REQUEST: The Public Works Department requests the City Commission validate the
staff recommendation rmding The Landings at Parkstone to be built in
substantial accordance with the Final Engineering plans and to accept the
potable water and sanitary sewer infrastructure for ownership and
maintenance.
PURPOSE: The purpose of this agenda item is to request the City Commission validate the
staff recommendation finding The Landings at Parkstone to be built in substantial
accordance with the Final Engineering plans per Section 9-178 and to accept the
potable water and sanitary sewer infrastructure for ownership and maintenance in
order for Certificates of Occupancy to be issued. This site is located on the
northwest corner of S.R. 434 and Parkstone Boulevard.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on
lots; exceptions.
( c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans, such as
withholding occupancy, the building official may issue building permits upon
advising the developer that all or partial occupancy will be restricted until
satisfactory completion of the improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are
accepted by the city commission.
FINDINGS:
1) All City departments have found the work to be acceptable.

2) The portions of the potable water and sanitary sewer improvements to be owned by
the City have been dedicated to the City, and a 2-year maintenance bond has been
provided.
3) At Staffs recommendation, the final lift of asphalt on all onsite roads will be installed
at or near the end of the townhouse construction phase.
4) The site landscaping is incomplete and has been deferred in order to avoid substantial
destruction ofthe site landscaping during construction ofthe townhome units. Staff
recommends that the developer provide a performance bond for the construction value
of the landscaping.
RECOMMENDATION:
Staff recommends that the City Commission validate the staff recommendation finding The
Landings at Parkstone built in substantial accordance with the Final Engineering per Section 9-
178, and accept the potable water and sanitary sewer infrastructure for ownership and
maintenance, with the following condition:
1. The developer shall issue a performance bond to the City for the construction of the site
landscaping in the amount of $127,000. The performance bond shall be received prior to
issuance of any Certificates of Occupancy, and the bond shall be released when the City
has accepted the landscaping.
IMPLEMENT A TION:
Certificate of Occupancies for those units eligible can be issued after Commission approval.
