REQUEST: The Community Development Department requests that the City Commission
remove from the table the final engineering/site plan and proposed building
rendering for the Dollar General store, along with the removal of 4 healthy
specimen trees.
PURPOSE: The purpose of this agenda item is to remove from the table the final
engineering/site plan (with removal of 4 healthy specimen trees) and building
rendering for an 8,125 square foot Dollar General store on a 1.355 acre site,
located on the north side of SR 434, west of Sheoah Boulevard and immediately
east of the existing Winter Springs Golf Club and immediately west of the
existing Sheoah Section 1 dwellings.

Chapter 20, Division 3. General Design Standards For Redevelopment
District (Sec. 20 - 240 thru Sec. 20 - 512)
CONSIDERATIONS:
This 1.355 acre site has a Commercial Future Land Use designation and C-1
Commercial zoning. It also lies within the SR 434 Redevelopment District. No
state or federally listed plant or animal species are known to inhabit or use the
site. The site does not contain any wetlands and is not located within the 100 year
floodplain. The site contains a number of large trees, including specimen trees
(pursuant to Ordinance No. 2002 - 08, specimen trees are those trees that are at
least 20 inches in diameter, as measured at 8 inches above the adjacent soil level).
A large treed area is proposed to be remain as such, although approximately 25
trees will be removed from the site, including 4 healthy specimen trees (a 44" oak
is not healthy and is not counted, a 36" oak, a 30" oak, and two 20" oaks - another
tree to be removed is depicted as a 20" oak is actually a camphor tree, which is an
invasive exotic species). The site design has been modified from its original
design in order to preserve even more trees than were originally proposed to be
saved (approximately 35 existing trees to be preserved, including 7 specimen
oaks). Brazilian pepper trees (invasive exotic) are growing in the south-west
comer of the site need to be properly removed along with the camphor tree.
The store has been d~signed as far away from the existing condominiums as
possible. The required 6 foot tall masonry wall is proposed between the site and
the existing apartments (wall to be field-adjusted to minimize the impact on
existing trees to remain - see note 14 on sheet 4). Most ofthe trees that will
remain are located between the store and the adjacent condominiums and should
significantly help buffer the two uses. A 10' wide landscape easement, adjacent
to the SR 434 right-of-way has been conveyed to the City in conjunction with the
State Road 434 Landscape and Beautification Project.
A site lighting plan is enclosed in the site plan package (sheet 5B), including a
photometric plan that demonstrates no off-site light spillage. Fixtures are down-
ward directed, located a maximum of20' above the adjacent grade. Any
significant alteration of or deviation from this lighting plan requires City
Commission approval (see Lighting Notes on sheet 5B).
Staff required a traffic study. The traffic study has been reviewed by the City's
traffic consultant - no traffic concurrency issues or public safety issues were
identified and no off-site or additional on-site traffic improvements were deemed
necessary.
Chapter 9 of the City Code requires one parking space per 300 square feet for
retail uses. The site is proposed with 28 spaces (2 handicap accessible), pursuant

to code. A bike rack to accommodate 2 bikes is proposed near the front door (see
note 16 on sheet 4).
The building is proposed with masonry walls on all 4 sides, pursuant to the
requirements of Section 20 - 489 of the City Code. The lower portion is proposed
to be split face block while the upper portion is proposed to be stucco. The roof
has been changed to a pitched shingle roof.
The plan depicts the location of the proposed monument sign, at least 15 feet from
the right-of-way line. Note 9 on sheet 4 states that all signage must meet the SR
434 Redevelopment District requirements.
The dumpster enclosure detail depicts a 6 foot tall masonry wall and wooden gate.
In the event that a taller dumpster will be provided by the waste hauler, the height
of the dumpster enclosure must be revised to screen the dumpster.
At the August 25, 2003, City Commission meeting, the City Commission voiced
concern with the proposed architectural rendering and tabled the item, in order
that the development team meet with the City Manager and propose a more
acceptable building design. The applicant's agent has met with the City Manager
and, proposes the attached rendering.
FINDINGS:
1) The site is zoned C-1 Commercial, has a Commercial Future Land Use designation, and lies
within the SR 434 Redevelopment District.
2) A Dollar General store is a permitted use in the C-1 zoning district.
3) The proposed site plan is consistent with the Comprehensive Plan and City Code of
Ordinances. .
4) Traffic volume and movements have been analyzed and found acceptable by traffic engineers
employed by both the applicant and the City.
5) The applicant must provide permits from the FDOT, SJRWMD, and FDEP, provide a copy of
the construction schedule, and provide a 1 percent inspection fee prior to any pre-construction
conference or commencing any site work (site work may commence without FDEP permit, but
no potable water or sanitary sewer may be installed prior to FDEP permit).
6) Any significant change in the site lighting plan must be referred back to the City Commission
for their review and approval (just as any other significant change to the site plan).

7) At its August 25, 2003, meeting, the City Commission table the final engineering/site plan,
until a revised architectural rendering was provided.
PLANNING & ZONING ACTION:
At its regularly scheduled meeting of August 6, 2003, the City of Winter Springs Planning and
Zoning Board recommended the site plan and the removal of 4 healthy specimen trees be
approved.
RECOMMENDATION:
The Planning and Zoning Board and Staff recommend approval for the Dollar General final
site/engineering plans and the removal of the 4 healthy specimen trees, subject to the conditions
set forth and referenced in the "Findings" section, above (i.e. Findings No.5 and 6).

Dear Mr. Baker:
As I discussed with you on Friday, June 13th and with Police Chief Kerr on the same day,
the Highlands Board of Directors would like to make specific requests regarding the
development of the Dollar General store (herein DG) on SR434 next to the Sheoah I
Condominiums/Highlands entrance as it proceeds forward. The Board understands that Dollar
General is the owner of record for the parcel as of April 2003. Given this fact, the Board
would like to ensure that everything possible is done to minimize the negative impact of
the store in relation to the surrounding area, mainly the Sheoah I Condominiums; the
greater Highlands community itself; and the Winter Springs Elementary School.
l)The Board would like the applicant to perform a traffic study to determine direct
impacts of traffic at the corner of SR434 and Sheoah Boulevard/Winter Springs Elementary
School entrances. This traffic study should also include predictions of traffic flow onto
Sheoah Boulevard or into the school parking lot due to the inability of doing a U-turn at
Sheoah for any eastbound SR434 traffic that wishes to turn westbound to enter DG's parking
lot. This will be necessary when FDOT installs the raised medians on SR434 and in the
event DG does not have a median cut.
2)The Board would like that all established trees and plants remain within and around the
buffer zone on the east side property line between Sheoah I and the DG property and the
north back property line between DG and the golf course property as much as possible.
3)The Board would like lighting to be restricted within and around these two buffer zones.
The Board would like all lighting to be non-intrusive to the Sheoah I Condominiums meeting
only the minimum allowable State of Florida standards for lighting of in public areas.
4)The Board would like that the buffer wall along the east side property line between DG
and the Sheoah I Condominiums and, if applicable, the back property line of the parcel
between DG and the golf course property to be constructed of brick, the new gold-standard
established by the City of Winter Springs Commission for publicly viewed areas.
5)The Board would like all construction of buildings, parking, signage, and lighting to be
aesthetically pleasing and compatible to the surrounding area (Sheoah I Condominiums and
Winter Springs Golf Club). Premium landscaping should be required.
6)The Board would like a minimum amount of signage on the property, with the restriction
of neon signs and other obtrusive signs specified
7)The Board would like all laws applicable to noise be followed when outlining the store's
hours of operation. The Board would like the dumpsters to be located as far as possible
from the Sheoah I Condominiums.
8)The Board would like that the building and site plans meet or exceed all police and fire
safety standards and any post-September 11th safety measures.
9) The Board would like at least two-business day prior notification when the applicant's
preliminary and final site and building plans are submitted for approval to the Board of
Adjustment (if applicable); Planning & Zoning Board; and City Commission by emailing the
Board of Directors at the Highlands email at highlandshhoa@aol.com.

hear this matter as part of the review, approval, and/or appeal process as well as the
packets distributed to the City Commission and Mayor each time it is scheduled for review

"I WOULD LIKE TO MAKE A MOTION TO TABLE THIS UNTIL THE NEXT
MEETING." MOTIO~ BY DEPUTY MAYOR MILLER.
MOTION DIED FOR LACK OF A SECOND.
Commissioner MCGinnil stated, "I have met with the HOA [Homeowner's Association]
adjacent to this. They also would like to have a brick wall, but they would like to have in
writing that whatever the wall is, that it would be steam-cleaned, pressure-cleaned
annually, walls tend to bt mildewed."

The Site Engineer for this project addressed the City Commission and spoke of
maintenance and stated, "If a condition of Approval is that some kind of maintenance
responsibility, pressure- ashing the walls or something like that, I don't think there

would be any concern about that. They may have every intent to do that and be a good
neighbor, etceteras." I
Deputy Mayor Miller sttted, "You have assured us that thIS IS gomg to be not the typIcal
store, but there are no artists' renderings that would allow me to at least make an analysis
that it is going to fit in ~he neighborhood." Furthermore, Deputy Mayor Miller said, "I
would like to see all ther details from the Staff."
Discussion ensued on t~e proposed building components. Deputy Mayor Miller added,
"Until I personally understand all the facets of this thing, and get a chance to comment on
it and see if we can't w~rk out additional details, ifpeople want to do that, regarding the
type of wall, regarding what the front looks like.
Commissioner MCGinn1 stated, "I was hoping we would see an Artist's rendering of
what it is going to look ~ike, because all I can envision now is a block building, which I
hope it is not just a concrte block building. So, I think we need details. I agree."
Discussion ensued on a rendering shown to the City Commission. Commissioner
McGinnis stated, "That looks pretty much like a storage building to me. It does not look
like a commerce buildin~, there are no windows on the side. I am just disappointed that
it does not have some style to it." Discussion followed on proposed landscaping and
architectural features.

Commissioner Blake sai~, "This is the first time that I have seen any rendering at all as to
what this building wot!.ld look like and I would quite frankly tend to agree with
Commissioner McGinni~ that it is just pretty much your rectangular box - and while
some of the materials m:ly be an upgrade for what your folks tend to use, I think that is an
excellent start, but if thFre were a way to fix the roofline, and add some architectural
value to the roofline, which doesn't necessarily mean to go two (2) stories, but I think if
there was something othler than what looks like a warehouse or a shed - something that
would give it a better ch.ance of blending in with the predominant residential character of
the area of which you pn~pose to build it."

Discussion followed I n the structnre of the proposed building and featUres.
Commissioner McLeod fpointed out that "You have a metal column building with block
infill. Ron [McLemore, this is far from what we are looking for on [State Road] 434."
Furthermore, Commissi ner McLeod said, "I realized it is nothing more than a Butler
building with block - is what you are looking at Ron [McLemore], unless you can bring
us architectural drawin s showing something different. Even your overhangs are all
metal overhangs. I wOl!lld suggest that we table this until we have some more detailed
drawings, as far as the structure of this building. That building is nothing at all of what I
expect to see on [State !oad] 434." .
NOTES:
With further discussion, Commissioner McGinnis suggested this Item be Tabled.
Commissioner McLeod stated, "You need an architectural rendering submitted to Mr.
McLemore that will h ve some credence to get through the review," Furthermore,
Commissioner McLeod raid, "I would direct you to go directly to Mr. McLemore to get it
him. He will decide w~'ether or not he thinks it needs to go to his Staff. If it doesn't get
past him, there is no need to take it to Staff. And then once he does that, then he will
bring it to us." Managclr McLemore stated, "I think I understand what you want. You

want a quality building. . ." Commissioner McGinnis added, ". . . With some
architectural. . ." Manjl ger McLemore then said, "... With some relief, and some
architectural details."
With discussion on wliether the Site Plan can be approved, Commissioner McLeod
pointed out, "As long as I Dollar General understands the approval ofthe site plan does not
necessarily mean that this building is going on it."

2. OUTFALL PROTECTION - PROJECT PIPE OR DITCH DISCHARGES INTO

SEDIMENT BUILDUP OR TRANSPORT. OUTFALLS SHALL BE PROTECTED
THROUGH USE OF ENVIRONMENTAL CONTROL FEATURES I>S NECESSARY
TO CONTAIN ANY SEDIMENT LOSS TO THE IMMEDIATE AREA OF THE
PROJECT. ANY SEDIMENT BUILDUP OR TRANSPORT OFF-SITE SHALL
BE THE CONTRACTOR'S RESPONSIBILITY TO REMEDY. THE
CONTRACTOR SHALL USE APPROPRIATE FEATURES I>S DIRECTED BY

3. SLOPE PROTECTION - ANY DISTURBED OR REWORKED SLOPES 3: 1 OR
GREATER SHALL BE ADEQUATELY PROTECTED FROM EROSION THROUGH
THE USE OF TEMPORARY SODDING UNTIL PERMANENTLY STABILIZED.
SUCH SLOPES SHALL NOT BE LEFT UNPROTECTED MORE THAN 24
HOURS OR DURING RAINFALL EVENTS.
4. HAY BALES - THESE SHALL BE PLACED AT THE BASE OF ANY SLOPE
WHERE A RAINFALL EVENT COULD ERODE A SLOPE AND TRANSPORT
SEDIMENTS OFF -SITE. BALES SHALL BE DOUBLE STAKED IN
ACCORDANCE WITH STANDARD INDEXES. IF EROSION DEPOSITS
REACH THE TOP ELEVATION OF EXISTING BALES, THEN SEDIMENTS

INLET OPENING IMMEDIATELY ADJACENT TO THE EDGE OF THE
INLET. ALL EXPOSED SLOPED MATERIAL ADJACENT TO INLET SHALL
BE COVERED WITH EROSION CONTROL MATTING WITH OUTER LIMITS
PROTECTED BY A SINGLE ROW OF HAY BALES.
6. STOCKPILED MATERIALS - THIS MATERIAL SHALL NOT BE LEFT IN
EROSION PRONE AREAS UNLESS PROTECTED BY COVER OR HAY BALES.

OVERGROWTH CONTROL. DO NOT MOW BOTTOM AREAS OF WET
RETENTION SYSTEMS.
3. INSPECT RETENTION AREAS PERIODICALLY FOR ACCUMULATION OF
DEBRIS AND TRASH AND REMOVE SAME I>S REQUIRED.
4. PERIODICALLY INSPECT RETENTION AREA BOTTOMS FOR DEPOSITS OF
