REQUEST:
The Community Development Department requests that the City Commission, in its capacity as
the DRC, consider the James Doran Company's request to change the floor plan and building
elevations as part of the partition of the remaining portion of Building No 8 (that part not
occupied by Leslie's Pool Supply).
PURPOSE:
The purpose of this agenda item is to review the amended building elevations and floor plan for
Building No.8 at the JDC Town Center (e.g. interior partitions and 2 additional doors).
CONSIDERATIONS:
The staffDRC reviewed the building elevations and floor plans for Building No.8 on October 1,
2002, and recommended approval of those plan. The building appears to meet all applicable
regulations and requirements - actual building plans must depict all the pertinent information.
Any variations from the codes, that may arise in the future, would require the plans to come back
to the City Commission for formal approval.
FINDINGS:
Building 8: The architectural depictions and floor-plan layout of building 8 appear consistent
with the Town Center Code and with the approved site plan.

RECOMMENDATIONS:
Staff recommends that the City Commission, in its capacity as the DRC, approve the revised
Building No.8 architectural renderings and floor-plan, subject to the condition that the interior
partitions and individual tenant build-outs ensure the front of the building and its main entrance
face the primary space, as set forth in the Town Center Code. In other words, for Building No.8,
the actual main entrance/front door and business front must be facing SR 434, which is the
primary space (to avoid a situation similar to Building No.9, where several businesses clearly are
oriented toward the parking lot).

REQUEST:
The Community Development Department Arborist recommends the City Commission consider the
request of Mr. Hany Migdal to remove 1 specimen sweet gum, approximately 20 inches in diameter.
PURPOSE:
The purpose of this agenda item is for the City Commission to consider Mr. Migdal's request to remove a
specimen (20 inch diameter) sweet gwn tree at 312 MacGregor Road, as required by Section 5-8 of the
City Code of Ordinances. The specimen tree is located in the back yard about nine feet from the house.
The applicant states that he wants to remove the tree because the stress is causing limbs to die and fallout
and the roots are damaging the neighbor's patio. He has stated a willingness to replace the tree.
APPLICABLE LAW AND PUBLIC POLICY:
On April 8, 2002, Chapter 5 of the City Code was repealed and replaced with Ordinance No. 2002-08
(pertinent sections enclosed as attachments).

FINDINGS:
1) Section 5-8.b of the Arbor Ordinance provides that a specimen tree shall not be removed
except for extraordinary circumstances and hardships and only by fmal pennit approval by the
City Commission.
2) In this application the applicant states that the owner wants this tree removed for the following
reasons:
a) The owner does not want the tree to fall on his house.
b) The neighbor's property is being damaged.
Public Safety
Staff analysis of the site in this application reveals evidence of
public safety issues caused by the tree. The weak points in the tree trunk
could break and the tree would do damage to both houses under it.
Conclusion
Staff's review of this application concludes that the applicant's request is based
upon safety issues that constitute verification of extraordinary
circumstances and hardship.
STAFF RECOMMENDATION:
Based upon staff's review of the facts related to this application, Staff recommends that the City
Commission approve the request to remove the 20 inch diameter specimen sweet gum tree from 312
. MacGregor Road.

Waivers. The City Commission may grant a waiver to provisions of this Chapter
where the applicant demonstrates that the literal interpretation of the ordinance will
deny the applicant reasonable use of the .property or where 'such wai~et can be
demonstrated to bC--conslstent with the purpose and intent of the ordinance. The
preservation of any approved Tree over four (4) inches in caliper may be considered
as the basis for the granting ofa waiver from the literal application of the provisions
of the City's land development regulations. If. in the detennination of the Citx
Commission. the sole basis for the request" for waiver is to preserve such Tree which
would otherwise have to be removed. it may direct any required waiver fee to be
waived. '

Gentlemen,
We are requesting permission to remove a large Sweet Gum tree from our property. The
tree sits dangerously close to our home as well as that of our neighbor.
The tree is leaning towards our home and overhangs the rear patio of the house next door.
Over the past several months a number of branches have fallen during windy weather
narrowly missing the patio and our roof If the tree were to come down in severe weather
the master bedrooms of each of our homes could be in the line of descent.
The rear of our home faces the golf course and prevailing west winds from this open area
increase our danger. In view of the present weather season we ask for a timely response.
We have had tree people confirm that there are signs of stress in the upper portion of the
tree. Mr. Mike Minega, the City Forester agrees with our assessment of the situation.
We agree with the City of Winter Springs that trees of any size should not be removed
arbitrarily but we believe "a clear and present danger" exists in this case.
We are enclosing photographs with comments to give you a better idea of our concern.
Regretfully, we have earlier obligations which will keep us away from home later in the
month and therefore unable to present this personally at the Commission meeting.
