REQUEST:
The Community Development Department requests the City Commission consider interpreting
the C-l permitted uses, Subsection 20-232 (a) of the City Code, provisions for (3) alcoholic
beverage sales (package) and (4) alcoholic beverage on-premise consumption to include micro-
wineries (retail establishments where wines may be made, sold, and consumed).
PURPOSE:
The purpose ofthis agenda item is for the City Commission to provide an interpretation of the
City Code to include micro-wineries, a use that appears to staff to fit within the parameters of the
existing permissible uses in the C-l zoning district.

CONSIDERATIONS:
Micro-breweries and micro-wineries are recent phenomenon. The City did not specifically
consider these with the last iteration of permissible uses for the C-l zoning district (Ordinance
2002-07). The provisions of subsections 20-231 (a) (3) alcoholic beverage sales (package) and
(4) alcoholic beverage on-premise consumption would appear to include a small up-scale retail
facility where patrons may pursue at least one of several options:
1. taste and purchase wines that are produced on-site;
2. purchase the kits for home production of custom wines;
3. attend wine-making classes and receive technical assistance from a trained staff; and
4. prepare their own custom wines at the facility, with technical assistance provided.
If the patron decides to prepare his/her own wine at the facility, he/she must initiate the process,
by mixing the ingredients. Staff would be available to test the fermentation process, to ensure
that the sugar content has properly turned to alcohol before the next step in the process is begun.
This process allows the patron to bottle the product on-site; choosing from a selection of labels,
including custom-made labels.
The key issues, from a planning perspective, include maintaining the micro-size and intensity of
the operation. Clearly, the C-l zoning district was not intended to include full-scale wineries or
breweries. An interested party has provided material indicating that at least one community
limited the size to 3,000 square feet and specifically prohibited assembly line production and/or
wholesale distribution.
STAFF RECOMMENDATION:
Staff recommends the City Commission interpret the existing permitted uses language addressing
sale and consumption of alCoholic beverages in the C-l zoning district to include retail micro-
wineries of less than 3,000 square foot total area if they do not employ assembly lines or any
wholesale distribution. This recommendation is subject to the City Attorney's review and
approval for consistency with applicable law.

Citing Winter Springs vigorous growth, strong demographics, strategic location and
abundance of upscale professional clientele the location of our D'Vine Wine " Your Place
or Mine" retail outlet would be ideal at our currently owned property at 116 West State
Road 434 Winter Springs, FL 32708. This location will offer a tastefully decorated retail
outlet with easy access to consumers from Winter Springs.

Current request, 2(cop) incidental in cg zoning district.
The petitioner is requesting to be allowed to open a retail establishment selling the equipment
necessary for making wine.
He's also requesting to make wine on the premises and taste wine as well.
Staff is not in favor of the wet zoning.
Cg zoning district didn't provide for the manufacturer of the wine.
I talked with Mr. Grandoff, and there is a text amendment being proposed to go through the
Planning Commission on October 14th.
He is aware right now that he can sell retail equipment and we've discussed the wet zoning as
well and he's saying -- he stated to me that he's going to drop it down to a 2(aps) this morning so
that they can do the wine tastings and sell wine and until the text amendment is done, they will
not be storing or manufacturing on-site.
There are other wet zonings within a thousand feet.
The copper top pub and cdb pizza.
Also residential within a thousand feet.
180 feet to an r-9 district in temple terrace and 600 feet to an rs-60 in Tampa.
There are also institutional uses within the thousand feet.
Calvary tabernacle church, bethel primitive baptist, the University of South Florida, and two
facilities owned by Hillsborough County.
The council would need to waive the distance requirements to approve this.

We're doing a text amendment through the Planning Commission, and that amendment will be

I agree totally with everything peter told you.
We'll drop it down to 2(aps) for the package sale of some of the wine and to allow the tasting
under chapter 3.

The Planning Commission first heard this request at their
September 9th meeting.
At that time they asked the applicant to go back, work with the
Staff, city legal, city zoning staff, to reword the language to
Make the request a little bit more restrictive.
The request is to add a new definition of amended schedule of
Permitted uses to include wine production customized.
The applicant did meet with the City staff and the applicant.
We had an additional meeting again prior to our October 14th
Planning Commission meeting.
You have the revised language in front of you.
And the language was revised to say wine production customized,
The use in which the customized production of wine, including
The sale of baked varieties, construction of fermentation
Processes, bottling, and for individual retail, retail sales and
Accessories.
One of the important items that was added was the maximum size
Of the facility is 3,000 square feet.
The intensity of this use does not permit the use of assembly
Lines or a wholesale distribution.
With those changes in place on October 14th, the planning
Commission found the request consistent and recommended
Approval.

There has been continued concern of the neighborhoods as this has moved forward with this
wine production being allowed in the cg because of it becoming an industry.
And I know that a larger building was evidently or a larger site was evidently approved.
The concern is this is for one, as we understand, one particular property and it is being proposed
to be allowed citywide.
And many of our residences, the neighborhoods, abut cg.
So will this become an industry, going to start out I know wine making for people who buy their
supplies and they are going to make the wine for them, but what's the cap on how much wine that
can be produced on this property?
How is the City going to monitor and make sure that the production of wine doesn't exceed and I
haven't been able to find out those answers.

We have worked with the petitioner to try to come up with a definition of the intensity of this use.
It was revised at the last hearing that I think we discussed.
And it sets basically 3,000 square feet, from my memory.
I didn't bring the ordinance.
As the limit in terms of the size of the operation.
This is allowing for it as a permitted use in the cg district, the commercial general district, and we
do feel that it's within the intensity of a use that's allowed in the cg.
The definition of this use is really what's going to be controlling the intensity and how it operates.
