Authorization REQUEST: The City Clerk respectfully requests that the City Commission consider dates for a Workshop on the Sunshine Law, as requested by the City Commission. PURPOSE: This Agenda Item is being proposed as this issue was brought up during the November 10, 2003 City Commission Meeting when it was suggested that a Workshop be held on the Sunshine Law. CONSIDERA TIONS: The following passage is from a November 10, 2003 City Commission Meeting "Report": Commissioner Blake suggested the City Commission and the Advisory Board and Committee Members "Go through a Workshop on the Sunshine [Law]. " Furthermore, Commissioner Blake suggested "That we put something together, have the City do it, have one big Meeting where we have an Expert, either the Attorney General can provide some folks I know that are experts on it - Anthony's [GarganeseJ firm can certainly provide some folks." Commissioner McGinnis said, "I would like to see a Workshop on it." Mayor Bush requested that Manager McLemore "Put together some kind of a recommendation on how we could address this - through the League of Cities. Our suggestion would be to have Mr. Robert Wayne Holmes, Esquire, Assistant State Attorney facilitate this Workshop. Please see his personal "Bio" which follows: "ROBERT WAYNE HOLMES has been an Assistant State Attorney for the State Attorney's Office of the 18th Judicial Circuit for Brevard and Seminole Counties. since November 1979. In his position as Chief of Operations for the past 1 4 years, he has been responsible for numerous administrative duties that include the hiring of attorneys and supervision of the office legal staff. Mr. Holmes has also prosecuted a broad range of criminal cases including the first degree murder trials of Bryan Jennings, William Cruse, and Mark Schwab. Mr. Holmes was raised in Brevard County, graduating from Melbourne High School in 1972, received his BA from the Florida State University School Criminology in 1976, and received his JD from Cumberland School of Law in 1979. More specifically to the issue of Sunshine Law, since I have been Chief of Operations all complaints and/or questions concerning the Sunshine Law that have been received by our office in either Brevard or Seminole County are directed to my attention for review. I have also handled two Governor Executive Assignments that concerned allegations of Sunshine Law Violations. " Mr. Robert Wayne Holmes, Esquire, Assistant State Attorney has noted that he would be available to facilitate a seminar on the Sunshine Law; would be available most evenings; and he would not charge the City a set fee for his time. However, the City will be able to reimburse him for his travel expenses. As a great number of our Advisory Board and Committee Members have never received any formal training on the Sunshine Law, it would be most desirable if a formal invitation from the Mayor and City Commission could be extended to our Advisory Board and Committee Members requesting their attendance at such a Workshop. Additionally, a Member of the City Commission recently suggested to me that the City Commission may wish to extend an invitation to the other surrounding municipalities in case their Commissions/Councils wished to also attend. Note: Our Commission Chambers holds approximately 150 guests. CITY OF WINTER SPRINGS CITY COMMISSION REGULAR MEETING - JANUARY 12,2004 REGULAR AGENDA ITEM 509 PAGE30F3 FUNDING: Any funds needed for travel expenses for Mr. Robert Wayne Holmes, Esquire are available under the Commission's Budget. RECOMMENDATION: The City Commission is being asked to: a) Decide if the Mayor and City Commission do wish to hold a Workshop dealing with Florida's Sunshine Law, and if so- b) Approve Mr. Robert Wayne Holmes, Esquire, Assistant State Attorney as the facilitator for an upcoming Sunshine Law Workshop c) Decide whether a formal invitation from the Mayor and City Commission should be extended to our Advisory Board and Committee Members requesting their attendance at such a Workshop d) Decide whether the Mayor and City Commission wish to extend an invitation to other surrounding municipalities (and which ones) inviting their Commissions/Councils to attend e) Agree upon a date for this Workshop. (If the City Commission is interested in including the City's Advisory Board and Committee Members, and as most of the City's Advisory Boards and Committees meet on either Tuesday evenings, Wednesday evenings, or Thursday evenings, a Monday evening [non City Commission Meeting night] might be the best choice) ATTACHMENTS: A. 2004 Calendar (including the months of January 2003 through May 2004).
