REQUEST: City Manager requesting the City Commission hold a public hearing for Second Reading
and adoption of Ordinance Number 2005-30 amending the City's Code of Ordinances,
Chapter 9, Article VIll, Impact Fees.
PURPOSE: This agenda item is needed to adjust the impact fees for the Transportation, Fire, Parks, Police
and Public Building Impact Fee.
CONSIDERATIONS:
The revenues from the various impact fees have been below projections since they were revised in
2003. In addition, construction costs and land use changes have resulted in significant deviations from the
assumptions in the last impact fee report. Staff has been working with Land Design Innovations and CPR to
review projections and update the fees. Below is a comparison of the 2003 report revenue projections versus
the 2005 preliminary revenue projections with the current fee.

With the exception of Parks, the fees to be generated are significantly below the 2003 projections. The
primary reason is that higher intensity usages were projected and gross acreages were used as opposed to net
buildable. Staff has worked with CPR and LDI to develop buildout projections on a parcel by parcel basis
rather than a gross land use areas. The buildout by traffic zone tables are attached. The remaining totals
projected as of October 1,2005 are 3,635 residential units, 741,000 square feet of office, 931,000 square
feet of commercial, and 114,000 square feet of industrial.

The table below summarizes the current fee projections, 1 st reading projections, 2nd reading projections
and capital needs. As can be seen, the Police Impact Fee proposed at ftrst reading was insufficient because the
capital needs of $550,000 referenced from the LDI 2004 update was used instead of the original capital needs
for buildout utilized in 2003.

RECOMMENDATION:
It is recommended that the Commission hold a second reading/adoption of Ordinance Number 2005-30
amending the current Impact Fee Ordinance Chapter 9, Article VIII of the City Code.

IMPLEMENTA TION:
The impact fees will be implemented immediately upon adoption. If the Commission desires a
tiered approach to Fire or other impact fees, staff can solicit a proposal for a study.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF WINTER SPRINGS, FLORIDA, AMENDING THE CODE OF
ORDINANCES CHAPTER 9, ARTICLE Vill, IMPACT FEES, BY
AMENDING POLICE, FIRE, PARKS AND RECREATION,
PUBLIC BUILDING, AND TRANSPORTATION IMPACT FEES;
PROVIDING FOR THE REPEAL OF PRIOR INCONSISTENT
ORDINANCES AND RESOLUTIONS, INCORPORATION INTO
THE CODE, SEVERABILITY, AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida, has previously found
and determined it to be in the best interest of the safety, health, and welfare ofthe citizens of the City of
Winter Springs to establish police, fire, parks and recreation, and transportation and other impact fees to
require new development to pay their equitable share of public improvements that must be constructed to
serve new growth; and
WHEREAS, the City has retained Land Design Innovations, Inc. ("LDI") and CPH Engineers,
Inc. ("CPR") to conduct a periodic reassessment of the City's impact fees and to prepare a report on the
appropriateness of the City's current impact fees; and
WHEREAS, LDI has reviewed the current impact fees and anticipated development activity and
has determined that there will be a deficiency in the estimated impact fee revenues to accommodate the
proposed capital improvement schedules for Fire, Police, Parks and Public Buildings; and
WHEREAS, CPH has also reviewed the current impact fees and anticipated development
activity and has determined that there will be a deficiency in the estimated impact fee revenues to
accommodate the proposed capital improvement schedules for Fire, Police, Parks, Public Buildings, and
Transportation; and
WHEREAS, CPH has prepared a report titled "Transportation Impact Fee Update" dated
October 2005; and
WHEREAS, the City Commission hereby finds that the Reports legally justifies the imposition of
impact fees pursuant to applicable law. See, e.g., Volusia County v. Aberdeen at Ormond Beach, 760
So. 2d 126 (Fla. 2000); Contractors and Builders Association of Pin ell as County v. City ofDunedin, 329
So. 2d 314 (Fla. 1976); Wald v. Metropolitan Dade County, 338 So. 2d 863 (Fla. 3d DCA 1976);
Hollywood, Inc. v. Broward County, 431 So. 2d 606 (Fla. 4th DCA 1983); and
WHEREAS, the City Commission finds that Section 163.3202(3), Florida Statutes, encourages
the use of innovative land development regulations which includes the adoption of "impact fees," and

WHEREAS, the City Commission also finds that the impact fees required by this Ordinance are
necessary to mitigate impacts reasonably attributable to new development; and
WHEREAS, the City Commission also recognizes that the Florida Legislature has mandated that
local government plan comprehensively for future growth and that this regulatory Ordinance is consistent
with that mandate. See, e.g., Ch. 163, Fla. Stat.; and
WHEREAS, new land development activity generates public facility and service demands within
the City and it is reasonable to require new development to pay a fair share of the cost of expanding new
public facilities and services attributable to new development; and
WHEREAS, this Ordinance is enacted pursuant to the Florida Municipal Home Rule Powers
Act, Chapter 163, Florida Statutes, the City of Winter Springs Comprehensive Plan, and other applicable
law authorizing a municipality to set rates, fees, and charges for new development; and
WHEREAS, it is in the best interests of the public health, safety, and welfare of the citizens of
Winter Springs to amend the City's police, fire/rescue, parks and recreation, transportation and public
building impact fees and procedures.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS, AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are hereby incorporated herein by this
reference.
Section 2. Code Amendment, Chapter 9, Article vm, Division 3. The City of Winter
Springs Code, Chapter 9, Article vm, Division 3, is hereby amended as follows (underlined type
indicates additions and strikeout type indicates deletions, while asterisks (* * *) indicate a
deletion from this Ordinance oftext existing in Chapter 9, Article vm, Division 3. It is intended
that the text in Chapter 9, Article vm, Division 3 denoted by the asterisks and set forth in this
Ordinance shall remain unchanged from the language existing prior to adoption of this
Ordinance):

bonds which were used to finance past fire capital improvements as follows:

Fee includes credit which new development will incur to retire outstanding bonds
which were used to finance past parks and recreation capital improvements and
to retire the Winter Springs General Obligation Bond, Series 2002.
(ii) Non-residential: None.
(4) Fire, Police, and Parks and Recreation fees and credits have been determined
through 2007. A reassessment of the impact fees and credits shall be provided
prior to 2007 and codified in the City Code.
(5) Public Buildings:
(i) Residential: $ 400.00 per dwelling unit.
(ii) Non-residential:
$ 925.00 per 1000 square feet.
Fee includes credit which new development will incur to retire the 1984 Improvements
Revenue Bond (as refunded from time to time) which was used to finance the construction of
City Hall. At the time of establishing this Public Building Impact Fee, this bond was the only
outstanding bond which was used to fund past construction of City administrative service
public buildings.
Section 3. Transportation Impact Fees. The transportation impact fees are hereby amended as
attached which replaces Exhibit "B" as referenced in Section 9-386.7 of the Code of
Ordinances.

Section 4. Repeal of Prior Inconsistent Ordinances and Resolutions. All prior inconsistent
ordinances and resolutions adopted by the City Commission, or parts of prior ordinances and
resolutions in conflict herewith, are hereby repealed to the extent of the conflict.
Section 5. Incorporation Into Code. This Ordinance shall be incorporated into the Winter
Springs City Code and any section or paragraph number or letter and any heading may be changed or
modified as necessary to effectuate the foregoing. Grammatical, typographical, and like errors may
be corrected and additions, alterations, and omissions, not affecting the construction or meaning of
this ordinance and the City Code may be freely made.
Section 6. Severability. If any section, subsection, sentence, clause, phrase, word or provision
of this Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed a
separate, distinct and independent provision, and such holding shall not affect the validity of the
remaining portions of this Ordinance.
Section 7. Effective Date. This Ordinance shall become effective immediately upon adoption by
the City Commission of the City of Winter Springs, Florida, and pursuant to City Charter.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular

EXECUTIVE SUMMARY
The existing Transportation Impact Fee method, established in 1990, will remain unchanged.
Exhibit B of this fee method will be revised based on the information contained in the
Supplement No. 3 Update to the "City of Winter Springs Transportation Study" dated January
2005. No revisions were made to the roadway capital improvements program. However, higher
anticipated construction costs have resulted in a revised construction cost per lane mile.
Based on the required capital improvements, the Transportation Impact Fee does require an
adjustment at this time. Based on the information herein, the cost per lane mile of construction
should be increased from $942,029 to $1,934,783. Impact fees will be adjusted accordingly as
shown in Exhibit B. Exhibit B has also been adjusted for the categories, data and information
contained in Trip Generation, 7th Edition.
As part of our project task, we were asked to evaluate whether the projected revenues would be
sufficient to construct the capital improvements projects. Based on our analysis contained
herein, the proposed new impact fees and other of available revenue sources, we believe that
the transportation program can be adequately funded. Timing of the improvements versus the
timing of the revenues received will be a potential problem and the City will have to analyze
whether or not to implement bonding the improvements rather than utilize a pay as you go
method. Although there will eventually be the proper amount of revenue generated, the projects
may have to be constructed before the revenues can be collected. The identified transportation
expenditures total approximately $20.025.000. The projected revenues through build-out total
approximately $19.03 million based on available data from the City of Winter Springs for
development of future areas. Other revenue sources will have to be investigated and
implemented by the City to complete the projects required.
CAPITAL IMPROVEMENTS
The proposed capital improvements program is shown in Tables 1 and 2. The proposed capital
improvements program is based on the results of the Supplement No. 3 Update to the City of
Winter Springs Transportation StUdy, January 2005 and new estimates of probable construction
cost for the type of roadway construction required. Table 3 illustrates the calculation of the lane
miles of proposed construction used in the formulation of the traffic impact fees shown in
Appendix B. The lane miles of construction have not changed from the previous evaluation and
analysis.
PROJECTED REVENUES
We prepared, as Table 4, an estimate of impact fee revenues based on development data
provided by the City of Winter Springs. The resulting revenue was calculated from the fees in
the proposed Appendix B, attached.
The estimated impact fee revenues for single-family construction are $1.317.435, based on the
construction of 416 single-family units. The estimated impact fee revenues for multi-family
construction are $6.242.253, based on the construction of 3219 multi-family units. The total
projected revenue for all categories (projected build-out) is approximately $19.03 million.
Because of the unique characteristics of the Town Center, where residential units are directly
integrated with the commercial uses and therefore less vehicle trips are generated, the City has
applied an aggregate method of collecting impact fees. It is understood that this system will
continue through phases 2a and 2b of the Town Center area. It was also assumed that this
program would not be continued beyond this area.
OTHER SOURCES OF REVENUE
There are other sources of revenue available to the City. These include FDOT, the One Cent
sales tax option that was initiated by the voters in Seminole County, Developer contributions
(such as ROWand stormwater treatment) and other municipal funding mechanisms.
The City has applied for FDOT "TRIP" funding through Metroplan Orlando and the City is in the
process of applying for funding from FDOT under the County Incentive Grant Program. We
believe that there are adequate available sources over the lifetime of these projects, to complete
the projects. We also believe that the planning numbers were conservative in nature. In other
words the City staff was not overly optimistic about the amount of new development that would
or could occur on the remaining properties with the jurisdiction of the City.

We have spent considerable time with the City staff Upcfatklg and revising the potentia'

detsnnlnatlon of the future needs and the abfIJty of the City to Q)I~ revenues to offset
these needs. The tables developed from this effort are attached. The projected growth is
consistent with hIstot'icaJ recorde, known devGlopment plans from submittals and
disCUSSions with developers and other growth projections for the area. We believe the
projectionS are based on sound data and are a reaf'18tic representation of the future
growth for the area. These tables were originally developed for the trarflc analysis and
are arranged by tratIic zones. The City has retained the same format for the
detennination of growth used in establishing the other Impact fee analysis.
The City Staff prepared an analysis of the revised local government impact fees for CIty
services and departments and requested our review of Ihese projected fees and
revenues. We have performed an Independent review of the projected impact fees for
the various programs. They are:

3) Parks and Recreation
4) Public Buildings
The fees proposed are consistent with the needs projected by the various departments.
Based on data 8ubmitted to us by the City. ihese needs are related to growth
requirements and the ablllty of the City to serve the future residents' and businesses. In
cases where the improvements meet existing needs as well as futLll'1t growth needs, the
staff hae appropriately assigned a percentage of the project to Impact f8e8. It appears
that these fees are necessary for the community to meet their future obligations.
