COMPREHENSIVE PLAN AMENDMENT ANALYSIS:
The following summarizes the data and issues which staff analyzed in reviewing this
application:
Justification for Future Land Use Desh!nation - The requested future land use map
designation was determined after numerous visioning exercises and workshops with the
Planning & Zoning Board and City Commission from September 2003 to February 2004.
The designation was determined by evaluating the prevailing character and opportunities
of US 17-92, as well as evaluating the existing land use and future goals and objectives
of the City. The subject properties are developed and not expected to change in the near
future and can continue as non-conforming uses per Code, Section 9-562.

Nuisance Potential Of Proposed Use To Surroundine Land Uses - The nuisance
potential of the proposed use resulting from the change of land use designation from
Industrial to Commercial to the surrounding properties should be minimal in view of the
following:
. The proposed FLUM designation will be more consistent with the surrounding areas
than the current designation. Adjacent County parcels along US 17-92 also have a
Commercial Future Land Use.
. No changes are being proposed on the properties.
Natural Lands Compatibility-
The properties under consideration do not include any conservation areas except Parcel E
which is south of Boat Lake. Parcel E is a car dealership. No further expansion or
redevelopment has been proposed. Therefore, no additional impacts to environmentally
sensitive areas are under consideration.

Consistency With The Comprehensive Plan -
The Comprehensive Plan provides the following definitions for Industrial and
Commercial Uses:
lndustrial- The industrial land use category includes both light and heavy industrial uses.
Industrial uses are typically connected with manufacturing, assembly, processing or
storage of products.
Commercial- The commercial land use category consists of a variety of retail and office
uses; such as, medical facilities, shopping centers, restaurants, automobile service
facilities, and similar uses.
The proposed administrative Large Scale Comprehensive Plan Amendment changing the
Winter Springs land use designation of "Industrial" to Winter Springs designation of
"Commercial" is compatible with the historic and proposed use of this area.
FINDINGS:
. The request is consistent with all applicable goals, objectives and policies of the
City's adopted Comprehensive Plan.
. The request is in conformance with the purpose and intent of the City Code and with
all applicable requirements.
. Considering the type and location of uses involved and the general character of the
area, the change of the FLUM designation will not result in any incompatible land
uses, including such factors as height, bulk, scale, intensity, traffic, noise, drainage,
dust, lighting, appearance, and other factors deemed important.
. The request is consistent with Florida Statute Chapter 163, Part II, and Rule 9J-5 of
the Florida Administrative Code, especially related to the protection of off-site and
on-site natural resources.

RE: Opposition to Large Scale Comprehensive Plan Amendment for
Parcels 28-20-30-5AS-OBOO-OI7B and 0160
Ordinance No. 2004-36, First Reading October 25, 2004
Dear Mayor and Commissioners:
I am writing to express my concerns regarding the change of future land use for my
property on US 17-92. The change from industrial to commercial use would make my
property a nonconforming use and would limit my ability to use my property for the
purpose it was developed and affect my ability to derive future income on the property.
Please consider the following timeline and enclosures that show the history and intent of
uses for this property.
1. Contract for Sale and Purchase, July 1979, which shows the contingency that zoning
must allow for industrial uses consistent with the uses of my adjacent Seminole
County property (rebuilding automobiles and paint and body).
2. Ordinance 203, adopted October 2, 1979, changing the zoning from PUD to C-2,
which would be compatible with the surrounding properties, particularly with my
adjacent Seminole County property.
3. Warranty Deed, November 16, 1979, showing my purchase of the property.
4. News Article, September 11, 1980, showing groundbreaking with Winter Springs
Mayor Troy Piland. I built a 10,000 square foot building and operated an automobile
reconstruction business for ten years. After Volkswagon stopped production and the
vehicles became scarce, the best utilization of the building was for manufacture of
sheds, and most recently has been used to manufacture and sell gazebos.
5. Printout of Property Appraisal Information, showing the economic value of my
property and taxes paid to the city.
6. Letter from E. Sahlstrom, July 22,2004, giving notice of proposed land use change,
but the Location Map only showed my parcel of land that is a Florida Power
easement.
Winter Springs City Commission-Page 2
October 2], 2004
7. Letter from my attorney J. Englehardt, August 3, 2004, only addressing the impact to
the easement property because the second parcel with the building was not shown on
the Location Map.
Our letter noted that the land use change would constitute a complete destruction
of the economic value of the easement parcel because no permanent structures can be
built and its only use is for outside storage, which is not allowed under commercial
zoning.
8. Fascimile from E. Sahlstrom to my attorney, October 1, 2004, adding my parcel of
land containing the 10,000 square foot building to the Location Map and giving my
attorney only five days notice of the LP A hearing.
The addition of the building parcel adds significantly to the impact of this land
use change because the existing building type and size is industrial and is not
conducive to commercial uses. The lease with the company manufacturing sheds and
gazebos is expiring within a year, and if they do not renew, the best use of the
property will be automotive, which was its original intent. The proposed change will
make the property nonconforming and put me at high risk because it would be very
difficult to find a tenant who could utilize a 10,000 square foot building
commerciall y.
Thank you for considering my concerns.
Sincerely,
Richard Moretti

Re: Richard Moretti Parcel D, Parcel # 28-20-30-5AS-OBOO-OI7B

Dear Sirs:
Please be advised that I represent Richard Moretti, the owner of a portion of the land
subject to the proposed change of land use from industrial to commerciaL Mr, Moretti's parcel
of land subject to this proposal consi sts of a piece of land subject to a Florida Power easement.
Since the Florida Power easement exists, the only use to which Mr, Moretti can put the
land is outside storage. It is my understanding that the outside storage is prohibited in
commercial zonin.g, For that reason, Mr, Moretti objects to any re-zoning of his land from
industrial to commercial. Such a re-zoning would constitute a com.plete destruction of tl:le
economic value of that parcel of land and would therefore constitute a taking for which Mr.
Moretti would require compensation from the City of Winter-$prings,
Jfyou have any questions please feel fTee to contact me.
