REQUEST: The Public Works Department requests the City Commission validate the
staff recommendation fmding Jesup's Reserve, Phase I to be built in
substantial accordance with the Final Engineering plans, to accept the public
roads, potable water, and sanitary sewer infrastructure for ownership and
maintenance, and to authorize transportation impact fee credits to Levitt &
Sons in the amount of $189,354.16 for the design and construction of the
collector road (McLeods Way) per the Developer's Agreement.
PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the
staff recommendation finding Jesup's Reserve, Phase I to be built in substantial
accordance with the Final Engineering plans per Section 9-178, to accept the
public roads, potable water, and sanitary sewer infrastructure for ownership and
maintenance, and to authorize transportation impact fee credits to Levitt & Sons
in the amount of $189,354.16 for design and construction of the collector road
(McLeods Way) per the Developer's Agreement.
PROJECT SUMMARY:
J esup' s Reserve consists of 161 townhome units on 11.03 acres, located on the south side
ofS.R. 434 and west of Tuskawilla Road in the Winter Springs Town Center. Phase I
consists of 151 townhome units, and Phase II consists of 10 townhome units at the eastern
end of the property.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on lots;
exceptions.
( c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans, such as withholding
occupancy, the building official may issue building permits upon advising the developer

that all or partial occupancy will be restricted until satisfactory completion of the
improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are accepted
by the city commission.
FINDINGS:
1) The site has been constructed in substantial accordance with the final engineering plans
approved by the City Commission at the August 8, 2005 City Commission meeting,
except as noted below under the recommended conditions of approval.
2) All City agencies have found the work to be acceptable, except as noted in the
recommended conditions of approval below.
3) FDOT has accepted the work performed within the FDOT right-of-way.
4) Record drawings have been submitted and accepted by Staff.
5) Levitt & Sons has provided a two-year, 10% maintenance bond to the City for the public
roadways and water and sewer facilities that are being turned over to the City for
ownership and maintenance.
6) Phase II consists of 10 townhome units at the east end of the property that cannot be
constructed until additional right-of-way has been obtained from the adjacent property
owner (Ondick). The additional right-of-way is required to construct Roberts Family
Lane as shown on the approved final engineering plans.
REIMBURSEMENT FOR COLLECTOR ROAD (McLEODS WAY):
Under the Pre-Annexation Developer's Agreement for Jesup's Reserve approved by the City
Commission at the September 20, 2004 meeting, the City is obligated to reimburse or issue
transportation impact fee credits to Levitt & Sons for the design and construction cost for
McLeods Way, a new collector road that runs through Jesup's Reserve. The total cost to design
and construct McLeods Way is $189,354.16.
RECOMMENDED CONDITIONS OF APPROVAL:
The following items shall be completed and accepted by the City prior to issuance of any
Certificates of Occupancy, except where specifically noted otherwise:
I) Sidewalks and landscaping in the immediate vicinity of townhome units shall be
completed and accepted by the City on a building by building basis prior to Certificates of
Occupancy for those buildings.
2) Sidewalks and landscaping along the S.R. 434 frontage shall be completed upon removal
of the overhead utilities, per the terms of the Developer's Agreement.
3) Complete the pond grading, landscaping, and irrigation.

4) Install the one-way sign in the S.R. 434 median opposite of the Roberts Family Lane
entrance.
S) Install reflective markers at the barricades located at the southeast corner of the site.
6) Repair the curb at the McLeod' sWay entrance.
7) Complete and/or repair missing or damaged sections of the concrete valley gutters.
8) Install pavement markings on McLeod's Way at the northbound approach to S.R. 434.
9) All alleys are required to have inverted crown sections with positive slopes away from the
units. Alleys that do not meet this criteria shall be repaired prior to issuance of any
C.O.'s for the surrounding units.
10) After onsite building construction is substantially complete, the final asphalt surface shall
be installed per the approved final engineering plans.
11) The performance bond on file with the City (bond #1003690 for $1,865,021.68 dated
September 30, 2005) shall not be released until the satisfactory completion of the above-
listed items.
FUNDING:
No funding is required for the issuance of the Phase I transportation impact fee
credits. However, Roberts Family Lane has not been completed yet due to right of way
acquisition issues and the costs associated with the completion are also the City's
responsibility as per the Developer Agreement. The Roberts Family Lane costs will be
addressed when the Phase II acceptance is brought before the Commission.
RECOMMENDATION:
Staff recommends that the City Commission validate the staff recommendation
finding Jesup's Reserve to be built in substantial accordance with the Final Engineering
plans, subject to the conditions listed above, accept the public roadways, potable water
and sanitary sewer infrastructure for ownership and maintenance, and authorize the
issuance of transportation impact fee credits to Levitt & Sons in the amount of
$189,354.16 for design and construction ofthe collector road (McLeods Way).
IMPLEMENTATION:
Certificate of Occupancies for those units eligible can be issued after Commission
approval and completion of the items listed in the conditions of approval. If Levitt has
paid transportation impact fees in excess of those required after the impact fee credits are
applied, the City will reimburse Levitt for those overpayments from the Transportation
Impact fee Fund.
