REQUEST: The Community Development Department - Planning Division and City
Attorney request the City Commission conduct a Public Hearing for 2nd Reading and Adoption
of Ordinance 2004-39, annexing 13 parcels containing 21.679 acres, more or less.
PURPOSE: This is an Administrative request to consider for Annexation, thirteen (13)
parcels, located contiguous to the City, as described in an annexation study area report entitled,
South of SR 434 at Tuskawi/la Road Annexation Report ("Report").
APPLICABLE LAW AND PUBLIC POLICY:
Florida Statute Chapter 171. Municipal Annexation or Contraction.
Florida Statute Chapter 171.042. (1) Prior to commencing annexation procedures under s.
171.0413, the governing body of the municipality shall prepare a report setting forth the plans to
provide urban services to any area to be annexed. . .
(2) Prior to commencing the annexation procedures under s. 171.0413, the governing body of the
municipality shall file a copy of the report required by this section with the board of county
commISSIOners.

CONSIDERATIONS:
. The annexation area is located in an unincorporated Seminole County enclave, in the area
south of State Road 434 and west of the intersection of Tuskawilla Road. Annexation of this
area will reduce the size of the enclave and will not create any further enclaves.
. The annexation area is contiguous to the City. Ninety-five percent (95%) of the area's
boundary is surrounded by the City of Winter Springs.
. The annexation area consists of 21.679 acres, more or less, and is predominantly vacant land
with some existing residential structures and one commercial building which will likely be
demolished in the near future. At the time of annexation, there will be no registered electors
living in the annexation area.
. The annexation area is reasonably compact and is developable for urban purposes.
. The City has capacity to provide this area with the same urban services provided to other
areas of the City and annexation will enable the City to continue its work toward providing
efficient use of public facilities and services by reducing an existing county enclave.
. Owners of more than 50 percent of the land and parcels in the study area consent to the
annexation.
. No off-premise sign structures exist on the property under consideration.
. Adjacent property owners have been notified by Certified Mail.
. The property has been posted.
FINDINGS:
. The Report concluded that this area clearly meets the requirements for Annexation as
outlined in Chapter 171 of the Florida Statutes.
. Annexation of this area furthers the State of Florida policy to eliminate enclaves.
. Annexation of this area also furthers the 1987 Interlocal Agreement between the City of
Winter Springs and Seminole County which identified this enclave as an "area of special
concern" to be encouraged to annex into the City.
. Annexation of this Area is consistent with the City's Comprehensive Plan and Zoning Code
which specifically requires this area to be included within the Town Center.

STAFF RECOMMENDATION:

CITY OF WINTER SPRINGS, SEMINOLE COUNTY,
FLORIDA, ANNEXING THIRTEEN (13) PARCELS OF REAL
PROPERTY, CONTAINING 21.679 GROSS ACRES MORE OR
LESS, AND GENERALLY LOCATED ALONG EAST STATE
ROAD 434 AND TUSKA WILLA ROAD, MORE
PARTICULARLY AND LEGALLY DESCRIBED ON EXHIBIT
"A," ATTACHED HERETO AND FULLY INCORPORATED
HEREIN BY THIS REFERENCE; PROVIDING FOR THE
AMENDMENT OF THE WINTER SPRINGS CHARTER,
ARTICLE II, BOUNDARIES, TO INCORPORATE THE REAL
PROPERTY INTO THE CITY BOUNDARIES; PROVIDING
FOR THE FILING OF THE REVISED WINTER SPRINGS
CHARTER WITH THE DEPARTMENT OF STATE;

WHEREAS, HIGHLANDER INVESTMENT L TD, hereinafter "HIGHLANDER I," owns
property identified by Seminole County Tax Parcel ill Number 36-20-30-502-0000-0020, included
in the property described in Exhibit "A," attached hereto and incorporated herein by this reference,
contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, IDGHLANDER INVESTMENT L TD, hereinafter "HIGHLANDER II," owns
property identified by Seminole County Tax Parcel ill Number 36-20-30-502-0000-004A, included
in the property described in Exhibit "A," attached hereto and incorporated herein by this reference,
contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, HIGHLANDER INVESTMENTLTD, hereinafter "HIGHLANDER III," owns
property identified by Seminole County Tax Parcel ill Number 36-20-30-502-0000-004B, included
in the property described in Exhibit "A," attached hereto and incorporated herein by this reference,
contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, HIGHLANDER INVESTMENTLTD, hereinafter "HIGHLANDER IV," owns
property identified by Seminole County Tax Parcel ill Number 36-20-30-502-0000-004C, included

WHEREAS, HIGHLANDER INVESTMENT L TD, hereinafter "HIGHLANDER VI," owns
property identified by Seminole County Tax Parcel ID Number 36-20-30-502-0000-0050, included
in the property described in Exhibit "A," attached hereto and incorporated herein by this reference,
contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, HIGHLANDER INVESTMENT LTD, hereinafter "HIGHLANDER VII,"
owns property identified by Seminole County Tax Parcel ID Number 36-20-30-502-0000-006A,
included in the property described in Exhibit "A," attached hereto and incorporated herein by this
reference, contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, HIGHLANDER INVESTMENT LTD, hereinafter "HIGHLANDER vrn,"
owns property identified by Seminole County Tax Parcel ID Number 36-20-30-502-0000-0060,
included in the property described in Exhibit "A," attached hereto and incorporated herein by this
reference, contiguous to the corporate limits of the City of Winter Springs; and

WHEREAS, the HIGHLANDER I through HIGHLANDER vrn properties are hereinafter
collectively referred to as the "Consenting Annexation Properties," totaling 8 parcels comprising
approximately 11.028 acres and illustrated in Exhibit "B," attached hereto; and
WHEREAS, the City wishes to annex the Consenting Annexation Properties and other
property located adjacent to or near the Consenting Annexation Properties, in accordance with
Chapter 171, Florida Statutes, more specifically described as the ROBBIE AND EDWARD
ONDICK Properties, hereinafter "ONDICK," identified by Seminole County Tax: Parcel ID Numbers
36- 20- 30-502-0000-0070, 36-20-30-502-0000-0080, 36-20-30-502-0000-0090, 36- 20-30-502-0000-
009A, and 26-20-30-5AR-OAOO-008F, included in the property described in Exhibit "A," totaling
5 parcels comprising of approximately 10.651 acres and illustrated in Exhibit "C," attached hereto
and incorporated herein by reference; and
WHEREAS, there are no registered electors on the HIGHLANDER Properties and ONDICK
Properties; and
WHEREAS, the City has determined that the area to be annexed is contiguous and
reasonably compact, is developable for urban purposes, is not within the boundaries of another
municipality, does not have any registered electors, and has met all other requirements of Chapter
171, Florida Statutes, including but no limited to the prerequisites for annexation; and

WHEREAS, the Consenting Property Owner has consented, in writing, to the annexation
of the Consenting Annexation Properties; and
WHEREAS, the Consenting Property Owner is the owner of parcels of land representing
more than fifty percent (50%) of the parcels of land in the area and more than fifty percent (50%)
of the land area to be annexed; and
WHEREAS, the City Commission has determined that the annexation of the Consenting
Annexation Properties and other adjacent and nearby properties as more specifically set forth herein,
have met all procedural requirements and that it will promote sound urban development and efficient
provision of urban services; and
WHEREAS, the annexation is in compliance and consistent with the goals and objectives
of the City of Winter Springs Comprehensive Plan, Charter, and City Code; and
WHEREAS, in the best interest of the public health, safety, and welfare of the citizens of
Winter Springs, the City Commission of the City of Winter Springs desires to annex the real property
generally described below into the municipal boundaries of the City of Winter Springs; and
WHEREAS, upon adoption of this Ordinance, the municipal boundary lines of the City of
Winter Springs, contained in Winter Springs Charter, Article II, shall be redefined to include the
subject real property.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are true and correct and are fully
incorporated herein by this reference.
Section 2. Annexation of Real Property. The real property shall be, and is hereby
annexed into the City of Winter Springs, Florida. This real property is described in Exhibit "A" and
illustrated in Exhibits "B" and "e." The real property shall be known as existing within the
boundaries of the City of Winter Springs, Florida, from the effective date of this ordinance.
Section 3. City Boundaries Redefined; Winter Springs Charter Amended. Pursuant
to Section 166.031(3), Florida Statutes, and Section 171.091, Florida Statutes, the City of Winter
Springs Charter, Article II, Section 2.01, is hereby amended to redefine the corporate boundaries of
the City of Winter Springs to include the area of real property described in Section 2 of this
Ordinance and any public rights-of-way included in the area described in Exhibit "A" and illustrated
in Exhibits "B" and "C." The City Clerk shall file the revised Winter Springs Charter, Article II,
Section 2.01, with the Department of State within thirty (30) days from the effective date of this
Ordinance. The City Clerk shall also file this Ordinance with the Clerk of the Circuit Court of
City of Winter Springs

Seminole County, the Chief Administrator of Seminole County, and the Department of State within
seven (7) days of the effective date.
Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions. All
ordinances and resolutions or parts of ordinances and resolutions in conflict herewith are hereby
repealed to the extent of the conflict.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this Ordinance.
Section 6. Effective Date. This Ordinance shall become effective immediately upon
adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City
Charter.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular

221, Public Records of Seminole County. Florida, being port of the unnumbered lot of Block B, D, R. Mitchell's
Survey of the Levy Grant, recorded In Plat Book 1, Page 5, Public Records of Seminole County. Florida, together
with thot portion of Lot B, Block A, of said D. R. Mitchell's Survey of the Levy Grant, and together with that portion
of the vacated unnamed 30 foot wide right of way iying between them, 011 being more particularly described os
follows:

ANNEXATION REPORT
This report establishes that the proposed annexation of an Annexation Study Area located on the
south of State Road 434 at Tuskawilla Road, meets the requirements for annexation as outlined
in Chapter 171 of the Florida Statutes. The Annexation Study Area consists of approximately
21.679 acres of predominantly vacant land with some existing residential structures and one
commercial building which will likely be demolished in the near future to accommodate new
Town Center development. At the time of annexation, there will be no registered electors living
in the Annexation Study area. This Annexation Study Area Report is provided as fulfillment to
the State requirements of subsection 171.042 of the Florida Statutes, entitled "Prerequisites to
Annexation". Annexation ofthis area furthers the State of Florida policy to eliminate enclaves.
Annexation of this area also furthers the 1987 Interlocal Agreement between the City of Winter
Springs and Seminole County which identified this enclave as an "area of special concern" to be
encouraged to annex into the City. Hence, Seminole County has agreed to encourage and
support annexation of the annexation Area into the corporate boundaries of the City of Winter
Springs. Annexation of this Area is also consistent with the City's Comprehensive Plan and
Zoning Code which specifically requires this area to be included within the Town Center.
Introduction
The annexation area considered in this study is located in unincorporated Seminole County
enclave, in the area south of State Road 434 and west of the intersection of Tuskawilla Road.
(See Exhibit 1 - Location Map.) Ninety-five percent (95%) of the study area's boundary is
surrounded by the City of Winter Springs. The Annexation Study Area is in Seminole County
Commission District #2, which is currently represented by Commissioner Randy Morris. If
annexed into the City of Winter Springs the area will be included in City Commission District
#5, which is now represented by City Commissioner David W. McLeod. (See Exhibit 2-
Commissioner 5 District).
The development pattern within and surrounding the Annexation Study Area is primarily urban
in form and intensity, being part of the Winter Springs Town Center. The Town Center
designation incorporates a mix of uses developed in a neo-traditional manner. The property in
the Annexation Study Area is expected to develop in a pattern consistent with the Town Center
District.
The Annexation Study Area is contiguous to existing city boundaries and is not a part of another
incorporated municipality, but rather is part of an unincorporated County enclave. Although the
Annexation Study Area is not developed, the area is urban in character with at least 60% of its
external boundary adjacent to areas developed for urban purposes. The Annexation Study Area
is located at the major intersection of State Road 434 and Tuskawilla Road and is currently being
used for urban purposes. The Annexation Study Area represents a compact urban form.
Therefore, the Annexation Study Area clearly meets the criteria set forth in subsection 171.043
of the Florida Statutes, entitled, "Character of the Area to be Annexed".
Current and Proposed Future Land Use and Zonin!!
Following annexation, the City of Winter Springs will initiate comprehensive plan amendments
to assign the appropriate City future land use designations for the annexed properties. The
proposed future land use designations and zoning classifications presented in this Annexation
Study Report are preliminary and may be modified once a more detailed land use analysis occurs
when initiating the necessary comprehensive plan amendments. However, a Town Center
designation is likely and already supported by the City's Comprehensive Plan.
Pursuant to Section 171.062 Florida Statutes, Seminole County future land use and zoning
regulations will remain in effect until the City of Winter Springs adopts a comprehensive plan
amendment and zoning for the annexed area. Please refer to Exhibit 3 - Existing Future Land
Use Designations, Exhibit 4 - Proposed Future Land Use Designations, Exhibit 5 - Existing
Zoning, and Exhibit 6 - Proposed Zoning.
Provision of Public Facilities and Services
The table below gives the current service providers and the potential providers that would serve
the community if the annexation ordinance is adopted. Exhibits 7-1 and 7-2 illustrate the
location of City of Winter Springs water & sanitary utility lines and stormwater utility lines in
the area.

What follows is a brief description of how the City of Winter Springs will provide each of the
needed urban services to the South of State Road 434 at Tuskawilla Road Annexation Study
Area upon annexation.
Potable Water:
The Annexation Study Area is not currently served by the City of Winter Springs for potable
water, although a 12" service line extends on the south side of State Road 434 adjacent to the
Annexation Study Area from the west end of the area eastward to Tuskawilla Road and down
that road. If annexed into the City of Winter Springs, the subject properties will be able to
connect to City potable water service.
Wastewater:
Developed lots within the Annexation Study Area are currently served by private septic systems
for wastewater services. If annexed into the City of Winter Springs, the subject properties will
be able to connect to City sewer service, which is currently available along State Road 434 and at
the southeast border of the area.
Reclaimed Water:
Although reclaimed water lines are in place along State Road 434, the City does not have
capacity to service additional areas with reclaimed water at this time.
Electric Service:
The City of Winter Springs, as well as the Annexation Study Area is serviced by Progress
Energy for electric service. If annexed, the Annexation Study Area will remain with Progress
Energy without any interruption of service. Annexation will not impact the current electric rates.
Solid Waste:
The City of Winter Springs currently has a franchise agreement and is serviced by Florida
Recycling, Inc., a private solid waste contractor. Upon annexation, Florida Recycling, Inc. will
provide service to this area.
Stormwater Management:
The Annexation Study Areas will be subject to the City of Winter Springs stormwater utility
program upon annexation. A 36" RCP line runs along State Road 434 on the north side. Smaller
18" Rep lines extend across State Road 434 to drains on the south edge of the pavement. The
area drains to the south and on site stormwater treatment and abatement will be required
consistent with City and SJRWMD regulations.
Police Protection:
The Annexation Study Area is part of "an area of concern" identified within a 1987 InterLocal
Agreement between Seminole County and the City of Winter Springs. The Agreement states
that Seminole County is not able to provide life safety services to these "areas of concern" and
that the City of Winter Springs is responsible for police protection.
Fire Protection:
The Annexation Study Area is part of "an area of concern" identified within a 1987 InterLocal
Agreement between Seminole County and the City of Winter Springs. The Agreement states
that Seminole County is not able to provide life safety services to these "areas of concern" and
that the City of Winter Springs is responsible for fire protection.
Summary:
The South of State Road 434 at Tuskawilla Road Annexation Study Area is contiguous and
compact and upon annexation, will provide a logical extension of City boundaries.
The annexation of the South of State Road 434 at Tuskawilla Road Annexation Study Area
meets the requirements of Chapter 171 of the Florida Statutes. More specifically, this report
entitled, "City of Winter Springs South of State Road 434 at Tuskawilla Road Annexation Study
Area" satisfies the requirement of Section 171.042 of the Florida Statutes entitled, "Prerequisites
to Annexation." In addition, the urban character of the annexation area, meets the urban
purposes requirements set forth in Section 171.043 of the Florida Statutes entitled, "Character of
the Area to be Annexed".
The City of Winter Springs has, and can provide, the necessary public facilities and services to
serve the South of State Road 434 at Tuskawilla Road Annexation Study Area.

in the property described in Exhibit "A," attached hereto and incorporated herein by this reference,
contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, HIGHLANDER INVESTMENT LTD, hereinafter "HIGHLANDER II,"owns
property identified by Seminole County Tax Parcel ID Number 36-20-30-502-0000-004A, included
in the property described in Exhibit "A," attached hereto and incorporated herein by this reference,

reference, contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, HIGHLANDER INVESTMENT LTD, hereinafter "HIGHLANDER VIII,"
owns property identified by Seminole County Tax Parcel ID Number 36-20-30-502-0000-0060,
included in the property described in Exhibit "A," attached hereto and incorporated herein by this
reference, contiguous to the corporate limits of the City of Winter Springs; and
WHEREAS, the HIGHLANDER I through HIGHLANDER VIII properties are hereinafter
collectively referred to as the "Consenting Annexation Properties," totaling 8 parcels comprising
approximately 11.028 acres and illustrated in Exhibit "B," attached hereto; and
WHEREAS, the City wishes to annex the Consenting Annexation Properties and other
property located adjacent to or near the Consenting Annexation Properties, in accordance with
Chapter 171, Florida Statutes, more specifically described as the ROBBIE AND EDWARD
ONDICK Properties, hereinafter "ONDICK," identified by Seminole County Tax Parcel ID Numbers
36-20-30-502-0000-0070, 36-20-30-502-0000-0080, 36-20-30-502-0000-0090, 36-20-30-502-0000-
009A, and 26-20-30-SAR-OA00-008F, included in the property described in Exhibit "A," totaling
5 parcels comprising of approximately 10.651 acres and illustrated in Exhibit "C," attached hereto
and incorporated herein by reference; and
WHEREAS, there are no registered electors on the HIGHLANDER Properties and ONDICK
Properties; and
WHEREAS, the City has determined that the area to be annexed is contiguous and
reasonably compact, is developable for urban purposes, is not within the boundaries of another
municipality, does not have any registered electors, and has met all other requirements of Chapter
171, Florida Statutes, including but no limited to the prerequisites for annexation; and

WHEREAS, the Consenting Property Owner has consented, in writing, to the annexation
of the Consenting Annexation Properties; and
WHEREAS, the Consenting Property Owner is the owner of parcels of land representing
more than fifty percent (50%) of the parcels of land in the area and more than fifty percent (50%)
of the land area to be annexed; and
WHEREAS, the City Commission has determined that the annexation of the Consenting
Annexation Properties and other adjacent and nearby properties as more specifically set forth herein,
have met all procedural requirements and that it will promote sound urban development and efficient
provision of urban services; and
WHEREAS, the annexation is in compliance and consistent with the goals and objectives
of the City of Winter Springs Comprehensive Plan, Charter, and City Code; and
WHEREAS, in the best interest of the public health, safety, and welfare of the citizens of
Winter Springs, the City Commission of the City of Winter Springs desires to annex the real property
generally described below into the municipal boundaries of the City of Winter Springs; and
WHEREAS, upon adoption of this Ordinance, the municipal boundary lines of the City of
Winter Springs, contained in Winter Springs Charter, Article II, shall be redefined to include the
subject real property.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS, A5 FOLLOWS:
Section 1. Recitals. The foregoing recitals are true and correct and are fully
incorporated herein by this reference.
Section 2. Annexation of Real Property. The real property shall be, and is hereby
annexed into the City of Winter Springs, Florida. This real property is described in Exhibit "A" and
illustrated in Exhibits "B" and "C." The real property shall be known as existing within the
boundaries of the City of Winter Springs, Florida, from the effective date of this ordinance.
Section 3. City Boundaries Redefined; Winter Springs Charter Amended. Pursuant
to Section 166.031(3), Florida Statutes, and Section 171.091, Florida Statutes, the City of Winter
Springs Charter, Article II, Section 2.01, is hereby amended to redefine the corporate boundaries of
the City of Winter Springs to include the area of real property described in Section 2 of this
Ordinance and any public rights-of-way included in the area described in Exhibit "A" and illustrated
in Exhibits "B" and "C." The City Clerk shall file the revised Winter Springs Charter, Article II,
Section 2.01, with the Department of State within thirty (30) days from the effective date of this
Ordinance. The City Clerk shall also file this Ordinance with the Clerk of the Circuit Court of
City of Winter Springs

Seminole County, the Chief Administrator of Seminole County, and the Department of State within
seven (7) days of the effective date.
Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions. All
ordinances and resolutions or parts of ordinances and resolutions in conflict herewith are hereby
repealed to the extent of the conflict.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the
validity of the remaining portions of this Ordinance.
Section 6. Effective Date. This Ordinance shall become effective immediately upon
adoption by the City Commission of the City of Winter Springs, Florida, and pursuant to the City
Charter.
