REQUEST: The Community Development Department recommends the City Commission
hear a request by Thomas Sign and Awning, on behalf of Discount Auto Parts, for a variance
from Section 20-486 of the City Code of Ordinances, to authorize a new approximately 21.55
square foot building-mounted single tenant identification sign to be constructed on the SR 434
(south) side of the building, within the SR 434 Redevelopment Overlay Zoning District.
PURPOSE: The purpose of this agenda item is to consider a request for a variance from
Section 20-486 of the City Code of Ordinances to allow a 21.55 square foot building mounted
single tenant identification sign to replace the existing compliant 16 square foot sign. Discount
Auto Parts changed its name to "Advance Discount Auto Parts" and the applicant wants to
include a sign that incorporates the new name at a size that can adequately be recognized from
SR 434. The applicant had requested a 61 square foot single tenant building mounted sign,
stated at the meeting a willingness to reduce the size to 44.81square feet, but reduced the
proposed size to 21.55 square feet after the Board of Adjustment meeting - in response to the
Board and staff recommendations.
The existing monument sign is proposed to be amended to incorporate the change, but no
variance is requested or appears necessary for this sign. The sign must be made to fully
conform with the Code, including, but not limited to, landscape plantings around the base of
the monument sign.
APPLICABLE CODE:
Sec. 20-82. Duties and Powers; general.
The Board of Adjustment shall make recommendations to the City Commission to
grant any variance or special exception as delineated in this chapter.

(1) The board of adjustment shall have the additional following specific powers
and duties:
a.

C. To recommend upon appeal such variance from the terms of this
chapter as will not be contrary to the public interest where, owing to
special conditions, a literal enforcement of the provisions ofthis
chapter will result in unnecessary and undue hardship. In order to
recommend any variance from the terms of this chapter, the board of
adjustment must and shall find:
1. That special conditions and circumstances exist which are
peculiar to the land, structure or building and which are not
applicable to other lands, structures or buildings in the same
zoning district;
2. That the special conditions and circumstances do not result from
the actions of the applicant;
3. That granting the variance requested will not confer on the
applicant any special privilege that is denied by this chapter to
other lands, buildings or structures in the same zoning district;
4. That literal interpretation of the provisions of this chapter would
deprive the applicant of rights commonly enjoyed by other
properties in the same zoning district under the terms of this
chapter and would work unnecessary hardship on the applicant;
5. That the variance granted is the minimum variance that will
make possible the reasonable use of the land, building or
structure;
6. That the grant of the variance will be in harmony with the
general intent and purpose of this chapter, will not be injurious to
the neighborhood, or otherwise detrimental to the public welfare.
(2) In recommending the granting of any variance, the board of adjustment may
recommend appropriate conditions and safeguards. Violations of such
conditions and safeguards, when made part of the terms under which the
variance is granted, shall be deemed a violation of the chapter. The board
of adjustment may recommend a reasonable time limit within which the
action for which the variance is required shall be begun or completed, or
both.

Sec. 20-103. Restrictions upon lands, buildings and structures.
(c) Percentage of occupancy (lot). No building or structure shall be erected. . . nor shall any
open space surrounding any building or structure be encroached upon or reduced in any
manner except in conformance with the building site requirements. .. for the district in which
such building or structure is located.
Sec. 20-486. Signs.
All signs and sign elements, including shape, form, lighting, materials, size, color and location
shall be subject to approval by the design review board if such signs or sign elements are
visible from adjacent properties or a street right-of-way.
(2) Ground mounted single-tenant identification sign: One (1) wide-based monument style
permanent project identification sign shall be pemlitted per single-tenant parcel. One
additional permanent wide-based monument style project identification sign may be permitted
for parcels in excess of one (1) acre with more than one (1) ingress/egress serving more than
one (1) building. The minimum separation for all signs on an individual ownership parcel
shall be two hundred (200) feet.
a. Shall only advertise one (1) person, fiml, company, corporation or major enterprise
occupying the premises.
b. Shall be located no closer than ten (10) feet from the front, side or rear property lines.
c. Shall not exceed two (2) faces.
d. Sign copy area shall not exceed thirty-two (32) square feet per face. For parcels in
excess of four (4.0) acres, the project identification sign face may be increased to forty-
eight (48) square feet.
e. Shall be consistent in design, format and materials with the architecture of the proposed
building.
f. The sign shall not be more than eight (8) feet in height above the closest driveway or
vehicular use area.
g. Signs shall be in an enclosed base a minimum width of two-thirds (2/3) the width of the
sign. Landscaping shall be incorporated around the base to include low growing shrubs
and ground cover and/or annuals to promote color.
(4) Building mounted single tenant identification sign: In addition to the ground-mounted
identification sign, a building mounted identification sign may be permitted consistent with the
following criteria:
a. Shall only advertise one (1) person, firm, company, corporation or major enterprise
occupying the premises.
b. The identification sign is located on the exterior wall of a building.
c. The sign shall be clearly integrated with the architecture.

(5) Additional Signs/Variance: Under special circumstances, such as for parcels on corner
lots, additional signs c:onsistent with these design standards may be approved by the city
commission, upon a request submitted to the board of adjustment pursuant to section 20-82
and 20-83 or [sic] the city Code. The board of adjustment shall recommend variances of this
sign code in specific cases where such variances will not be contrary to the public interest and
where, due to special conditions, a literal translation of this sign code would result in
unnecessary hardship. All requirements, procedures, findings and appeals of sign code
variances shall follow those provisions for zoning variances.
CONSIDERATIONS:
On November 10, 1997, the City Commission adopted Ordinance No. 683, which, among other
things, created the SR 434 Redevelopment Overlay Zoning District. The subject site has C-l
Zoning, a Commercial Future Land Use designation, and is located within the SR 434
Redevelopment Overla.y Zoning District.
The applicant proposes. to replace an existing conforming building mounted single tenant
identification sign with a 21.55 square foot sign, which is 1.35 times as large as the permissible
16 square foot. The originally requested 61 square foot sign was 3.8 times the allowed 16
square feet. At the November 6, 2003, Board of Adjustment meeting, Mr. Gregory Davis, of
Thomas Sign and Awning Company, stated to the Board that the applicant was willing to
decrease the size of the proposed sign to 44.81 square feet (2.8 times the allowed 16 square
feet).
The Board questioned the need for a large sign on the building when the monument sign
between the store and SR 434 is very visible. They also asked what the copy area would be if
the word "Advance" were added to the existing sign and further asked what the copy area
would be ifthe sign were re-designed to emphasize the word "Advance." Mr. Davis noted that
there is a size threshold below which it becomes almost impossible to create individual
internally lighted letters. Mr. Davis stated that he would address these issues with the owner.
The applicant subsequently amended the request to an approximately 21.55 square foot sign
(1.35 times the allowed 16 square feet) in response to the Board of Adjustment discussion and
vote (letter and diagram received December 31,2003).
The applicant states that the new proposed sign would retain the same letter size as the existing
sign, but include the word "Advance" large enough to read from the adjacent SR 434 roadway.
The Code does specifically provide for variances for additional signs on comer lots (see above
in bold), but does not provide these additional signs as a right. Although the concept is similar,
this request is not for an additional sign, it is for additional sign area. Unfortunately for the

applicant, even if this were to apply (staff believes it does not apply), the same variance criteria
appear to govern granting a variance for additional signs as for other zoning code variances.
FINDINGS:
1).The subject site, 620 W. SR 434, is a separate out-parcel adjacent to Village
Marketplace (a.k.a. Badcock) Shopping Center, is located within the C-l zoning
district, the Commercial Future Land Use desib'11ation, and the SR 434
Redevel.opment Overlay Zoning District.
2). The SR 434 Redevelopment Overlay Zoning District sign standards have
been in effect since November 10,1997, with the adoption of Ordinance No.
683.
3).On or about September 18,2003, the variance application was received by
the City, for a variance to allow a building mounted single tenant identification
Sign.
5).The Board of Adjustment is required by Code to find that the variance
request meets all six variance criteria, set forth in Subsection 20-82 (1) (c), in
order to recommend approval.
6). Staff does not find that the variance meets all of the six criteria for a
varIance:
1. !there are no conditions or circumstances peculiar to the land,
structure, or buildings which are not applicabh~ to other lands,
structures, or buildings in the same SR 434 Redlevelopment Overlay
Zoning district;
2. special conditions and circumstances are the result of the
applicant's client changing its name;
3. l~ranting the variance requested would convey on the applicant
special privileges that is denied by this chapter to other lands,
buildings or structures in the same overlay zoning district;
4. a literal interpretation of the provisions of this chapter would not
deprive the applicant of rights commonly enjoyed by other
properties in the same overlay zoning district under the terms of
this chapter and would not work an unnecessary hardship on the
applicant;
5. the variance requested is not the minimum variance that will make
possible the reasonable use of the land, building or structure; and
6. granting the variance requested would not be in harmony with the
~~eneral intent and purpose of this chapter and would undermine the
Code, which could be injurious to the neighborhood, or otherwise
detrimental to the public welfare.
7). A financial hardship does not constitute a hardship in terms of granting a
varIance.

8). At its regularly scheduled meeting on November 6, 2003, the Board of
Adjustment voted 4-0 to recommend denying a 61 or 44.81 square foot building
mounted single tenant identification sign.
9). On December 31, 2003, the City received an amended request for an
approximately 21.55 square foot building mounted single tenant identification
sign. A Thomas Sign representative stated that this is the result of staff and
BOA discussions and recommendations and that they are willing to take this
modified request forward, without going back to the BOA, based on that input.
BOA ACTION:
At its regularly scheduled meeting of November 6, 2003, the Board of Adjustment heard a
request for first a 61 square foot building mounted single tenant identification - the Thomas
Sign representative verbally decreased the request to 44.81 square feet. The Board voted 4-0 to
recommend the request be denied.
RECOMMENDATION:
The Board of Adjustment recommended that the City Commission deny the variance request
for both a 61 or 44.81 square foot building mounted single tenant identification sign, pursuant
to the six variance criteria set forth in Subsection 20-82 (1) (c) of the City Code of Ordinances.
Staff appreciates the applicant's efforts to accommodate the Board's concerns and to make a
reasonable request, but recommends that the City Commission deny the applicant's modified
request (21.55 square feet) for the variance, based on the six variance criteria.

Advance Discount Auto Parts is on a shopping center outparcel. The signage allowance for
businesses in that center appears to be more liberal, relative to their store width, based on
the signage installed and the code allowances (please see attached photo #1). The property
Advance Discount Auto Parts owns is beautifully landscaped, however the landscaping
interferes with the sign visibility (please see photo #2).

The circumstances and conditions causing the hardship are not the result of the action of the
applicant.
3. ThaI granting the variance requested will not confer on the applicanl any special privilege that is
denied by this chapter to other lands, buildings or structures in the same zoning district.
We do not believe that the intent of the code as written was to deprive businesses of the
ability to be adequately identified. We therefore do not believe this request is for a special
privilege, but rather an adjustment based on conditions.
4. That literal interpretation of the provisions of this chapter would deprive the applicant of rights
commonly enjoyed by other properties in the same zoning district under the terms of this
chapter and would work unnecessary hardship on the applicant.
Advance Auto Parts is a national chain, which has acquired the Discount Auto Parts chain.
Their registered name in the state of Florida is Advance Discount Auto Parts, and they are in
the process of changing the store identification statewide out to the revised name. Given the
length of their legal name the 16 square foot allowed would not proVide a sign large enough
to be read form any distance beyond their parking lot. The existing sign meets the square
foot requirement. It has less letters, has 12" high upper case copy and at that size is almost
impossible to read (please see photo#3 taken 40' from sign in the parkin9 lot; photo#4 taken
130' from the sign to the edge of 434; and photo#2 taken 200' from the sign to the corner of
434 & Sherry Ave.). To meet the square foot requirement the new sign would have to be
even smaller letters.
Under Sec.20-470 (3) f. & g multi-tenant wall sign would be allowed up to 24" letters not to
exceed 70% of the fascia width. If allowed to comply with this section we feel that 21"
(upper case) set of letters with a width of 34'-10" (<50% of 75' building width) would be
reasonable and would still meet the intent of the code, which we do not believe was meant
to be punitive to bu.sinesses with a long name.
Under Sec.20 (5) Additional signs there is a provision for requesting an additional sign for the
wall facing Sherry Ave., since this is a corner lot. We would not be pursuing that option
feeling that one readable sign at 21" would be sufficient identification.

As addressed in item #4, we feel 21" high channel letters would make possible the
reasonable use of the' property.

As previously stated, we believe our request to be in compliance with the intent of the code

Auto Parts For A Variance From The Sign Requirements Of Section 20-486. For
The Retail Facility At 380 East State Road 434.
Mr. John Baker, AlCP, Senior Planner, Community Development Department, read the
request for a variance to replace the existing 16 square feet wall sign to 61 square feet of
wall sign to accommodate the new name "Advanced Discount Auto Parts". The staff
does not believe they meet all six (6) criteria, and can not reC0fl1l11end. approval of this
variance request.
Discussion.
Gregory Davis, 4590 - 118 Avenue North, Clearwater, Florida, from Thomas Sign and
Awning Company representing owners of Advanced Discount Auto Parts, in their request
to change the existing sign on their building because of a name change.
Gregory Davis presented pictures of the building and what the new sign would look like
and passed a color sample to the Board of Adjustment. Mr. Davis informed the Board.
that the owners of the property are willing to decrease our request from the existing
signage request to 44.81 square feet.

signage.
On the City of Winter Springs web site calendar, there are two
meeting listed - Planning & Zoning at 7pm on 117/04 and City
Commission at 6:30pm on 1/12/04. Should we attend both of
these meetings or which one should we be planning to attend?
