REQUEST:
The City Attorney's office requests the City Commission consider and adopt Resolution 2005-48.
PURPOSE:
The purpose of this Resolution is to declare the perpetual conservation easement granted to
the City of Winter Springs over and under the land commonly known as the Winter Springs Golf
Course to be of significant public importance to the City and its citizens.
APPLICABLE LAW AND PUBLIC POLICY:
1. Section 704.06, Florida Statutes, regarding Conservation Easements
2. Chapter 166, Florida Statutes, Florida Home Rule Powers Act
CONSIDERA TIONS:
I. The City originally acquired the conservation easement in 1984.
2. The conservation easement was amended in 1998.
3. At the last City Commission meeting, the Commission directed the City Attorney to prepare
a resolution declaring the conservation easement to be of significant public importance to the
City and its citizens.

4. The City's Utilities Director will be presenting a map depicting the exact location of the
conservation easement area, which includes practically the entire Winter Springs Golf Course
property, excluding the commercial frontage along State Road 434.
STAFF RECOMMENDATION:
The City Attorney's office recommends the City Commission adopt Resolution 2005-48.

2. In 1984, the City accepted the original conservation easement. The same was amended in
1998.
3. At the November 28,2005 City Commission meeting, the Commission directed the City
Attorney to prepare this Resolution.

A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, RECOGNIZING
THE CONSERVATION EASEMENT GRANTED TO THE
CITY OF WINTER SPRINGS OVER AND UNDER THE
LAND COMMONLY KNOWN AS THE WINTER SPRINGS
GOLF COURSE; DECLARING THAT THE CONSERVATION
EASEMENT IS OF SIGNIFICANT PUBLIC IMPORTANCE
TO THE CITY OF WINTER SPRINGS AND ITS CITIZENS;
PROVIDING FOR REPEAL OF PRIOR INCONSISTENT
RESOLUTIONS, SEVERABILITY, AND AN EFFECTIVE
DATE.
WHEREAS, the City is granted the authority under Section 2(b), Article VIII, of the State
Constitution to exercise any power for municipal purposes, except when expressly prohibited by law;
and
WHEREAS, on December 26, 1984, the City of Winter Springs was granted a perpetual
conservation easement over and under the land commonly known as the Winter Springs Golf
Course, recorded in Seminole County Official Record Book 1604, Page 131; and
WHEREAS, an amendment to such easement was made on November 15, 1998, as reflected
in Seminole County Official Record Book 3539, Page 0364; and
WHEREAS, the current City Commission desires to go on record to declare the perpetual
conservation easement over and under the Winter Springs Golf Course to be of significant public
importance to the City of Winter Springs and its citizens, and that such easement shall be enforced
as stated in the aforementioned conservation easement; and
WHEREAS, the City Commission of the City of Winter Springs deems that this Resolution
is in the best interests of the public health, safety, and welfare of the citizens of Winter Springs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby fully incorporated herein by this reference
and are deemed a material part of this Resolution.
Section 2.
Declaration of Significant Public Importance. The City Commission hereby

declares the perpetual conservation easement granted to the City of Winter Springs over and under
the land commonly known as the Winter Springs Golf Course to be of significant public
importance to the City of Winter Springs and its citizens, and that such easement shall be enforced
as stated in the aforementioned conservation easement.
Section 3. Repeal of Prior Inconsistent Resolutions. All prior resolutions or parts of
resolutions in conflict herewith are hereby repealed to the extent of the conflict.
Section 4. Severability. If any section, subsection, sentence, clause, phrase, word, or portion
of this Resolution is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion hereto.
Section 5. Effective Date. This Resolution shall become effective immediately upon adoption
by the City Commission of the City of Winter Springs, Florida.
DONE AND ADOPTED in regular session of the City Commission of the City of Winter
Springs, Florida, this _ day of 2005.

customarily utilized In connection with the operation of a golf course.
(2) There shall be no filling, excavating. dredging. removal
of loam, peet. topsoil. sand, gravel or roek,' nor any material change In
the topOgraphy of the Protected Property In any manner elCC8pt a. may
be ....ltOft8bly required to maln~ln and Improve, remodel and relocate
roadl. golf cart paths, foot trans. tees. green.. 'airways. sand traps
and other topographical features r.onnally .Sloctaled with a golf course. .
There shell be no mining or drilling or removal of minerals In such
manner as. to affect the surface;
(3) There shall be conducted no activity or use on the
Protected Property, other than tnat associated with a golf caur.e. that
Is detrimental to drelnage. flood control, water conservation. erosion
control. soli conservation. flsh. wildlife or habitat preservation; . .

motorcy~I.., or other loud, destructive or offensive recreational
