REQUEST: Community Development Department is advising the City Commission of the current
status of the property located on the western boundary of the Foxmoor Subdivision adjacent to the City
of Casselberry maintenance yard.
PURPOSE: This agenda item is to update the Commission on staffs effort to negotiate an acceptable
mitigation of the un-permitted site work performed by the City of Casselberry on the conservation area
of their maintenance yard.
CONSIDERATION:
In the middle of December 2004, the City of Winter Springs ArboristlEnvironmental Inspector visited
the subject site and discovered the removal of trees without a permit. The City of Casselberry (Cae)
had contacted the City of Winter Springs (COWS) stating that they intended to clean up some hurricane
damage and debris on the subject site. The removal of trees, as defined by the COWS, was not part of
this clean up. Since the discovery of the un-permitted site work, COWS staff have been working with
COC staff to formulate a mutually acceptable restoration plan for the site. During the course of these
negotiations, the COWS did receive one complaint from Mr. Jason Greep (see attachment A). This
complaint was received on May 19, 2005.
At the present time, COWS staff has proposed the re-vegetation of the site with 100 long leaf pines and
100 sand live oak. To insure maximum survivability ofthe re-vegetation effort, these trees would be 3-
gallon, container grown material and would be installed during the dormant season (December-
January). The COC has indicated their agreement with the proposed restoration effort and the
implementation time frame (see attachment B). COWS staff will monitor the restoration efforts.

I am unhappy with the cutting down of the trees and development of the land @ the end
of Panama Circle next to the Casselberry public works building. I am very disturbed to
hear the site was cleared of all the trees and shrubbery by a city of Casselberry employee
without authorization, pennission or a permit/site review. I would like the area restored
back to its natural habitat. We have come to enjoy the wooded buffer that shelters us
from all of the noises and activities that go on at the public works facility. The loss of the
trees in this wooded area has created a bothel'SOme noise in our quiet and peaceful
neighborhood. If you allow the city ofCasselbeny to go forth with the development of
this site and construct a warehouse directly behind our homes, we are extremely
concerned that these problems will arise:
1. Our peaceful quiet neighborhood will become a noisy industrial zone.
2. Our privacy that we have had will be no more.
3. Our property value wiIldecline tremendously.
4. Our quality of life will be diminished.

Site Restoration
Dear Mr. Mingea:
I am in receipt of your letter dated September 12, 2005. The City appreciates the opportunity to restore
the site and all the consideration extended by the City of Winter Springs relative to this issue.
The City is in the process of contacting local nurseries to make arrangements to secure the necessary plant
material. After our discussion this morning, it was determined to wait until somewhat cooler weather
arrives in the area for planting. However, the City of Casselberry will have completed the restoration by
the completion date of December 31, 2005. Prior to commencement of any work, I will contact your
office to advise you of our work schedule.
In closing, I appreciate all the time and assistance you have provided relative to this matter. If you have
