REQUEST: Community Development Department requesting Commission approval and
adoption of Resolution No. 2003-10.
PURPOSE: The purpose of this Agenda Item is to request that the Commission approve and
adopt Resolution No. 2003-10, to amend Resolution No. 728, regarding the
numbering of lots 17, 17 A, and 18 of North Orlando Ranches, Section 2, as
recorded in Plat Book 12, Page 12 of the public records of Seminole County. This
resolution will resolve a conflict between the lot numbering provided by the City
and the subsequent parcel identification numbering set forth be the Seminole
County Property Appraiser's office.
APPLICABLE CODE:
Chapter 9. Land Development.
Article VII. Uniform Building Numbering System.
FINDINGS: 1) The City approved the creation of the 3 lots (17, 17 A, and 18) from 2 platted
lots (17 & 18) in North Orlando Ranches, Section 2 (Plat Book 12, Page 12) by
adoption of Resolution No. 728, on January 10, 1994.
2) A depiction of which lot is Lot 17 and which is Lot 17 A was specified in
Resolution 728 by the City.
3) The Seminole County Property Appraiser's office reversed these lot numbers
for lots 17 and 17 A when assigning full parcel identification numbers and is
reluctant to change them.

4) Mr. Anderson has built a home on one lot and has encountered difficulties, due
to the inconsistent numbers.
5) Resolution No. 2003-10 will remedy the inconsistency between the City and
County lot identification numbers.

A RESOLUTION OF THE CITY OF WINTER SPRINGS,
FLORIDA, PROVIDING FOR THE DIVISION OF 'lW0 (2)
ORIGINALLY PLATTED LOTS HEREINAFl'ER DESCRIBED, ONCE
INTO NO MORE THAN THREE (3) PARCELS OR LOTS,
PURSUANT TO SECTION 9-3 OF THE WINTER SPRINGS CODE
OF ORDINANCES ENTITLED "DIVIDING PLATTED PROPERTY",
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, . Section 9-3 of the City Code of Winter Springs,
Florida, allows an owner of a lot of sufficient size, except in an approved
Planned Unit Development platted area, with the prior approval of the City
'~ssion, to divide an originally platted lot once, into no more than two
(2) parcels or lots, provided that each parcel or lot shall in every
respect meet the criteria established elsewhere in this Code for the
category of zoning under which the property is zoned; and
WHEREAS, the applicant, J .R.. Hattaway, has made application to
the City Carrnission for the following property to be divided pursuant to
Section 9-3:
Lots 17 and IB, Block "A", North Orlando Ranches
SectiOn_2, Plat Book 12, Page' 12, of the Public
Records .of Seminole County, Florida.
WHEREAS, the City Conmission was informed that:
1. The owner was seeking such division of the property of
sufficfent size;
2 . The property in question is not contained in an approved
Planned Unit Development platted area;
3. The platted lots to be divided had not been previously
divided pursuant to Section 9-3;
4. The platted lots to be divided shall be divided into no
more than three (3) parcels or lots, and that each parcel or lot shall in
every respect meet the established criteria contained in the category of
zoning under which the property is zoned.

property is approved in accordance with Section 9-3 as follows:

Mr. J.R. Hattaway has made application to split two (2) lots into
three (3) lots. The lots are located on. Coral Way and the zoning
for this area is R-1A. This zoning category requires a minimum lot
size of 8,000 sq. ft.
The City Clerk has given the Commission the proposed resolution in
the package that she prepares for them.
This request, if approved by the Commission, meets all zoning
requirem~nts.

CITY OF WINTER SPRINGS, FLORIDA, AMENDING
RESOLUTION NO. 728, CORRECTING A SCRIVENER'S
ERROR REGARDING THE LOT IDENTIFICA TION
NUMBERS OF THREE (3) PARCELS OF LAND (LOTS 17,
17 A, AND 18) LOCATED AT NORTH ORLANDO RANCHES,
.SECTION 1, RECORDED IN PLAT BOOK 12, PAGE 12,
PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
RECORDING IN THE PUBLIC RECOROS OF SEMINOLE
COUNTY, FLORIDA; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida, ("City
Commission") adoptedRcsolution No. 728 on January 10, 1994,approving the subdivision of two
(2) plalled 101S into no more than three (J) parcels or lots; and
WHEREAS, upon adoption of Resolution No. 728, the City Commission recorded the
r~soJution in the Public Records of Seminole .County, F'orida~ and
WHEREAS, Resolution No. 728 contained as exhibits surveys ofthc subdivided lots and
identified the Jot numbers as Lots 17, 17 A, and 18; and
WHEREAS, the Property Appraiser of Seminole County, Florida ("Property Appraiser"),
erroneously identitied Lot 17 as Lot 17 A and Lot 17 A as Lot 17 when creating the new parcel
identification numbers for the subdivided lots; and
WHEREAS, the Jot numbers contained in Resolution No. 728 and the parcel identification
numhers provided by the Property Appraiser are currently inconsistent and the inconsistency is
causing confusion; and
WHF.RF.AS, the Property Appraiser's Otlice has informed City staff that they are unwilling
to change the parcel identification numbers for 1he subject lots; and
WHEREAS, the City Commission deems it to be in the best interests of the public health,
safety, and welfare oflhe CiliuIll) of the City and the owners of the subject subdivided lots to COrTect
this inconsistency in order to eliminate the existing confusion and to avoid potential title problems
involving the subject subdivided lots,
NOW, THERE;FORE, BE IT RESOLVED BY TH.E CIIY COMMISSION OF THF.

Section 1. RECITALS. The foregoing recitals are affirmed and incorporated as part of this
Resolution.
Section 2. AMENDMENT OF RESOLUTION NO. 728. For purposes of providing
consistency with the parcel identification numbers provided by the Property Appraiser, the lot
identification numbers contained in Resolution No. 728 are hereby amended as follows:
A Lot 17, identified on Exhibit "A" of Resolution No. 128, shall hereby be
referred to as Lot 17 A.
B. Lot 17 A, identified on Exhibit "B" of Resolution No. 728, shall hereby be
referred to as Lot I 7.
Section 3. RECORDATION. The City Clerk is hereby directed to record this Resolution in
the Public Records of Seminole County, Florida.
Section 4. SEVERABILITY. If any section, clause, phrase, word, or provision of this
Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction.
