REQUEST: The Community Development Department presents to the City Commission an
APPEAL of the Denial of a Variance request from the requirements of Section 9-3 of the City
Code, to allow further subdivision of a platted lot, pursuant to the criteria set forth in Section 9-5,
The property is located generally at the northeast comer of Panama Road and South Moss Road.
PURPOSE: The purpose of this agenda item is to consider an APPEAL by M. Rebecca
Furman of Lowndes, Drosdick, Droster, Kantor & Reed, P.A. (Applicant) of the Denial of a
Variance to subdivide a platted property into more than 2 lots,

CONSIDERATIONS:
In 1990, North Orlando Ranches, Section 1, Block B, Lot 6 (approximately 5,163 acres) was
divided into 2 lots. The corner was established as one 1.5-acre lot (more or less) with the other
3.6-acre lot (more or less) configured as an "L-shape" surrounding the corner lot and with
frontage on both Panama and Moss Rd, (See attachment.) Section 9-3 of the City Code allows a
platted lot to be re-platted from one lot into two lots as long as each lot meets all applicable
criteria established for that zoning district, as well as other applicable regulations.
This unique lot configuration was the desire of the property owners, Neil & Pearl Backus. They
were the property owners that requested the original split and are still the owners of both parcels,
Currently, Neil and Pearl Backus are trying to sell the larger 3.6-acre parcel. They have a
contract with Paul Ruso who is represented by by M, Rebecca Furman of Lowndes, Drosdick,
Droster, Kantor & Reed, P,A. as the Applicant requesting a variance to subdivide the 3,6-acre lot
into 3 new lots (2 approximately I-acre lots and one approximately 1.5-acre lot). Since the lot
was already split in accordance with Section 9-3 of the City Code, the lot cannot be split again
unless, according to Section 9-5, a variance is granted from this requirement, The code states
that a variance can be granted if all of the variance criteria are met.
Under the existing zoning of "RC-1 ", one-acre lots are the minimum lot size allowed. Lots are
required to have a minimum lot width of 120 feet at the building line as well as other applicable
regulations (e,g create buildable lots that do not compromise applicable zoning, building code,
health department, or wetland setbacks). The proposed lots, meet the minimum dimensions
required under the "RC-1" code. In Winter Springs, the "RC-l" zoning classification is the least
dense residential zoning classification available, Lot sizes range significantly within this
classification. The Applicant has also surveyed the wetland boundary and has determined that
buildable lots would be created (as required under the City's Comprehensive Plan), The site
abuts South Moss Road and Panama Road which are both paved, No new roadway construction
would be required.

The water line adjacent to the property was installed concurrent with the paving of Moss Road in
1998. This gravity sanitary sewer extension was funded by Mr. Backus and conveyed to the City
for ownership and maintenance in approximately 1997. The adjacent homes have connected to
the system and it has the capacity for additional homes.
Under the current future land use designation of Rural Residential, one dwelling unit per acre is
the maximum density allowed, The Rural Residential future land use classification is the lowest
density available in the City. Lot sizes range significantly within this classification.
Section 9-5 of the City Code provides that variances may be granted from this requirement,
"when such variance will not be contrary to the public interest, and where owing to special
conditions, a literal enforcement of the provisions of this chapter would result in unnecessary
hardships, Such variance shall not be granted if it has the effect of nullifying the intent and
purpose of this chapter." The applicant must demonstrate "that special conditions exist which
are peculiar to the lands, structures or required subdivision improvements involved and which are
not applicable to other lands, structures or required subdivision improvements."
The Applicant indicates that the special circumstances that exist are "the unique shape of the lot
along with the physical features of the land severely inhibit the reasonable use of the property"
and that these circumstances are not the result of actions by the Applicant. However, the unique
shape ofthe land is the result of the original lot split as initiated by the property owner. The
stream (or ditch) and its associated wetlands that cross this property and divide the L-shaped
piece existed on the site at the time when the site was previously divided, (It has been suggested
that ifthe configuration of the two existing parcels is a problem, they could be rejoined and
reconfigured into two new lots that are not inhibited by the wetland and which are not "uniquely
shaped".)
The application states that granting the variance will not confer a special privilege because there
are at least 7 other similar subdivisions that have been allowed (e,g. Moss Road Ranches, Seibert
Manor, Morie Subdivision, Susan Woods, Bahama Ranches, VandergraffEstates, and Oak Hill
Estates). These divisions include I-acre parcels but were approved over 20 years ago, during the
time period from 1978 to 1985, The fact that Section 9-3 of the City Code has stood for 30 years
speaks to the City's desire to maintain this requirement.
Section 9-5 requires (the Board of Adjustment make a finding) that each portion of this section
have been met in order to vote for the variance, The Board must "make a finding that the reasons
set forth in the application justify granting the variance and that the variance is the minimum
variance that would make possible the reasonable use ofthe lands, buildings or other
improvements," The Board must additionally make a "finding that the granting of the variance
would be in harmony with the general purpose and intent ofthis chapter and will not be injurious
to the surrounding territory or otherwise detrimental to the public welfare." Additionally, the
Board may prescribe appropriate conditions and safeguards, if they vote in favor of the variance,
Reasonable use of the land is available to the Applicant without granting the variance, No
hardship exists, The request is driven by the applicant's desire to receive greater financial gain,

Letters/Phone Calls In Favor Or Opposition - A letter received on Aug. 31, 2004 from adjacent
property owner D. Brad Phillips and Alisa Harper, opposing the variance. Opposition by four
other property owners in the area was given at the Board of Adjustment meeting. However, one
adjacent property owner was in favor of the variance because she wanted to do likewise with her
property.
FINDINGS:

for setbacks).

The Applicant has not justified the variance request based on the required criteria,
BOARD OF ADJUSTMENT ACTION:
At a regular meeting of the Board of Adjustment, the Board held a Public Hearing on the
proposed variance and voted unanimously to DENY the variance request based on the findings
presented,
STAFF RECOMMENDATION:
Staff recommends that the City Commission UPHOLD the DENIAL based on the findings.

For subdivisions where no now streets, water,
sewer, or drainage structures are involved. appli-
cation for approval of preliminary or final subdi-
vision plans may be waived provided, however,
that a plat, that can be recorded of tho proposed
subdivision shall be submitted for review by the
city staff, The recommendation of the city staff
shall be subject to approval by the city commis-
sion, The purpose of this approval is to ensure
that the proposed subdivision conforms to appli-
cable requirements of the subdivision regulations.

Sec. 9-6. Appeals Crom granting oCvarlances,
(8) Any person, board, taxpayer, department
or bureau of the city, aggrieved by the granting of
any variance, or the failure of granting of any
variance, or by the interpret.ation by the board of
adjustment of t.his chapter may appeal the deci-
sion of the board of adjustment to the city council.
(b) Upon the rendering of an unfavorable de-
cision upon aPI>eal by the city council, ony person,
board, taxpayer, department or bureau of the city,
aggrieved by the granting of any variance or by
the interpretation by city officials of this chapter
may seek review Ulrough a court of record of such
finding or interpret.ation in the manner provided
by the laws of the stat.e,

Sec. 9-7. EnCorcement and penalties.
(a) The city council or any aggrieved person
may have recourse to slIch remedies in law and
equity as may be necessary to ensure compliance

injunctive relief, to enjoin and restrain any per-
son from violating the provisions of this chapter
and any rules and regulations adopted under this
chapter. pnd the court may, upon proof of the
violation 'of this chapter. issue such temporary

prevent the violation of this chapter,
(b) Any person violating or failing to comply
with the terms and provisions specified herein,
shall be punished, upon conviction and at the
discretion of the court, by a fine not to exceed five
hundred dollars ($500,00) or by imprisonment not
exceeding sixty (60) days, or by both fine and
imprisonment. Each day tbat a violation is per-
mitted to exist shall constitute a separate orrense.

Sec. 9.8. Soil, rock, ete,. removal.
(3) It shaH be unlawful for any person to
remove from any real property w:ithin the city any
soil, subsoil, rock. or sand without approml as
provided herein, Prior to such removal such pcr-
son shall file with the city manager an application
which shall include a written consent of the
owner for such removal. The city manager shall
present the application to tho city commission for
its approval. If the commission approves the ap-
plication, the mayor shall issue a written pennit
for such removal.
(b) Unless such removal becomes 1I public nui-
sance or endangers 'the public health. safety or
welfare, no permit would be necessary other than
a building permit for the removal which would be
incident to the preparation of single-family homes
or lluxiliary structures such as patios, swimming
pools or driveways.

Mr. Baker:
My wife and I wanted to send you this letter since we will be unable to attend the meeling
on 9/2/04 in regards 10 the property on South Moss Road and Panama Road being rc-
platted from two lots imo four lots, My wife, Alisa Harper, and rare vcry much against
this plan. When we moved here over two years ago we specifically picked this area
because of the large lots with acreage and few neighbors. There is no other area like this
any'where nearby, We noted when we were buying that the zoning and deed restrictions
stated that the four and five acre lots could only be divided into two 1011' to preserve Ihe
feel and value of the community. We strongly relied on these written rules when
purchasing our property. We teel that the City of Winter Springs should uphold the
zonmg and deed restriclions of the Ranchlands, The sign when enlering the Ranchlands
says "Dedicated to Country Living" not dedicated to subdivisions.
Vole do not want a mini subdivision in our ba~kyard wilh three morc neighbors, We will
do whatever we need to do to fight this change, If this re-plauing takes place then we will
request that our property be re-platted so we can build a subdivision on our property and
then we wilt move. By allowing the rezoning you arc opening it up for all Ranchland
property owners to do the same. There are plenty that will if this changt: is allowed,
There is also the problem of drainage. I believe the back of the property in question is
partly wetlands and should not be built on, Much of this property is lower than our
property and ifbuilt on the property will be raised and drainage diverted right toward our
land,
If the re-platting is done the Ranchlands wjlllose their uniqueness and we believe the
value of these lots will decrease.

Excerpt from Minutes, Oct. 7, 2004
Ms. Sahlstrom said, "Staff recommends denial of this Request." Ms. Sahlstrom stated, 'Unlike
some of the other Variance requests, your decision will stand unless it would be challenged to
the [City] Commission, but you're not making a recommendation to the Commission in this case,
you are actually making the decision.
Staff believes that the Variance Request would be detrimental to the public interest and would
set a precedent that's not been substantiated by the Applicant that there are not Special
Conditions that would result in an unnecessary hardship and that if they had documented that
there were Special Conditions that existed, peculiar to the land that in fact, anything peculiar to
the land would have been self-created hardship because the configuration of the land as it is
today was based on a lot split by the current owner. So, therefore, the unique characteristics of
the parcel are not beyond the control of the property owner and economic disadvantage by not
being able to sell the land for the price he desires does not rise to the level of a legal hardship.
And, any Variance that would be granted would need to be the minimum Variance that could be
granted to make the reasonable use of the land, And, since the land can be used as it stands
today, Ijust conclude by saying Staff recommends denia1."
