REQUEST: The Community Development Department recommends the City
Commission consider and provide direction regarding the proposed conceptual site plan
and architectural rendering for Bruster's Ice Cream.
PURPOSE:
The purpose of this agenda item is to consider and provide direction to the applicant and
staff regarding a conceptual site plan and architectural rendering for a Bruster's Ice
Cream shop at the southeast comer of SR 434 and Costa Rica Road (the site has C-I
zoning and is within the SR 434 Redevelopment Overlay Zoning District).
APPLICABLE LAW AND PUBLIC POLICY:
Chapter 9 - Land Development.
Chapter 20, Article III, Division 7, Sections 20 - 231 thru 20 - 238, C-1
Commercial Zoning District.
Chapter 20, Article VI, Division 3, General Design Standards for Redevelopment
Area, Sections 20 - 480 thru 20 - 490.
CONSIDERATIONS: The applicant submittedtinal engineering/site plans for
development of the 1.36 acre site on May 15 and learned at the May 18 DRC that any
drive-thru must be adequately screened from SR 434. Subsequently, their was discussion
about both the architecture and the location of the drive-thru, in conjunction with a City
Commission informational development review up-date. This is the applicant's response
to both staff and City Commission comments and concerns.
At its regularly scheduled September 7, 2004, meeting, the DRC briefly reviewed the
concept plan and architectural rendering. The concept plan appears to be generally
consistent with Code, although the following issues were noted: (1) the plan depicts a lot

split, that proposes a new 0.34 acre lot abutting a private street, but with a cross-access
easement (would require platting), (2) a cross-access easement to the property to the east
must be provided, (3) the driveway location and details are contingent upon FDOT, (4) an
acceptable traffic study must be provided, addressing, for example, both on-site and off-
site movements and possible improvements - which may cause the plan to be modified,
(5) underground utility provision is required, (6) the dumpster must be adequately
screened from SR 434, (7) ground mounted single-tenant monument signs must be at
least 15 feet from any property line, (8) Section 20-470 allows a maximum building sign
copy area of 16 square feet (2' maximum letter height) - the applicant would need either
a development agreement or seek a variance to provide the signage depicted on the
architectural rendering, (9) the vehicle accommodation area does not meet the applicable
SR 434 Redevelopment Overlay Zoning District 10 foot setback from Costa Rica Drive,
(10) a landscape plan consistent with Code must be prepared by a Florida-licensed
landscape architect, and (11) the applicant has been asked by staff to meet with the
Hacienda Village HOA to determine their concerns and try to ensure maximum
compatibility (staff has not heard whether or not this has occurred).
In short, the general layout for the site appears workable, subject to modifications to meet
code, any modifications that may be required from the traffic study and/or its review by
the City's consultant, or as a result of working with the Hacienda Village HOA. There is
no guarantee that the applicant will have enough usable land to re-plat the proposed
Parcel B. It appears that the 1.36 acre site is already a part of a platted lot that was split
(will require further research).
STAFF RECOMMENDATION: Staff recommends that the City Commission (1)
approve and provide direction as to the general conceptual layout of the proposed site,
but that nothing in the conceptual approval over-ride any applicable Code provision and
(2) that a detailed aesthetic review come back to the Commission for review with the
final engineering/site plan.
