REQUEST: The Community Development Department presents to the City Commission a
request for a special exception to allow an additional telecommunications co-locator to place
ground equipment (associated with co-locating additional antennae on an existing
telecommunications tower) within a 100' x 100' lease site, pursuant to Chapter 30 of the
Seminole County Code.
PURPOSE: The purpose ofthis agenda item is to consider a request by Spectra Site to allow
Sprint to locate equipment on a 100' x 100' lease site, as part of extending the height of the tower
from 156' to as high as 176' and adding Sprint telecommunications antennae. The subject
approximately one quarter acre site is located on an approximately 19.75 acre parcel located on
the east side of Barrington Estates, generally north ofSR 434 and west of De Leon Street. The
100' x 100' lease site is approximately 40' from the eastern edge of Barrington Estates.
All of the property east of Barrington Estates that was annexed into the City still retains its
Seminole County Future Land Use (Rural-3) and Zoning (A-3). Since these properties never
received City Future Land Use designations or Zoning, County land development regulations
apply. Therefore, even though it is located within the City, the City must administer the
County's land development regulations for any development on this site until the City adopts a
Future Land Use designation and Zoning for the site.

unincorporated Seminole County, the Seminole County Board of Adjustment granted a Special
Exception to approve a telecommunications tower at the subject 100' x 100' lease site on the
approximately 19.75 acre tract. At that time, what is now Barrington Estates (formerly Battle
Ridge and subsequently Belfaire) had not received preliminary engineering approval from the
City and was still not developed. The applicant's "Statement of Compliance for Nextel
Communications Special Exception Request" at that time stated that the proposed 156' tall tower
(this height included the 2' tall lightning rod) was 468' (300 percent of the tower's height) from
the nearest residentially zoned property and 550' from the nearest residence (located northeast of
the site). Barrington Estates, which is now located approximately 40' west of the 100' x 100'
lease site, has a Low Density Residential Future Land Use designation (1- 3.5 DU/acre) and R-
IA zoning (minimum 8,000 SF lots). Barrington Estates has subsequently been platted for 110
single family residences and is nearly "built out" (fully constructed). Both Barrington and the
tower site are now within the City's corporate boundaries.
The tower was constructed and a 8' tall chain-link fence with barbed wire on top secures a 78.7'
x 79.7' portion of the site. No landscaping was provided, at that time. Due to the isolated nature
of the site at that time, the applicant sought and received a waiver from the landscape
requirement from the county. The site is served by an unpaved 30' wide extension of Cress Run
(not a public roadway), which intersects the west side of De Leon Street, north of Florida Avenue
and south of Howard Avenue.
On August 26, 2004, Spectra Site applied to the City, on behalf of Sprint, for a permit to extend
the existing 156' tall monopole tower at least an additional 8.5' (could extend by 20'), to co-
locate antennae on the pole, and locate the associated equipment facilities near the base of the
tower, within the fenced portion of the 100' x 100' lease site. Since the existing tower is not
located at one of the specific sites depicted and described for locating telecommunication towers
within the City (Chapter 20, Division 3, Section 20-451 ofthe City Code), staff requested
direction from the City Attorney's office.
The City Attorney's office contacted Seminole County and subsequently received documentation
regarding the existing tower and its approval history. They then provided this documentation and
direction to staff, regarding the applicant's request. The City Attorney's office opined that no
further special exception is required for the tower to be increased by as much as 20' in height
and/or to place the additional antennae on the tower. They did, however, opine that a special
exception is required for the ancillary equipment/facilities, which are located on the ground
within the fenced area. They noted that the special exception could be avoided if the proposed
Sprint equipment could be combined with either of the existing equipment. This, however, may
not be commercially or technically be feasible or preferable.
Section 30.168 of the Seminole County Code (please see attached) states that the general policy
relating to co-location is "to minimize adverse visual impacts associated with the proliferation
and clustering of communication towers, co-location of communication antennas by more than
one (1) carrier on existing or new communication towers is encouraged..." The original site plan
for the tower depicted future areas for co-locators' ground equipment. The primary issue at this
point appears to be whether or not the ground equipment is currently or will be adequately

screened and buffered, given the nearby 110 unit Barrington residential development. The
applicant states that the equipment will extend to about 7 feet tall (shorter than the fence).
Although no residential development application has been received for the properties east of
Barrington Estates, appropriate landscape buffering should be provided all 4 sides of the tower at
once - to ensure uniform plant material, height, and width. Staff has reviewed the applicant's
plans and has recommended modifications to the landscape plan to enhance the buffer and better
ensure plant survivability. The applicant has verbally agreed to those recommendations.
After sending letters to the property owners within 150' of the 19.75 acre parent tract (where the
100' x 100' lease site is located), staff was asked whether or not the tower will be lighted,
whether or not the new equipment will generate or emit noise, whether or not micro-wave
antennae were being proposed, what type of equipment is proposed on the ancillary equipment
pads located on the ground, and whether or not the proposed impervious area would exacerbate
drainage problems within Barrington. Abutters also voiced these concerns at the Board of
Adjustment public hearing. The tower is not lighted and will not be lighted, unless required by
the Federal Aviation Administration (FAA). The ancillary equipment will not generate or emit
noise unless a power outage requires the use of a generator. No microwave dish currently exists
or is proposed there. The ancillary equipment is basically the same as currently exists for the
current locator. The 16' x 20' equipment pad on this 100' x 100' lease site on 19.75 acres is
unlikely to exacerbate any drainage problem that may exist in Barrington or create any new
drainage problem.
CHRONOLOGY:
June 26, 2000 - Seminole County approved the special exception for a telecommunication
tower at this site
August 26, 2004 - City received the plans for the co-location
October 8,2004 - City Attorney's office received information from Seminole County and
provides direction to planning staff about processing the special exception
November 4, 2004 - BOA recommended the special exception be approved
FINDINGS:
l.The site was annexed into the City of Winter Springs but retains the Seminole County A-3
zoning and an R-3 Future Land Use (FLU) designation.
2. Since the site retains its Seminole County Future Land Use designation and zoning, City staff
must apply the applicable county land development regulations to the site.
3. The original submittal (to Seminole County in the year 2000) included a request to waive the
landscape buffer requirement, due to the distance to any residential development (granted).
4. Since the monopole was approved, Barrington Estates was constructed within 40' of the 100'
x 100' lease site.

BOARD OF ADJUSTMENT ACTION: At its regularly scheduled meeting of
November 4, 2004, the Board of Adjustment voted to recommend that the special exception be
approved, subject to staff's landscaping recommendations.
RECOMMENDATION: Both the Board of Adjustment and Staff recommend that the
special exception be appoved, subject to adequate landscape buffering around the approximately
80' x 80' fenced area, as recommended by staff.

Please allow this correspondence to serve as a follow-up to our letter dated
September 13, 2004, regarding the above-referenced matter. In that regard, we have
received the documents requested from Seminole County regarding the cell tower site.
We were pleased to learn the cell tower was approved by special exception on or
about June 26, 2000, by the Seminole County Board of Adjustment. As such and in
accordance with our legal opinion, no further special exception is required for the tower to
be increased in height b)' the requested 20 feet and the placement of an additional array
at the top of the antenna. Please see Section 30.1368(d) of the County Code. The
applicant will, however, be required to obtain a special exception for the ancillary facilities-
which they intend to place on the ground to service the array. As we previously opined,
SpectraSite could avoid this requirement by providing for the co-location of the ancillary
equipment with the existing Nextel equipment. However, we understand this may not be
commercially or technically preferable.
Based on the foregoing, SpectraSite should submit an application for special
exception relating to the ancillary equipment. The special exception will need to be

Section 30.1368, Seminole Co. Code
Sec. 30.1368. Co-location of communication tower antennas.
(a) General policy relating to co-location. To minimize adverse visual impacts associated with
the proliferation and clustering of communication towers, co-location of communication
antennas by more than one (1) carrier on existing or new communication towers is encouraged.
Additional communication antennas proposed on existing Communication Towers are permitted
uses and may co-locate onto existing communication towers if they satisfy the requirements of
this section and no special exception is required.
(b) Procedure for administrative granting of special exceptions. If co-location requires
utilization of real property for construction of ancillary facilities such as equipment rooms, which
uses were not permitted under the applicable zoning code and which uses are expressly
prohibited by prior special exceptions, then such ancillary facilities such as equipment rooms
shall not be deemed a permitted use as a matter of right under this section unless and until a
special exception is issued pursuant to the provisions of this subsection.
(1) The Planning Manager, after consultation with the applicant, shall determine in
conjunction with the Planning and Development Director, consistent with sound and generally
accepted planning and land use principles, whether co-location of ancillary equipment, such as
equipment room, in support of co-located communication antennae are appropriate and meet the
criteria of this section.
(2) Upon a determination that the co-location of ancillary facilities, including equipment
rooms, are appropriate for a parcel, the Planning Manager shall cause a "Notice of Intent to
Allow Co-Location of Communication Tower Ancillary Facilities, Including Equipment Rooms"
to be published in a newspaper of general circulation. The Notice shall, at a minimum, state the
address of the real property and the proposed use. The Notice shall further state that any person
objecting to the use of the property as described must file a notice of objection with the Planning
Division within fifteen (15) days of the publication.
(3) Upon a determination that co-location of Communication Tower ancillary facilities
(including equipment rooms) is not appropriate for the subject property, the applicant may appeal
said decision the Board of County Commissioners by filing a notice of appeal with the Planning
Division within fifteen (15) days of the rendering of the decision. The Planning Division shall
schedule the appeal before the Board. The Board may approve or deny the co-location.
(4) If the Planning Division receives no objections to the Notice, in his or her sole discretion,
then the Planning Manager shall allow the co-location of Communication Tower ancillary
structures (including equipment rooms) as proposed.
(5) The Planning and Development Director shall issue a development order or denial
development order consistent with the determination made under this section.
(c) Type of construction. A communication tower which is modified or reconstructed to
accommodate the co-location ofan additional communication antenna shall be of the same tower
type or a lesser impact tower type, as determined by the Planning Manager based upon the intent
of sections 30.1362 through 30.1370 and sound and generally acceptable planning practices and
principles, as the existing communication tower.

(d) Height. An existing communication tower may be modified or rebuilt to a taller height, not
to exceed twenty (20) feet over the tower's existing height, to accommodate the co-location of an
additional communication antenna. Such a height increase may only occur one (1) time per
communication tower and may be allowed for those sites, which obtained previous special
exception approval. The additional height authorized herein shall not require an additional
distance separation as described in Table 1, section 30.1364. The communication tower's pre-
modification height shall be used to calculate such distance separations.
(e) Site location. A communication tower which is being rebuilt to accommodate the co-
location of an additional communication antenna may be moved on the site to an area located
within fifty (50) feet of its existing location and may also be relocated, with the approval ofthe
Planning Manager based upon sound planning and land use principles and upon a finding that
such approval would be consistent with and further the intent of this Code, in the same manner
on a site which received a previous special exception notwithstanding any condition of approval
relating to the grant of the special exception. After a communication tower is rebuilt to
accommodate co-location, only one (1) tower may remain on the site. A communication tower
relocated on a site shall continue to be measured from the original tower location for purposes of
calculating separation distances between communication towers. A communication tower which
has been relocated on a site and which intrudes into the separation distances required with regard
to property described in Table 1, section 30.1364, shall only be permitted when written consent
as set forth in a recordable instrument is obtained from all property owners within the applicable
separation distance.
(f) Filing of a master plan. To enhance the County's ability to promote the co-location of
communication towers, any communication company that owns or operates a communication
tower in the County or intends to install a communication tower in the County shall file with the
Planning Division a master plan indicating the site of all existing communication towers, any and
all proposed communication tower sites and a statement describing the anticipated
communication tower needs over the next ten (10) years; provided, however, that disclosure of
marketing strategies, trade secrets, commercially privileged information or any other information
that the provider deems would adversely effect his, her or its ability to compete is not required to
be disclosed and the determination of the communication company shall be conclusive. The
master plan shall be filed on or before January 1 of each year. The master plan is not binding. Its
primary purpose is to serve as a mechanism of coordinating co-location of communication towers
between persons and entities involved in that industry.

After reviewing the submit~ed plans for the cell tower landscaping
here is what I noticed n$eding changes.
1. The plan is not signed and sealed by a Florida Landscape
Architect who may be more familiar with local plant selections.
2. There is NO irrigation plan and mus t have at least a one yea:r.'
establishment period of time for newly installed materials.
On a typical site of this type there is a drip emitter system.
3. The wax myrtle plants are spaced too far ap~rt to be a barrier
hedge or proper screen. They need to either be placed closer
on cen tars { i. e. 10' o. c. ) or another plant bab-vaen the ones
shown ( i.c. Sand Cord Grass or Faxahatchie grass).
4. Lodge pole P03ts must NOT be replaced or substituted with an
anchoring sy~tem. ( notes: c on L2 )
5. Guy wires need to be replaced with a flat cloth or synthetic
material liko Gro-tape or other brands that will not cut into
the bark and needs to be removed with~~ the first year.
6. Any B & B Inclterial cannot be \VTapped i.n synthetic material
around the roots.
7. Plant materials must be Filiorida Grades #1 or better and inspect-
ed by the city prior to planting.

Mr. Richard Shirah, Earth Com Services representing Spectra Site, 109 Thompson Cove, Saint
Simons Island, Georgia, stated: "One of the things that we always like to emphasize is that we try
to co-locate whenever possible. Because, just like you folks, other places, we prefer not to build
the towers unless they're really needed". Mr. Shirah further discussed the co-location of the
tower and landscaping.
Vice Chairman Jack Taylor asked, "It's my understanding that you agree basically to these seven
(7) things that you just received tonight from the arborist?"
Mr. Shirah stated, "Yes sir. - We can sign and seal it... the irrigation system if we could just
have you folks work with us on that we'll come up with a system. Obviously, we want to do it as
cheap as we can, but do it adequately. Bring the trees closer together - no problem; the - poles-
doesn't sound like it's anything major so we will do that because we want to make sure the plants
are properly taken care of... we don't have any problems with any of that."
Board Member Fairchild asked, "Would it be impossible to bring in a Florida landscaper as a
consultant?"
Mr. Shirah said, "We will revise our drawings and put it in there - this will not be a big deal for
us."
Chairman Waters opened the "Public Input" portion of the Agenda Item.
Mr. Robert Crosby,1562 Wescott Loop, Winter Springs, Florida (Barrington Estates): spoke
about a notice received from Mr. John Baker, AICP, Senior Planner, Community Development
Department regarding the tower. Mr. Crosby's concems are the noise, lights, additional
structures, landscaping, the height of the tower, and drainage.

Again, they are metal cabinets that will be below the line of the top of the fence, and our
landscaping should deal with that so that it becomes really a better situation out there."

opposite side where it would be less noise intrusion on us."
