PURPOSE: The purpose of this Agenda Item is to request the Commission hold a Public Hearing for 1 st Reading of Ordinance 2003- 23, amending Winter Springs Code Section 20-463. APPLICABLE LAW AND PUBLIC POLICY Florida Statute 166.041: (procedures for adoption of ordinances and resolutions.) Winter Springs Charter Section 4.15 Ordinances in General. (procedures for adoption of ordinances) Winter Springs Code. Section 20-463. Applicabili{)i to new development overlqy zoning district. CONSIDERATIONS: The eastern boundary of the New Development area as currently defined in the Code is S.R. 417 (Greeneway). Subsequent to the adoption of the S.R. 434 New Development guidelines. The City annexed property east of S.R. 417. FINDINGS: In order for the City to preserve uniform design standards along S.R. 434, the eastern boundary of the New Development Area should be extended to the easternmost boundary of the City. June 9, 2003 Public Hearing Item L This amendment would also allow for any future annexations east of SR along S.R. 434 that the City Commission may adopt east of SR 417. The following desib'11 standards shall apply to the New Development Overlay Zoning Di~'trict which includes all properties adjacenlto the S.R. 434 right-of-way from Hayes Road eastward to S.R.. 417 (the "Gre~lIe WCiIj" the easternmost boundary of the City of Winter Springs with cxdusion(s) indicated in Ordinance No. 675. :~ Section 3. Repeal ofPrio.' Incon~istent Ordinances and Resolutions. All prior inc()nsi~tent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and resolutions in cl1tHlicl herewith, ate hereby repealed to the extent of the coritlict. Section 4. Incorporation Into Code. This Ordinance shall be incorporated into the Winter Springs City Code and any section or paragraph number or letter and any heading may be changed or modified as neces.~ary to effectuate the foregoing. ~ Section 5. Severability. If any section, subsection, sentence, clause, phrase, word or provision of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, whether for substantive, pro~dural, or any other leason, sUl:h portion shall be deemed a separate, distinct and independent provi~i()n, and such holding shall not affect the validity of the renlaining portions ofthis Ordinance.
