REQUEST:
The Community Development Department, City Arborist, recommends the City
Commission consider the request of Pete Smith of 1004 Troon Trace to remove (1) one
specimen tree located on the resident's private lot.
PURPOSE:
The purpose of this agenda item is for the City Commission to consider a residential
request to remove (1) one specimen (25 inch diameter) Cypress tree from the resident's
private lot due to damage it is causing to adjacent underdrains and the raising of street
side curbing.
CONSIDERATION:
The specimen tree is located in the front yard within 10' (feet) of the residential street and is
presently causing the lifting of the curb approximately 2", resulting in blockage of water flow.
Unless removed this condition will continue to deteriorate the curbing in this area.
APPLICABLE LAW AND PUBLIC POLICY
On October 13, 2003, Chapter 5 of the City Code was repealed and replaced with Ordinance No.
2003-22 (pertinent sections enclosed as attachments).

FINDINGS:
1) Section 5-8.b of the Arbor Ordinance provides that a specimen tree shall not be
removed except for extraordinary circumstances and hardships and only by final
permit approval by the City Commission.
2) Upon a visit to the site by the City Arborist and the City Engineer, damages were
observed by the tree to street side curbing and Staff concurred with the need for
removal.
STAFF RECOMMENDATION:
Staff recommends the City Commission approve Pete Smith's request to remove (1) one (25" in
diameter) specimen tree located on his residential property with the understanding that there will
be replacement tree requirements as specified by the Arbor Ordinance; to be installed within (30)
thirty days.
