adoption by the City Commission of the City of Winter Springs, Florida.
