REQUEST:
The Community Development Department Arborist recommends the City
Commission consider the request ofMr. Uwe Pagenkopf to remove 1
specimen long-leaf pine tree, approximately 21 inches in diameter, from
the west side of the lot, in order to protect the home structure.
PURPOSE:
The purpose of this agenda item is for the City Commission to consider
the Mr. Pagenkopf s request to remove a specimen (21 inch diameter)
long-leaf pine tree. The specimen tree is located on the west side of the
lot. The applicant's contractor states that the tree roots are damaging the
house.
APPLICABLE LAW AND PUBLIC POLICY:
On April 8, 2002, Chapter 5 of the City Code was repealed and replaced
with Ordinance No. 2002-08 (pertinent sections enclosed as attachments).

CONSIDERATIONS:
Mr. Pagenkopf requests to remove one specimen pine tree from his lot, as
defined in the amended (Ordinance No. 2002 - 08) Chapter 5 of the City
Code. The applicant has stated that he wishes to remove the tree in order
to protect the house. The specimen tree in question is located in the corner
side yard (please see the attached plot plan with the trees). The amended
arbor code requires specimen tree to be removed only under "extraordinary
circumstances and hardships and only by final permit approved by the City
Commission." Staff finds that the applicant's desire to protect the house
does constitute "extraordinary circumstances and hardships."
STAFF RECOMMENDATION:
Staff recommends that the City Commission approve the request to
remove the specimen tree from 200 Chestnut Ridge Street (Lot 52
Chestnut Ridge) on the grounds that the necessary "extraordinary
circumstances and hardships" have been demonstrated.

Waivers. The City Commission may grant a waiver to provisions of this Chapter
where the a icant demonstrates that the literal int retation of the ordinance will

demonstrated to be--conslstent with the purpose and intent of the ordinance. The
reservation of an a roved Tree over four 4 inches in cali er ma be nsider;_
as the basis for the granting of a waiver from the literal application of the provisions
of the City's land develooment regulations. If. in the determination of the Citx'
Commission. the sole basis for the request for waiver is to preserve such Tree which
would otherwise have to be removed. it may direct any required waiver fee to be
waived.

This is on behalf of the owner of the property at 200 Chestnut
Ridge Street, Winter Springs,
There is a big pine tree at the side of the house, only 8 feet from
the wall, The roots are going under the house, the branches wide
over the house,
In the area of the roots, the wall is showing small cracks, probably
damages caused by that pine tree, The branches over the house are
a potential risk for the roof,
We hereby highly recommend cutting the pine tree to prevent
further damages,
