REQUEST: The Community Development Department-Planning, Customer Service, and
Building Inspection Divisions and Public Works Department requests the City Commission
consider granting Multi-Family Residential Units a 90-day extension to the March 1, 2004
compliance date for dumpster enclosures.
PURPOSE: Site constraints for many existing multi-family residential units are making
compliance difficult and resulting in dumpster enclosures located in very visible locations such
as easements and adjacent to street right-of-ways. Staff is gathering data regarding an option of
individual curb-side pick-up. Staff needs time to resolve the details of this option. About 20%
of the property owners impacted by the dumpster enclosure ordinance are Multi-Family.
Should this option be desirable once it is further researched, an amendment to the Franchise
Agreement with Florida Recycling Services would need to be brought before you.
APPLICABLE LAW AND PUBLIC POLICY:
ORDINANCE 2002-13: An ordinance of the city commission of the city of winter springs, florida
establishing minimum standards for screening frorn public view new and existing dumpsters; repealing
winter springs code sections 20-473 (c) and 20-489 (c) generally relating to dumpsters along sr 434;
provisiding an implementation schedule for existing dumpsters; providing for severability; incorporation
into the code; and providing for an effective date.
Section 9-281. (g) All new Dumpsters shall comply with the minimum requirements set forth herein
upon the effective date of this Division. All Dumpsters existing on the effective date of this Division
shall comply with the minimum requirements set forth herein bv March 1. 2004.
ST AFF RECOMMENDATION:
Staff recommends that the Commission Approve a 90-day extension to the dumpster enclosure
compliance date for Multi-Family Residential Units.
