REQUEST: The Community Development Department presents to the City Commission a
request for a conditional use to allow major automotive service, paint, body, restoration, and
repair shop with light manufacturing, processing, assembly, and welding operations in the I-I
(Light Industrial) zoning district, at 240 Old Sanford-Oviedo Road, pursuant to Section 20-261 of
the Zoning Chapter of the City Code of Ordinances.
PURPOSE: The purpose ofthis agenda item is to consider a request by Blue Moon
Motorsports, the applicant, to locate an automotive restoration, light manufacturing, and welding
center at an existing developed site in the City's industrial area, on the north side of Old Sanford-
Oviedo Road, adjacent to and in front of a portion ofthe City's proposed Public Works complex.

CONSIDERATIONS:
The site is approximately 1.37 acres and contains 3 existing structures (a single story 15,000
square foot metal building, a single story 4,983 square foot metal building, and a 360 square foot
metal building). The site has I-I zoning, an Industrial Future Land Use (FLU) designation.
The application package states that some light manufacturing, processing, assembly, and
distnbution will be done on-site. Since the Code provides for light manufacturing, processing,

and/or assembly of vehicle accessories and parts, as well as wholesale sales and distnbution, this
appears to be a permissible use (pursuant to Subsection 20-259 (1) and Subsection 20-345.1 (1)
(kk)) for this site, but is being requested in the conditional use, to be prudent. The applicant
clarified the nature and extent ofthis portion of the business at the BOA meeting.
The proposed operation and conditional use was discussed at the October 4 staff review (by the
applicable City departments). The Building Official has advised that the paint booth will require a
separate building permit. The Fire Marshal stated that the applicant will not be required to retrofit
the existing building with fire sprinklers at this time, in part due to the self contained suppression
systems which will be installed within the buildings. Staff inquired of the extent (area) of what
appears to be an existing wetland at the north side of the property, abutting the City's Pubic
Works site. No encroachment into the wetland is proposed. A dumpster pad enclosure will be
required, sections 9-280 and 9-281 of the City Code.
CHRONOLOGY:

FINDINGS: l.The site has 1-1 (Light Industrial) zoning and an Industrial Future Land Use
(FLU) designation.
2. Planning staff finds the concept of a major automotive service paint, body,
restoration, and repair shop with welding operations within the 1-1 zoning district,
at this location, to be consistent with the general zoning and with the public
interest.
3. In the application package, the applicant notes that there will be no on-site
outside storage (as required by Code).
4. Pursuant to Section 20-33 ofthe City Code, "all conditional use
recommendations and final decisions shall be based on the following criteria to the
extent applicable:
(a) Whether the applicant has demonstrated the conditional use, including its
proposed scale and intensity, traffic-generated characteristics, and off-site impacts,
is compatible and harmonious with adjacent land uses, and will not adversely
impact land use activities in the immediate vicinity."
Staff believes the use, at the proposed scale and intensity, will be compatible
and harmonious with the adjacent land uses and not adversely affect land
use activities in the vicinity.

(b) "Whether the applicant has demonstrated the size and shape of the site, the
proposed access and internal circulation, and the design enhancements to be
adequate to accommodate the proposed scale and intensity of the conditional use
requested. The site shall be of sufficient size to accommodate design amenities
such as screening, buffers, landscaping, open space, off-street parking, and similar
site plan improvements needed to mitigate against potential adverse impacts ofthe
proposed use."
Staff believes that the applicant has adequately demonstrated that locating
within the 3 existing buildings on this site meets this criteria, subject to
constructing a dumpster pad enclosure, consistent with sections 9-280 and 9-
281 of the City Code.
(c) "Whether the proposed use will have an adverse impact on the local economy,
including governmental fiscal impact, employment, and property values."
Staff believes that this proposed use will have a positive impact on the local
economy, employment, and property values.
(d) "Whether the proposed use will have an adverse impact on the natural
environment, including air, water, and noise pollution, vegetation and wildlife,
open space, noxious and desirable vegetation, and flood hazards."
Staff believes that the proposed use will not have an adverse impact on the
natural environment.
(e) "Whether the proposed use will have an adverse impact on historic, scenic, and
cultural resources, including views and vistas, and loss or degradation of cultural
and historic resources."
Staff does not believe that the proposed use will have or create any of these
adverse impacts.
(f) "Whether the proposed use will have an adverse impact on public services,
including water, sewer, surface water management, police, fire, parks and
recreation, streets, public transportation, marina and waterways, and bicycle and
pedestrian facilities."
Staff does not believe that the proposed use will have or create any of these
adverse impacts.
(g) "Whether the proposed use will have an adverse impact on housing and social
conditions, including variety of housing unit types and prices, and neighborhood
quality. "

BOARD OF ADJUSTMENT RECOMMENDATION:
At its regularly scheduled meeting of October 6,2005, the BOA reviewed the
applicant's responses to the conditional use criteria in Section 20-33 ofthe City
Code and voted to recommend the Conditional Use be approved.
RECOMMENDATION:
The BOA and staff recommend the proposed conditional use for Blue Moon
Motorsports at 240 Old Sanford-Oviedo Road be approved.

Please state YOUR REQUEST: Conditional Use Approval for automotive maior service and repair
establishment in accordance with Section 20-261. City Code, as detailed in this application.
The APPLICANT IS RESPONSIBLE for posting the blue notice card (provided by the City) on the site at
least SEVEN (7) DAYS prior to the Board of Adjustment Meeting at which the matter will be considered.
Said notice shall NOT be posted within the City right-of-way. All APPLICANTS shall be afforded minimal
due process as required by law, including the right to receive notice, be heard, present evidence, cross-
examine witnesses, and be represented by a duly authorized representative.
The CITY COMMISSION shall render all final decisions regarding variances, conditional uses and waivers
and may impose reasonable conditions on any approved variance, conditional use or waiver to the extent
deemed necessary and relevant to ensure compliance with applicable criteria and other applicable
provisions of the City Code and Comprehensive Plan. All formal decisions shall be based on competent
substantial evidence and the applicable criteria as set forth in Chapter 20, Zoning. APPLICANTS are
advised that if, they decide to appeal any decisions made at the meetings or hearings with respect to any
matter considered at the meetings or hearings, they will need a record of the proceedings and, for such
purposes, they will need to insure that a verbatim record of the proceedings is made, at their cost, which
includes the testimony and evidence upon which the appeal is to be based, per 286.0105, Florida Statutes.
Any CONDITIONAL USE, VARIANCE, or WAIVER which may be granted by the City Commission shall
expire two (2) years after the effective date of such approval by the City Commission, unless a building
permit based upon and incorporating the conditional use, variance, or waiver is issued by the City within
said time period. Upon written request of the property owner, the City Commission may extend the
expiration date, without public hearing, an additional six (6) months, provided the property owner
demonstrates good cause for the extension In addition, if the aforementioned building permit is timely
issued, and the building permit subsequently expires and the subject development project is abandoned or
discontinued for a period of six months, the conditional use, variance or waiver shall be deemed expired
and null and void. (Code of Ordinances, Section 20-36.)

Blue Moon Motorsports is a world-class business specializina in automotive restoration.
fabrication. and systems. As Applicant is a manufacturer of world class suspension
components and systems. Applicant is further reauestino conditional use approval in
accordance with Section 20.261 (5), Winter Sprinos Code. as amended. of those lioht
manufacturino. processino, and assemblv activities associated with applicant's operations.
Attached as Schedule 1 to this Exhibit "A" is a brochure detailino the business operations of
Blue Moon Motorsports. LLC.
CJ How is the Conditional Use (including its proposed scale and intensity, traffic-generating
characteristics, and offsite impacts) compatible and harmonious with adjqcent land uses?
The Conditional Use is compatible and harmonious with adiacent land uses and will not
oenerate any neaative off-site impacts. The Conditional Use will be whollv contained within the
two (2) existina on-site buildinos, therefore there will be no visual impact to adiacent land uses.
The Conditional Use is expected to oenerate very little traffic. Fewer than one (1) customer per
day is expected to visit the business. As such. traffic oeneration will be limited to (j) emplovees:

deliveries. The paint filtration system will trap all particulate matters before release to the

areas. so it is not necessary to provide any screenino buffers. Applicant intends to install minor

have a positive economic impact on the local economy. From the human resources
perspective. the company pays a hiaher waae than comparable iobs in the industry and
marketplace. The annual Blue Moon median salary is $21.000 more than the Florida median.
and $13.000 more than the Orlando SMSA median. Hourlv emplovees eniov a median waae of
$5.24 more than the Florida median and $4.07 more than the Orlando SMSA median. Blue
Moon Motorsports also provides a comprehensive emplovee benefits packaae to its emplovees.
Additionallv. property values in the immediate area should increase as a result of their proximity
to this world-class operation. As Blue Moon Motorsports continues to arow. the local economy
will benefit from the increased number of hiahlv skilled and paid workers that will be associated
with the operation. as well as the taxes aenerated from business sales.

There will be no adverse impact on the natural environment. Blue Moon Motorsports is
a leader in environmental issues in the automotive repair and restoration industry. All
operations will be particulate free. Paint booths are at a level of environmental protection
matched bv onlv three (3) other restoration businesses in the Southeastern United States and
twenty-seven (27) facilities in the entire United States. As further detailed above. all operations
will be whollv contained within the existina buildinas on the site.

top notch performance suspension components and
systems, including tubular control arms for your muscle car

Our operations and capabilities are vertically integrated. In
other words, we do everything in-house: Chassis design and
fabrication, suspension systems, roll cages, tubular control
arms, outrageous prep and paint; hand-stitched custom
upholstery, engines, vehicle assembly and fabrication, final
assembly and road testing. All of our people are certified at
the highest levels in their areas of expertise with a
combined experience of more than 250 years it's no wonder
we can do just about anything automotive.

Automotive restoration is more than a profession. It is
synonymous to the role of a curator, preserving key
elements of history for future generations. America's love
affair with the automobile has grown from an idle weekend
hobby in a backyard garage to remarkable investment

The Wall Street Journal (February 8, 2005) reported that
twenty-seven collectible automobiles from the 1950's and
1960's outpaced the Dow by 600% since 1998. A $30,000
1968 Dodge Charger Hemi purchased in 1998 is now worth
well over $180,000 in restored condition. Not a bad
investment, especially when you consider the fun factor. In
addition, the automobile aftermarket has blossomed into a
$13 billion per year business. Vehicle manufacturers,
especially the "Big Three," understand this and depend on
aftermarket manufacturers, such as Blue Moon Motorsports,
to develop new products to improve their new factory
models.
There's no question of the return on investment of restored
and restorable cars. Major corporations now spend an
average of $180 thousand to have a collectible corporate
vehicle for shows, employee events and other marketing

CITY OF WINTER SPRINGS
"1-1" Light Industrial District
(Revised July 12, 2004; May 23,2005)
Sec. 20-258. In general.
The provisions of this district are intended to apply to lands and structures, by their use and location, which
are especially adapted to the business of wholesale distribution, storage and light manufacturing and to
authorized land uses and activities which could cause adverse secondary effects and influences on
residential areas and non-industrial uses. Such lands are located in close proximity to principal
thoroughfares and adequately separated (or buffered or both) from residential uses. The purpose of this
district is to encourage and develop exceptionally clean, non-objectionable industrial uses and to allow a
place for other uses and activities which could cause adverse secondary effects and influences on
surrounding neighborhoods if located elsewhere. It is also the intent of this district to protect adjacent
parcels from encroachment of smoke, fumes, vibration, noise or odors of any objectionable nature and to
promote aesthetic and architectural harmony, and attractiveness within the community. All uses allowed
hereunder shall abide by the performance and development standards of the city 1eGat-, county, state, and
U.S. government Areas of the city for which this zoning category may be appropriate are designated on the
future land use map as "Industrial".
Sec. 20-259. Uses permitted.
Within the 1-1 Light Industrial Zoning District, no building, structure, land or water shall be used except for
one (1) or more of the following uses:
(1) Any permitted use listed in Section 20-345.1 of the "Commerce Center" District;
(2) Any permitted use listed in Section 20-346.1 of the "C-3 Highway 17-92 Commercial" Districtfor
properties with frontage along US 17-92;
(3) Adult entertainment and sexually oriented businesses,..;
(4) Boat building and storage yards,..;
(5) Cabinet makers, furniture assembly and woodworking shops,..;
(6) Laundry and dry cleaning,..;
(7) Machinery sales and storage;
(8) Outside storage of contractor's equipment and supplies; public storage of tagged vehicles, boats,
RVs and commercial vehicles; fleet and dispatch yards; bulk storage; and other kinds of storage
yards of non-flammable I non-hazardous materials associated with manufacturing. (See Section
20-263 below.);
(9) Showrooms;
Sec. 20-260. Building height regulations.
No building or structure shall exceed fifty (50) feet.
Sec. 20-261. Conditional uses.
(1) Body piercing and tattoo shops.
(2) Building floor area greater than 50,000 SF;
(3) Halfway houses, group homes and similar uses,..;
(4) Kennels, pet and animal rescue operations, animal boarding houses, and similar animal facilities or
operations;

(6) Trucking terminals;

similar heavy type uses) provided that all activity shall be conducted within a completely enclosed
building and there is no outdoor storage of any kind.
Sec. 20-262. Bulk regulations.
(1) Minimum floor area: nine hundred (900) sq. ft.; Maximum floor area: 50,000 SF unless permitted by
Conditional Use.
(2) Minimum lot size: Seven thousand five hundred (7,500) sq. ft.
(3) Minimum lot width: Seventy-five (75) ft.
(4) Minimum lot depth: One hundred (100) ft.
(5) Minimum front setback: Twenty-five (25) ft.
(6) Minimum rear setback: Fifteen (15) ft.
(7) Minim um side interior setback: Five (5) ft.; side corner lot: Fifteen (15) ft.
(8) The total impervious surface area shall not exceed seventy-five (75) percent of the total site.
Sec. 20-263. Enclosed buildings and outside storage.
All uses shall be maintained within an enclosed permanent building with any outside storage screened from
streets by an 8' masonry wall with any gates being opaque.

About Us
Established in 1999, Blue Moon has grown from a two
person operation in a two-car garage to a 14 thousand
square foot facility employing sixteen full-time professionals.
Our objective is the preservation of automotive history and
the development of tomorrow's automotive ideas.
Starting with a simple premise...create a world-class vertical
business serving the automotive hobby, strive for 100%
customer satisfaction and price everything responsibly...the
concept has taken hold. We have completed ground up
street rods, multiple body-off restorations, show cars for
individuals, corporations and original automobile
manufacturers, restomods, Kirkham Motorsports authentic
aluminum Cobra ™ reproductions and developed an
international reputation as world class builders and
restorers.
In that short time we have also developed our own line of
top notch performance suspension components and
systems, including tubular control arms for your muscle car
or street rod, and the world's first bolt-in independent rear
suspension systems. These are sold under the Control
Freak Suspensions ™ label.
Our operations and capabilities are vertically integrated. In
other words, we do everything in-house: Chassis design and
fabrication, suspension systems, roll cages, tubular control
arms, outrageous prep and paint; hand-stitched custom
upholstery, engines, vehicle assembly and fabrication, final
assembly and road testing. All of our people are certified at
the highest levels in their areas of expertise. With a
combined experience of more than 250 years it's no wonder
we can do just about anything automotive.
Preserving
History
Automotive restoration is more than a profession. It is
synonymous to the role of a curator, preserving key
elements of history for future generations. America's love
affair with the automobile has grown from an idle weekend
hobby in a backyard garage to remarkable investment
opportunity.
The Wall Street Journal (February 8, 2005) reported that
twenty-seven collectible automobiles from the 1950's and
1960's outpaced the Dow by 600% since 1998. A $30,000
1968 Dodge Charger Hemi purchased in 1998 is now worth
well over $180,000 in restored condition. Not a bad
investment, especially when you consider the fun factor. In
addition, the automobile aftermarket has blossomed into a
$13 billion per year business. Vehicle manufacturers,
especially the "Big Three," understand this and depend on
aftermarket manufacturers, such as Blue Moon Motorsports,
to develop new products to improve their new factory
models.
There's no question of the return on investment of restored
and restorable cars. Major corporations now spend an
average of $180 thousand to have a collectible corporate
vehicle for shows, employee events and other internal and
external marketing activities. This is good for business and
good for historical preservation.
Not all old cars are worth preserving, but the exceptional
cars should be saved from the crusher and passed on for
generations to come.

Environment
Work and natural environment are our highest priorities.
After all, our shops are our showrooms.
At work our environment must be clean, comfortable and
conducive to producing exceptional product. That's why
Blue Moon Motorsports is not your average restoration
facility. Our floors are finished in a gloss epoxy, ensuring a
clean, stable and dust free environment. Our tools and
equipment are among the most environmentally friendly
produced when measured for noise and debris. Even our
paint systems are the most advanced in the world,
utilizing clean air in and filtered clean air out.
Protecting our natural environment is second nature at Blue
Moon. Our paint system filtration systems are designed to
trap particulate matter in specially designed filter systems
well before the exhaust air is released outside. In other
words, our paint booth exhaust air has no paint particiles in it
whatsoever. Only three such systems exist in the State of
Florida, while some 70% of all paint facilities in our state
would fail rigorous environmental testing.
Despite extensive restoration work and manufacturing, our
state-of-the-art Clean Air Work Stations absolutely control
dirt, debris and dust, making our workplace safer, cleaner,
brighter and more enjoyable than any other shop of its kind.
While we have said it before, we'll say it again: Our shops
are our showrooms and must maintain a showroom look and
fee I.

Human Assets
Blue Moon Motorsports, LLC has become successful
through its people. With more than 250 years of cumulative
experience, all of our professionals are certified in their
respective areas of expertise, and more.
Our paint, body and finishing staff are alii-CAR certified,
and our finishing manager is I-CAR Platinum Standard
certified, one of only 600 nationwide.
Blue Moon mechanics & technicians are all A.S.E. certified,
holding multiple A.S.E. and specific vehicle brand
certifications. In fact, one of our technicians not only holds
his ASE certifications, but was also schooled and trained by
"NASCAR school," UTI. Our technical manager goes well
beyond, holding Master ASE status in all areas of
certification.
In our manufacturing, fabrication and welding areas, our
fabricators are practiced and certified in automotive and
aircraft welding, making them among the best anywhere.
Some are even certified machinists.
With this group of professionals here to serve our individual
and corporate customers, it's no wonder that all of our
finished products are exceptional and recognized
nationwide.

Our Products
In addition to our extraordinary and unusual automotive
skills and services, Blue Moon Motorsports is also a
manufacturer of world class suspension components and
systems. The burgeoning aftermarket has provided an
opportunity for us to share our skills with the general public
and automobile manufacturers.
Sold under our Control Freak Suspensions ™ brand, we
have designed, developed and manufactured a series of
suspension components for vintage "muscle" cars and new
offerings from Ford Motor Company. We started with the
premise that most automobiles handle reasonably well for
everyday use. But as more and more new high performance
vehicles come to market, and as more collectors are
restoring older vehicles with the desire for today's handling
and safety, we created tubular front suspension control arms
to meet their needs. We began manufacturing in 2003 and
today we hold a significant share of the high end
performance aftermarket.
Our newest offering, a true bolt-in Independent Rear
Suspension (IRS) system for the 2005 Mustang, has taken
the automotive aftermarket by storm. This has never before
been accomplished, other than in dedicated race cars. We
built in safety, performance and the modern convenience of
anti lock brakes and traction control. The worldwide product
launch will take place in November at the SEMA show in Las
Vegas, the world's largest business-to-business trade show.
Trade magazines will feature our suspension systems on
several monthly covers and our pre-production orders are
already accumulating.
Clearly, Blue Moon Motorsports doesn't know when to quit.

Restoring or modifying collectible vehicles and show cars is
