REQUEST: Community Development Department requests that the Commission approve the
the final subdivision re-plat for Wagner's Curve and authorize its recordation.
PURPOSE: The purpose of this agenda item is to approve and record the final subdivision re-
plat for Wagner's Curve (property located generally northwest of the Post Office
and across SR 434 from the Winter Springs High School). This subdivision plat
contains 16.12 acres and creates 2 lots, one for the proposed commercial
development and one for 158 townhouses. The Wagner's Curve plat was
approved on January 27,2003, and the property is being re-platted to modify the
dedication (upper right-hand portion of the I sl sheet) portion of the plat.
APPLICABLE CODE:
Code Section 9-75. Final Pla~ contents and recording procedures.
(a) The final plat shall conform substantially to the approved preliminary plan,
and shall be submitted to the city planner as follows:
(1) The final plat shall include one (I) linen original. Ifmore than one (I) sheet
is required, a suitable index map showing the entire development with index
for the various sheets shall be shown on the first sheet.
(2) The final plat shall show streets, lots, blocks and easements indicating the
centerline, width and sidelines of all easements.
(3) Surveys and surveying data on the final plat shall be in accordance with
acceptable professional practices and principles for land surveying and
preparation of plats. Special consideration shall be given to the relationship of the
proposed plat to existing abutting plats to prevent unintended overlap or omission
oflands.

(4) Mortgage holders shall execute before two (2) witnesses and a notary public
the following certification on plats: "The mortgagee(s) consents and agrees to the
platting of lands embraced in this plat and to the dedication(s) shown herein; and
further, should it become necessary to foreclose the mortgage covering the
property, that all pieces and parcels dedicated to the public will be excluded from
the suit and the dedication shall remain in full force and effect."
(5) A dedication to the public by the owners of all roads, streets, alleys,
easements and other rights-of-way, however designated, shown on the plan for the
perpetual use of all public purposes.
(b) Three (3) copies of all protective or restrictive covenants to be recorded shall
be submitted with the final plat.
(c) A letter from an acceptable abstractor shall certify the following:
(1) That the parties executing the plats are owners of the land included therein.
(2) All recorded mortgages, liens and other encumbrances.
(3) That taxes and assessments have been paid to date.
(4) That the description shown on the plat is correct.
(d) An appropriate bond submitted in accordance with the bonding procedures
set forth in section 9-76 shall be required for all developments within which
improvements are to be dedicated to the public.
Section 9.77. Approval of final plat.
The city commission may approve the final plat, considering any applicable
agency reports, if the plan is in substantial conformity with the approved
preliminary plans and it complies with regulations established by this chapter.
Action by the city commission may be taken expeditiously, but not to exceed
thirty (30) days after receipt of the final plat and supporting data by the city unless
delay is requested or caused by the applicant. If the commission certifies that the
development has met all requirements hereof, the plat shall be endorsed as finally
approved by the mayor and attested by the city clerk in order that the same may be
recorded among the public records of the county.
Code Section 9-78. Recording/distribution of the final plat.
Upon completion of all approval action, the city planner shall be responsible for
ensuring that the original linen is signed and sealed, and the plan and deed

restrictions, if any, are delivered to the appropriate authority for recording. The
developer shall submit to the city the recording fee as specified in the current fee
schedule.
Chapter 177, Florida Statutes.
FINDINGS: 1) Final engineering was approved by the Commission on November 11, 2002.
2) The plat is consistent with the approved final subdivision plan.
3) The plat is consistent with the approved Development Agreement and its
modification.
4) The plat is consistent with the Comprehensive Plan and City Code.
5) The City's surveying consultant has reviewed the plat and has certified that it
meets the platting requirements of Chapter 177, Florida Statutes.
6) The DRC has reviewed the plat and recommends approval, subject to the
following conditions being completed before the City executes and records the
plat:
a. the applicant reimburse the City $350 for the City's surveying
consultant's fee;
b. the City Attorney's review and approval of the plat and title
certification - applicant to make any changes or provide any additional
information required by the City Attorney;
c. inclusion of a 10 foot wide utility easement over the portion of the
commercial site that abuts the SR 434 right-of-way (please see
Attachment B).
RECOMMENDATION:
The recommendation is that the City Commission approve and record the
Wagner's Curve final subdivision, subject to the conditions set forth in item 6 of
the above findings.

PUBLIC UTILITY EASEMENT AND AGREEMENT
THIS UTILITY EASEMENT is made this ~ I day of J,^ I y , 2003, .by
SPRINGS LAND INVESTMENTS, LTD., a Florida limited partnership and JESSUP SHORES
LIMITED PARTNERSHIP, a Florida limited partnership (collectively hereinafter called
"Grantor"), in favor of the CITY OF WINTER SPRINGS,' FLORIDA, a Florida Municipal
Corporation ("Grantee").
WITNESSETH:
WHEREAS, Grantor is fee simple owner of certain real property located within the City of
Winter Springs, Florida; and
. WHEREAS, the Grantor desires to convey a public utility easement to Grantee for purposes
of allowing Grantee to install, operate and maintain public utilities over, under, and across the real
property which is subject to this Easement; and
WHEREAS, the Grantor and Grantee believe that this utility easement is in the best interests
of the public health, safety, and welfare of the citizens of the City of Winter Springs, Florida.
NOW, THEREFORE, in consideration ofthe enumerated public purpose stated herein, and
the mutual covenants, terms, and conditions and restrictions contained herein, together with other
good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the
parties agree as follows:
1. Incorporation of Recitals. The foregoing recitals are hereby incorporated herein
by this reference,

.. 2. Grant of Easement. Grantor hereby voluntarily grants and conveys to Grantee, its
successors and assign~, on behalf of the public, subject to any previously duly recorded easements
or grants of record, a nonexclusive and perpetual public utility easement over, under, and across the
real property described as Exhibit "A, " which is attached hereto and fully incorporated herein by this
reference ("Easement Property"), of the nature and character and to the extent hereinafter set forth
("Easement") .
3. Purpose of Easement. This Easement is granted for the express purpose of allowing
Grantee to perpetually"use the Easement Property to construct, operate, and maintain facilities as may
be reasonably and customarily necessary for Grantee, and others authorized by Grantee, to provide

underground public utilities over, under, and across the Easement Property, subject to the rights of
Grantor herein reserved. It is also the express purpose of this Easement to provide Grantee
unconditional ingress and egress to, over, across, under and from the Easement Property for the .
purposes stated herein.
4. Riehts of Grantee. To accomplish the public purpose stated above, the following
rights are conveyed to Grantee by this ~asement for the benefit of the -public and may, at the
Grantee's sole and absolute discretion and expense, be exercised at any time during the term of this
Easement:
a. To pave the nonexclusive and perpetual use of the Easement Property to
install, operate, and maintain underground public utilities and appurtenant
. structures just above the surface such as manhole covers, fire hydrants, and
utility boxes;
b. To use this Easement for ingress and egress over, upon, and through the
Easement Property for the repair and maintenance of the underground
utilities;
c. To" cut, trim, and keep clean such trees, brush, and undergrowth that might
hinder or prohibit Grantee's and the public's use of the Easement Property
sllbject to the rights of Grantor to lands?ape; and
d. To maintain, inspect, replace, improve the Easement Property consistent with
the purposes set forth herein,
5. Maintenance. Grantee shall bear the cost and responsibility to maintain any
improvements made by Grantee therein in a safe condition. To the extent that Grantee makes any
improvements to the Easement Property, Grantee will restore (less 'reasonable wear and tear) the
Easement Property to the condition that existed at the time the Grantee commenced the
improvements.
6. Public Use. Grantor agrees that the Easement Property and any improvements made
and equipment installed by Grantee, and others authorized by Grantee, thereon shall be dedicated
for public use under the terms and conditions of this Easement.
7. Riehts Reserved by Grantor. Grantor reserves the right to install landscaping,
lighting, irrigation, signage, and parking on Easement Property in accordance with applicable law.
8. Duty Not to Overburden Easement. Grantor and Grantee agree that they,
individually and/or jointly, shall not sUrcharge or overburden the Easement and the use of tl:te
Easement Property as provided hereunder. .

9. Remedies for Default. The parties agree that, in the event of default, there may not.
be an adequate remedy at law and, therefore, the ~ggrieved party shall be entitled to seek injunctive
relief, including a mandatory injunction.

Easement Property. Therefore~ !hIs Easement .shall "run with the. . land" and be a~tomatically
assigned by any deed or other conveyance conveying a portion ofthe Easement Property relating to
this Easement, ~ven though thecpnveyance makes no reference to this Easement as such.

11. Attorneys' Fees. Irithe eveD:t of any legal action arising under this Easement
between the parties, the parti~s agree to bear their own attorneys' fees and costs,
12. Recordation. Grantee shall record this instrument in a timely fashion in the Official
Records of Seminole County, Florida, and may re..,record it at any time as may be required to
preserve its rights in this Easem~nt.
13. Successors. The covenants, terms, conditions, rights, and restrictions of this
Easement shall be binding upon, and inure to the benefit of, the parties hereto and their respective
personal representatives, heirs, successors and assigns and shall continue as a servitude running in
perpetuity with the Easement Property. .. .
14. Grantee's Ri2ht to Terminate. Grantee shall have the right to terminate this
Easement by Written recorded notice of termination, at its sole and absolute discretion, if Grantee
determines there is no longer a public need for this Easement.
15. Entire A~reement. This Easement constitutes the full and entire agreement
between the parties hereto and supercedes any oral or written prior communications between the
parties related to the subject matter contained in this Easement. The laws ofPlorida shall govern this
Easement.
16. Soverei~n Immunity. Nothing contained in this Easement shall be construed as a
waiver of the Grantor's right to sovereign immunity under Section 768.28, Florida Statutes, or other
limitations imposed on the Grantor's potential liability under state or federal law,
17. Modification. This Easement shall only be modified by a written instrument
executed by the parties hereto or any successors, assigns, heirs, or representatives thereto.
