REQUEST;
To approve Resolution No. 2003~ 17 to vacate a portion of the drainage easement which is set forth
in Plat Book 51, Page 1, of the Public Records of Seminole County, Florida.
')
PURPOSE:
Rick and Laura Miller own the real property at 703 Palenci Court, in Winter Springs In or about the
summer of2002, the Millers' contracted with Sunrise Pools and Spas to construct a screen enclosure
upon their property. The constructed enclosure encroaches into a twenty (20) foot drainage casement
which is dedicated to the City of Winter Springs and the Seville Chase Homeowners Association.
The maximum encroachment is approximately ten (10) inches. Sunrise Pool and Spas admitted to
the encroachment and attributed the same to ils difficulty in using a 40-scale plat survey to construct
the project.
The Miller's sought a variance from the City to allow the encroachment to remain. The City
Commission denied the variance request. Such denial was appropriate as the City Commission did
not have jurisdiction to grant a variance because the applicable restriction was not contained within
the City Code, but instead a covenant running with the land.
The Miller's have obtained a letter dated Februa.ry 28, 2002 from the St. Johns River Water
Management District, wherein the District has determined that said encroachment was minor in nature

and would not interfere with the function of the drainage facility.
The Se\~lle Chase Homeowners Association has prepared and recorded a resolution vacating its
interest in t.he portion of the drainage easement which contains the easement. The Millers are now
asking, based upon hardship, that the City vacate in interest in the drainage easement where the
encroachment exists.
APPLICABLE LAW AND PUBLIC POLICY:
Section 2(b), Art. VUl of the State Constitution gives the municipalities the authority to exercise any
power for municipal purposes, except when expressly prohibited by law
CONSIDERA TTONS:
A. If the City Commission does not vacate its interest in the encroached portion of the
drainage easement, the property owners will be required to remove any and all
encroachments
B. The drainage easement was created and dedicated to the benefit of the City and the
homeowners association for the collection, retention, detention and drainage of storm
water from Seville Chase. The stom, water collection system Vlas permitted and
approved originally by S1. John' 5 River Water Management District, and the District
has indicated the encroachment should have no effect on the storm water system.
C. Approval of the requested vacation could set a precedent that encroachments into
City easements will be allowed. Such requests, however, will be reviewed on a case
by case basis, and would lie with the facts presented, and other requests for vacations
could be denied provided the Commissions decision was not arbitrary or capricious.
STAFF RECOMMENDATION:
To approve the Resolution to vacate a portion of the drainage easement which is set forth in
Plat Book 51, Page 1, of the Public Records of Seminole County, Florida.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF' WINTER SPRINGS, FLORIDA, RELATING TO
THE PARTIAL VACATION OF A DRAINAGE EASEMENT;
PROVIDING FOR THE REPEAL OF PRIOR lNCONSISTI!:NT
RESOLUTIONS; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Declaration of Covenants, Conditions, Fasements and Restrictions ofSe'ville
Chase, recorded in Book 3124, Page 0839, of the Public Records of Seminole County, cr~ated and
dedicated a twenty (20) foot drainage easement, as sel forth in Plat Book 51, Page 1, of the Public
Records of Seminole County, for the benefit of the City of Winter Springs and the Seville Chase
Horne Ov.mers Association, and
\VIIEREAS, the City and Seville Chase Home Owners A!;sociation have. been asked to vacate
a small portion of said drainage casement due to the unintended em;roachment of screened pool
l:nc1osure located at 703 Palenci Court; and
WHEREAS, the St. John's River Water Management Di~trict has determined, by letter dated
February 28, 2003, that such encroachment is "minor" in nature and will not interfere with the
function of the drainage easement; and
WHEREAS, Seville Chase has recorded its Resolution Vacating Portion of Drainage
Easement, dated March 27,2003; and
WHEREAS, the City finds it is in the best interest of the health, safety, and welfare of the
citizens of the City of Winter Springs to vacate, as described in Exhibit" A" attached herl:to and
incorporated herein, a portion of said drainage easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CIIT OF WL~TER SPRINGS, SEMINOLE COUNTY, .FLORIDA, AS FOLLOWS:

Section 4. Repeal of Prior Inconsistent Resolutions: All prior inconsistent resolutions
adopted by the City Commission are hereby repealed.
Section 5. Severability: If any section, clause, phrase, word, or provision is for any
reason held invalid or unconstitutional by a court of competent jurisdict.ion, whether for
substantive or procedural reasons, such portion shall be deemed a separate, distinct, and
independent provision, and such holding shall not atTe.ct the validity of the remaining portions
of this resolution.
Section 6. Effective Date: Tllis resolution shall become effective immediately upon
passage by the City Commission of the City of Winter Springs, Florida, and pursuant to the
City Charter.
DONE AND ADOPTED in regular ses~ion of the City Commission of the City of Winter

abov~referenced project. It is (he Districl' s understanding that the recenl con~(ruclion uf the
southeast comer of the pool deck has encroached approximately] 1 inches into the 20-foot
drainage easement at the rear of the property.
Based on the information you have provided. the Dislrict has determined thai the minor
encroachment of the pool deck into (he drainage: ellsemcnl will not interfere with iL~ function.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, RELATING TO
THE PARTIAL VACATION OF A DRAINAGE EASEMENT;
PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT
RESOLUTIONS; AND PROVIDING FOR AN EFFECTIVE
DATE
WHEREAS, the Declaration of Covenants, Conditions, Easements and Restrictions of Seville
Chase, recorded in Book 3124, Page 0839, of the Public Records of Seminole County, created and
dedicated a twenty (20) foot drainage easement, as set forth in Plat Book 51, Page I, of the Public
Records of Seminole County, for the benefit of the City of Winter Springs and the Seville Chase
Home Owners Association; and
WHEREAS, the City and Seville Chase Home Owners Association have been asked to vacate
a small portion of said drainage easement due to the unintended encroachment of screened pool
enclosure located at 703 Palenci Court; and
WHEREAS, the St. John's River Water Management District has determined, by letter dated
February 28, 2003, that such encroachment is "minor" in nature and will not interfere with the
function of the drainage easement; and
WHEREAS, Seville Chase has recorded its Resolution Vacating Portion of Drainage
Easement, dated March 27,2003; and
WHEREAS, the City finds it is in the best interest of the health, safety, and welfare of the
citizens of the City of Winter Springs to vacate, as described in Exhibit "A" attached hereto and
incorporated herein, a portion of said drainage easement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:
Section 1.

Recitals: The foregoing recitals are affirmed and incorporated as part of this

The City of Winter Springs hereby vacates, as described in Exhibit "A" hereto, a portion of

Section 3. Repeal of Prior Inconsistent Resolutions: All prior inconsistent resolutions
adopted by the City Commission are hereby repealed.
Section 4. Severability: If any section, clause, phrase, word, or provision is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, whether for
substantive or procedural reasons, such portion shall be deemed a separate, distinct, and
independent provision, and such holding shall not affect the validity of the remaining portions
of this resolution.
Section 5. Effective Date: This resolution shall become effective immediately upon
passage by the City Commission of the City of Winter Springs, Florida, and pursuant to the
City Charter.
DONE AND ADOPTED in regular session of the City Commission of the City of Winter
