The Community Development Department requests that the City Commission, in its capacity as
the DRC, consider Dr. Burks DDS's request to change the floor plan for one bay at Building No
8 (JDC Town Center), immediately adjacent to Leslie's Pool Supply to accommodate his dentist
office.
PURPOSE:
The purpose of this agenda item is to review the amended floor plan for Building No. 8 at the
JDC Town Center (e.g. modified rest room locations) and approve, disapprove, or approve with
conditions, the proposed build-out of the portion of Building 8 adjacent to Leslie's Pool Supply.
CONSIDERATIONS:
The building plans for the dentist office depict different rest room locations than were approved
by the City Commission in its DRC capacity at the July 28, 2003, City Commission meeting.
No specific tenant or tenant build-out was noted to staff at that time. The September 8, 2003,
City Commission agenda item addressed the build-out for the opposite end of the building. Dr.
Burks is pursuing the build-out of this bay independently of the J. Raymond Construction Corp.
The plans depict 2 restrooms, one within 11' 3" of the SR 434 frontage and another rest room
(for employees) within about 9' 2" of the parking lot side of the building. This build-out appears
oriented toward SR 434, rather than the parking lot, but is technically inconsistent with the at
least temporarily suspended 15' policy established by the City Commission on January of 2003,
but not officially adopted as an ordinance, and now, at least, temporarily suspended.
The City Manager and City Attorney have met with the James Doran Company representatives
and Dover Kohl and Partners to try to resolve this issue for the town center (not for this specific

bay). Both the City and the developer sent teams to the Reston "Place Making" conference, at
least partly, to determine how applicable the rule is and whether or not some mutually agreeable
alternative exists.
FINDINGS:
1. The City Commission, in its capacity as the Development Review Committee, is authorized,
through the Town Center Code, to review interior building layouts and any amendments.
2. Section 20 -325 of the City Code of Ordinances, [Town Center] "Squares, parks, and street
types" requires "The front of a building and its main entrance must face the primary space."
3. Staff has documented the problem whereby tenants at the JDC Calhoun Town Center have
faced their businesses toward the parking lot and blocked access and visibility from the street
frontage.
4. Staff has documented that engaging and inviting business fronts (i.e. onto the street frontage)
are very important to a successful town center.
5. The City Commission did, on January 27, 2003, adopt a policy related to interior partitions to
help ensure compliance with Section 20-325 of the City Code, but this policy has been
suspended.
6. The build-out plan for Dr. Burks meets the intent of Section 20-325 of the City Code.
Although it depicts a restroom 11' 3" from the SR 434 frontage, in contrast to the suspended
policy, it appears to be significantly set back from the building front and the office appears
oriented toward SR 434 rather than the parking lot.
RECOMMENDATIONS:
Staff recommends that the City Commission, in its capacity as the DRC, approve the revised
Building No. 8 floor-plan proposed by Dr. Robert Burks.
