REQUEST: The Community Development Department presents a proposed
amendment to the Elementary School "I" site plan.
PURPOSE: The purpose of this Agenda Item is to present the proposed school entrance plan
amendment (without a traffic signal) to the City Commission.
CONSIDERATIONS: On June 23, 2003, the City Commission approved a final site plan
for Elementary School "I," located on the north side ofSR 419, between Wade Street and SR
434, subject to a "Letter of Understanding" (please see attached). The letter of understanding,
among other things, addressed petitioning the FDOT to allow a traffic signal to be placed at the
proposed school entrance. City staff had been opposed to this entrance, or at least having this as
the sole entrance, because they questioned the probability of receiving permission for a traffic
signal at this location and because, based on the City's experience with other school crossings,
staff estimated that the cost of providing officers to manage vehicular and pedestrian access
would cost the City approximately $44,000 per year (2003 dollars). Staff was assured that FDOT
was likely to allow the light at the proposed location. Now the applicant's engineer has
resubmitted plans for the entrance without the traffic signal.
RECOMMENDATION: Staff recommends that the City Commission approve the proposed
change contingent upon the School Board confirming their commitment to fund a traffic signal if
approved by the FDOT in the future..

LETTER OF UNDERSTANDING
TIllS LEITER OF UNDERSTANDING is made and entered into on this day
of June, 2003, by and between the City of Winter Springs, Florida ("City") and the Seminole
County School Board ("School Board").
RECITALS:
WHEREAS, School Board is planning, permitting and constructing a new Elementary
School "1" within the City of Winter Springs on real property generally located on State Road
419; and
WHEREAS, in the year 2003, the City and School Board have previously entered into an
Interlocal Agreement for Public School Facility Planning pursuant to Sections 163.31777 and
1013.33, Florida Statutes ("Interlocal Agreement"); and
WHEREAS, pursuant to Section 7 of the lnterlocal Agreement, the Schooi Board and
City agreed to jointly determine the need for and timing of on-site and off-site improvements
necessary to support each new school and that the parties have the option to enter into a written
agreement, if necessary, as to the timing, location, and governing body responsible for
constructing, operating, and maintaining the required improvements; and
WHEREAS, the School Board and City desire to set forth in writing some of their
. respective responsibilities for the construction of the new Elementary School "I" as more
particularly described herein; and
WHEREAS, Section 1013.33(13), Florida Statutes, allows a local government to impose
reasonable development standards and conditions in accordance with Section 1013.51(1), Florida
Statutes, and to consider the School Board's site plan and its adequacy as it relates to
environmental concerns, health, safety and welfare, and effects on adjacent property; and
WHEREAS, Section 1013.51(1)(a), Florida Statutes, expressly authorizes either party to
expend funds; separately or collectively, by contract or agreement, for infrastructure
improvements upon and contiguous to the proposed educational plant and facility school site
including improvements for roads, byways, sidewalks, sewer, water, stormwater and other
utilities, and for the installation~ operation, and maintenance of traffic control and safety devices;
and

WHEREAS, the City and School Board recognize schools as focal points for community
activities; and
WHEREAS, residential development and population growth in and around the City of
Winter Springs has generated a need for another elementary school.
NOW, THEREFORE, in consideration of the provisions contained in this Letter of
Understanding, and other good and valuable consideration which the parties acknowledge has
been received, the parties agree as follows: .
Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and by this
reference are fully incorporated into this Letter of Understanding.
Section 2. Site Plan. On June 23, 2003 the City Commission approved a site plan submitted
by the School Board for the construction of the new Elementary School "1." A copy of said site
plan is attached here as Exhibit "A" and fully incorporated herein by this reference ("Site
Plan").
Section 3. Construction Date. The City agrees that the School Board is permitted to
commence construction of new Elementary School "I" any time after July 1, 2003 in accordance
with the approved Site Plan and final engineering plans approved by the City Commission.

Traffic Control Devices. Regarding traffic control devices, the following shall
The School Board and City shall cooperate together to petition the Florida
Department of Transportation and Seminole County for permission to install
appropriate traffic control devices, including a traffic signal, crosswalk, and
pedestrian signals, at the school entrance prior to the school opening scheduled
for August 2004. Said devices shall be fully operable prior to the school opening.
The School Board shall pay for the permitting, installation, and maintenance of
. the traffic control devices.
The traffic control devices shall be in accordance with the City's decorative
standards.
The School Board shall install a sidewalk along the south side of State Road 419
from Wade Street to the school entrance.

Permits and Inspections. Regarding permits and inspections, the following shall

The School Board shall permit and inspect all on-site construction per the Florida
Building Code, except arbor, and sign age permits and inspections. It is
acknowledged that construction shall include building, paving, landscaping, and
on-site utilities.

The City shall permit and inspect all off-site construction.

The School Board shall pay the City inspection fees for off-site, City-owned
improvements only.
Section 6. Easement. Upon completion of construction of the sewage lift station and
ancillary lift station facilities (e.g., perimeter fencing, discharge force mains), the School Board
will convey ownership of the lift station and ancillary lift station facilities to the City. In
addition, School Board shall grant an easement to the City on, over, and under the real property
on which the lift station facilities are constructed. Said easement shall be in a form acceptable to
the City. Upon conveyance of the lift station facilities and the easement, the City shall maintain
said facility in the same manner it maintains other sewer infrastructure in the City.
Section 7. Buffer. The School Board shall maintain the natural buffer along the western
boundary of the school site property and install a black vinyl chain-link fence along the said
boundary line. If both parties agree that more buffering is required at a later date, the School
Board will install a masonry wall along applicable portions of the western boundary and obtain
all applicable City permits including arbor. .
Section 8. Cross Seminole Trail. It is acknowledged that pursuant to Resolution 2002-R-
159 of the Seminole County Board of Commissioners, the School Board has access rights across
the Cross Seminole Trail. It is also acknowledged that the School Board and Seminole County
intend to route the Cross Seminole Trail around the school site. The actual location of the Cross
Seminole Trail will be finalized by School Board and Seminole County at a later date. .
Section 9. Dumpster Pad. It is acknowledged that the School Board has a system of
bagging waste prior to discarding the waste in a dumpster that eliminates putrescible waste and
the need to clean refuse cans or food debris at the dumpster pad. Therefore, as long as said
system is utilized by the School Board, and putrescible waste is controlled at the dumpster pad, a
hub drain or catch basin is not required to be installed at the dumpster pad.

Section 10. Old Sanford-Oviedo Road. It is acknowledged that the City prefers to preserve
as much of the old Sanford-Oviedo roadway as possible on the school site. If portions of the
roadway are required to be removed to accommodate the construction of the school, the School
. Board shall make a reasonable effort to re-use any removed roadway pavers to construct
decorative landscape features at the school. The pavers may also be used to complete other
design features of the school and to ensure a safe and level walk1ng surface. If the roadway is
removed in areas where a specimen tree exists, as defined in the City's Arbor Ordinance, the
School Board will use a certified arborist to oversee the removal of the road and to ensure that
specialized arborist procedures are used in that removal to protect any adjacent trees. Because of
this arborist' oversight, no protective barriers are required as specified in the Arbor Ordinance.
Section 11. Vegetative Clearhlg. The following shall apply regarding vegetative clearing:
11.1 Prior to commencing construction, the School Board shall submit to the City a
revised tree survey which will identify all existing trees (4 inch caliper or greater)
that are located on the school site, excluding any trees that are located in the
natural buffer area referenced in Section 7 herein.
11.2 It is acknowledged that a significant amount of vegetative clearing must occur to
construct the new school pursuant to the Site Plan including the removal of no
more than forty-one (41) specimen trees (including 28 cabbage palms) as defined
in the City's Arbor Ordinance. On June 23, 2003, the City Commission found
that pursuant to the Arbor Ordinance, the construction of the new Elementary
School "I" serves a compelling government interest that enhances the Winter
Springs' coinmunity. As such, the City Commission found the School Board
demonstrated an extraordinary hardship and circumstance justifying the removal
of the specimen trees.
11.3 The School Board will pay the arborpermit fees as calculated by the City for the
removal of trees located on the school site. In addition, in accordance with the
compelling government interest finding set forth in Paragraph 11.2, the City
Commission hereby waives all tree hank payment requirements, pursuant to
Section 5-16 of the Arbor Ordinance. However, the School Board shall
implement the landscape plan approved by the City Commission on June 23,
2003.

Requests The City Commission Approve Preliminary And Final Engineering/Site
Plan For The New Elementary School "I" And To Consider The School Board's
Request To Remove Thirteen (13) 20-Inch (Or Greater) Trees.
Ms. Diane Kramer, Deputy Superintendent, Seminole County Public Schools, 400 East
Lake Mary Boulevard, Sanford, Florida: asked about getting a copy of the "Letter of
Understanding" for the School Board's Meeting scheduled for tomorrow and spoke on
this proj ect.
Next, Ms. Kramer spoke of a tree survey, and stated, "We have that to submit to you
tonight." Furthermore, Ms. Kramer stated, "Our survey indicates there are an additional
twenty-eight (28) Cabbage Palms that are twenty inches (20"); so I would have to revise
that to be thirteen (13) specimen trees and twenty-eight (28) Cabbage Palms that would
have to be removed."
Furthermore, Ms Kramer said, "What I would ask is that this agreement give us the
authority to proceed with the demolition of the trees necessary for this project, with the
landscaping plan that we have turned in. That landscaping plan we revised at the
suggestion of yoill' Urban Forester - it has forty (40) Live Oaks, it has seven (7) Winged
Elms, it has thirty-one (31) Laurel Oaks, and thirty-three (33) Palms. We would like for
that to be acceptable as the replacement of trees for this project and that we would not be
putting taxpayer money into the Tree Bank - that we would pay the Arbor Fee to cover
the inspections - that we would not put money into the Tree Bank."
Mayor Bush said to Ms. Kramer, "On the Staff recommendation - what you are saying is
you are adding to what the Staff has recommended, you are adding twenty-eight (28)
Cabbage Palms?" Ms. Kramer responded, "Right. That would be in Section 11.2 of the
Letter of Understanding. I am also asking that our submitted Landscape Plan be
acceptable as the replacement trees, and pay the Arbor Permit Fee which would be the
$100.00 plus ten dollars ($10.00) per tree that is removed; that there would be no
contribution to your Tree Bank."
Deputy Mayor Miller inquired about what would be done with the Cabbage Palms. Ms.
Kramer stated, "If you want to come and pick them up, we will give them to you."
Deputy Mayor Miller added, "Is that an offer?" Ms. Kramer replied, "Yes." Deputy
Mayor Miller then said, "There are companies that sell them and they may be interested
in them - we will get the City Manager to see if can get an offer to come and take them
out." Furthermore, Deputy Mayor Miller stated, "It is on the record, so I will remind you
of that." Ms. Kramer then said, "I have no problem..."

With discussion, Commissioner Blake said to Attorney Garganese, "When we decided to
remove some trees on Central Winds Park - did we not utilize - some special provision
for the interest of the common good that we were able to not replace those? I think it was
a hardship." Attorney Garganese responded and spoke of a Waiver provision in the
Arbor Ordinance and suggested, "If the Commission wanted to waive that requirement,
we would just put it into the Letter of Understanding that has already been drafted, we
will make some modification and the Commission could execute it. I would reference in
the Letter of Understanding the City Commission's authority under the Arbor Ordinance
to waive Waiver requirements." Commissioner Blake added, "When we get to that point,
I would like to make sure that we do that."
Deputy Mayor Miller inquired, "What is the requirement for the City to put in sidewalks
near schools, because there are no sidewalks in that area at all." With brief discussion,
Mayor Bush stated, "I think this may be something that needs to come back to the
Commission." Deputy Mayor Miller added, "We are in the Budget process right now,
and if we need to put that on the Agenda for discussion, we need you to bring it back to
us real quick." Attorney Garganese added, "Deputy Mayor Miller does bring up a good
point, I think the schools and the Cities need to provide appropriate walking conditions
for students to and from the school, and in the event that a hazardous - walking condition
was created - Florida Law requires that hazardous conditions be alleviated within a
reasonable period of time and cooperation between the City, the School Board and any
other governmental entity with jurisdiction." Deputy Mayor Miller said, "Bring it back to
us if you would so that we can put it into the Budget, if we need to."

RE: Layer Elementary (School "I") School; Traffic Signal Commitment
Dear Mr. McLemore:
On June 23, 2003, the City Commission approved the Letter of Understanding (LOU)
between the School Board of Seminole County and the City of Winter Springs regarding
site construction requirements for Layer Elementary School. Section 4 of the LOU
outlined the School Board's commitment to provide a traffic signal at the entrance into the
school from State Road 419. It was understood that the signal placement would require
approval from the Florida Department of Transportation (FOOT).
The school district hired Traffic Planning & Design to perform the warrant study required
by FOOT. The conclusions of the study and the engineer's recommendations were
submitted to City staff on December 22, 2003. The study did not warrant the traffic signal
and instead recommended that a school speed zone be the desired control means for the
intersection. The study did, however, note that a signal could eventually be warranted if
the actual traffic volume exceeds the current and estimated future volume.
FOOT accepted the study and has since issued a permit for the State Road 419 entrance
improvements. As a side note, FOOT did approve Item 4.4 of the LOU and the district is
proceeding with construction of a sidewalk on the south side of SR 419 from the school
entrance crosswalk westward to the intersection of Wade Street and SR 419.
Seminole County Public Schools remains indefinitely committed to the original Letter of
Understanding in that the district will install the traffic signal at the school intersection
when and if FOOT gives permission to proceed. Please do not hesitate to call me if you
