REQUEST:
The Community Development Department requests the City Commission conduct a public hearing
for the second reading and adoption of Ordinance 2002-11, which would change the Future Land
Use Map (FLUM) designation of two (2) tracts located west of Tuskawilla Road, between Milky
Way and Trotwood Boulevard, from (Seminole County) Medium Density Residential to (City of
Winter Springs) Low Density Residential.
PURPOSE:
The purpose of this request is to adopt City-initiated FLUM designations for two (2) tracts
totaling 1.24 acres.
APPLICABLE LAW AND PUBLIC POLICY:
. Section 15-34 of the City Code states, "The city may approve proposed small scale
amendments to the comprehensive plan without regard to statutory limits on the
frequency of consideration of amendments to the comprehensive plan...."
. Section 20-57 of the City Code states, "The planning and zoning board shall serve as the
planning and zoning commission.. ..to recommend to the city commission the boundaries
of the various original zoning districts. . . .and any proposed amendments thereto. . . .and act
on measures affecting the present and future movement of traffic, the segregation of
residential and business districts and the convenience and safety of persons and property
in any way dependent on city planning and zoning....it shall serve as the local land
planning agency pursuant to the comprehensive planning act of the state...."

. Section 20-359 of the City Code states, "Any request for an alteration, revision, addition
or deletion to the final development plan shall be submitted to the city clerk for review by
the planning and zoning board... .the board shall review the proposal and the staff
recommendations to determine whether or not the proposed change is substantially
consistent with the approved final development plan. If the proposal is determined to be
consistent, the planning and zoning board may approve or approve with modifications the
proposed change."
CONSIDERATIONS:
1. The subject properties are comprised of a 0.81 acre tract that directly abuts Lots 729
through 741 of Oak Forest Unit 7 to the north and a 0.43 acre vacated right-of-way
which directly abuts the 0.81 acre tract to the north.
2. The subject properties are currently vacant with a FLUM designation of (Seminole
County) Medium Density Residential. Existing land use, zoning and FLUM
designations are shown in the table below:

3. Both tracts were annexed into the City in August 2000 but were never assigned City
FLUM designations.
4. Following the vacation of the 0.43 acre right-of-way in April 2001, half of it reverted
to the owner of the property north of its location (Tuscawilla Office Park) and the
other half reverted to the owners of the 0.81 acre tract, which abuts Tuscawilla Unit 7.
5. Both tracts were acquired in May 2001 by the abutting property owners ofTuscawilla
Unit 7 and recorded by deed in the Seminole County Registry.
6. Following annexation into the City and acquisition by the Oak Forest Unit 7 property
owners, the subject properties were never officially subdivided or recombined with
Lots 729 through 741.

7. The Seminole County Property Appraiser's Office has assigned individual property
identification numbers for each portion of the 0.81 acre tract that has been partitioned
by deed, as shown in Exhibit G.
8. The approval of the proposed FLUM amendment would be pursuant to the future
subdivision and recombination of the subject properties into Lots 729 through 741 of
Oak Forest Unit 7 as herein presented.
FINDINGS:
1. The request is consistent with all applicable goals, objectives and policies ofthe
City's adopted comprehensive plan.
2. Considering the type and location of uses involved and the general character of
the area, the request would not result in any incompatible land uses, including
such factors as height, bulk, scale, intensity, traffic, noise, drainage, dust, lighting,
appearance, and other similar applicable factors.
STAFF RECOMMENDATION:
Staff recommends the City Commission adopt Ordinance 2002-11, which would change
the FLUM designation of the subject properties from (Seminole County) Medium Density
Residential to (City of Winter Springs) Low Density Residential, subject to the following
condition:
A. Prior to the FLUM amendment becoming effective, the owners
of the subject properties must obtain approval for the alteration of the final
subdivision plan as stated in City Code Section 20-386, in order to combine the
subject properties with Lots 729 through 741 of Oak Forest Unit 7 and legally
record the same.

PARTICULARLY DEPICTED AND LEGALLY DESCRIBED

WHEREAS, the future land use map amendment embodied in this Ordinance is a small scale
amendment to the City of Winter Springs Comprehensive Plan in accordance with Section
163.3 187 (1 )( c), Florida Statutes; and
WHEREAS, the Local Planning Agency of the City of Winter Springs held a duly noticed
public hearing on March 6,2002, in accordance with the procedures in Chapter 163, Part II, Florida
Statutes, on the proposed Comprehensive Plan Amendment and considered findings and advice of
staff, citizens, and all interested parties submitting written and oral comments and has recommended
adoption to the City Commission; and
WHEREAS, the City Commission of the City of Winter Springs held a duly noticed public
hearing on the proposed amendment set forth hereunder and considered findings and advice of staff,

citizens, and all interested parties submitting written and oral comments and supporting data and
analysis, and after complete deliberation, hereby approves and adopts the Comprehensive Plan
Amendment set forth hereunder; and
WHEREAS, the City Commission of the City of Winter Springs hereby finds. that this
Ordinance is in the best interests of the public health, safety, and welfare of the citizens of Winter

Springs.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS HEREBY ORDAINS, AS FOLLOWS:
Section 1.
Recitals.
The foregoing recitals are true and correct and are fully
incorporated herein by this reference.
Section 2.
Authority. This Ordinance is adopted in compliance with, and pursuant to,
the Local Government Comprehensive Planning and Land Development Regulations Act.
Section 3.
Purpose and Intent. It is hereby declared to be the purpose and intent of this
Ordinance to clarify, expand, correct, update, modify and otherwise further the provisions of the City
of Winter Springs' Comprehensive Plan.
Section 4.
Adoption of Amendment to the Future Land Use Map. The City of
Winter Springs' Comprehensive Plan, Future Land Use Map, is hereby amended by designating the
'real property depicted on Exhibit "A" from Seminole County "Medium Density Residential" to City
of Winter Springs "Low Density Residential." Exhibit "A" is attached hereto and fully incorporated
herein by this reference.

Section 5.
Transmittal to the Department of Community Affairs. The City Manager
or his designee is hereby designated to sign a letter transmitting the adopted Comprehensive Plan
Amendment to the Florida Department of Community Affairs, in accordance with Section
163.3 I 87(1)(c)(4), Florida Statutes, and Section 9J-l1, Florida Administrative Code.
Section 6.
Repeal of Prior Inconsistent Ordinances and Resolutions. All prior

inconsistent ordinances and resolutions adopted by the City Commission, or parts of prior ordinances
and resolutions in conflict herewith, are hereby repealed to the extent of the conflict.
Section 7.
Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shall not affect the validity
of the remaining portions of this Ordinance.
Section 8.
Incorporation into Comprehensive Plan. Upon the effective date of the
Comprehensive Plan Amendment adopted by this Ordinance, said Amendment shall be incorporated
into the City of Winter Springs' Comprehensive Plan and any section or paragraph number or letter
and any heading may be changed or modified as necessary to effectuate the foregoing.
Section 9.
Effective Date and Legal Status of the Plan Amendment. The effective
date of this Ordinance shall take effect thirty-one (31) days after adoption, in accordance with Section
163.3 I 87(3)(c), unless challenged within thirty (30) days after adoption of this Ordinance, then this
Ordinance shall become effective at such time the Florida Department of Community Affairs or the
Administration Commission issues a final order determining the adopted small scale Comprehensive

Plan Amendment is in compliance. No development orders, development permits, or land use
dependent on this Amendment may be issued or commenced before it has become effective. After
and from the effective date of this Amendment, the Comprehensive Plan Amendment set forth herein
shall amend the City of Winter Springs' Comprehensive Plan and become a part of that plan and the
Amendments shall have the legal status of the City of Winter Springs' Comprehensive Plan, as

amended.

I. APPLICABLE LAW AND PUBLIC POLICY
Section 15-34 of the City Code states, "The city may approve proposed small scale
amendments to the comprehensive plan without regard to statutory limits on the frequency
of consideration of amendmenL~ to the comprehensive plan...." .
Section 20-57 of the City Code states, "The planning and zoning board shall serve as the
planning and zoning commission....to recommend to the city commission the boundaries
of the vcuious Oliginal zoning dist:ricts....culel CU1Y proposed cunendments thereto....culd act
on measures affecting the present and future movement of traflic, the segregation of
residential culd business districts .md the convenience CUlel safety of persons culd property in
CU1Y way dependent on city planning CUlel zoning....it shall serve as the locallculd plcu1l1ing
agency pursucult to the comprehensive plcu1l1ing act of the state...."
Section 20-359 of the City Code states, "Any request f()l' CUl alteration, revision, addition or
deletion to the final development plan shall be submitted to the city clerk for review by the
plcu1l1ing culd zoning bocu.d....the board shall review the proposal culel the stafT
recommendations to detennine whether or not the proposed change is substcultially
consistent with the approved final development plan. If the proposal is determined to be
consistent, the plcu1l1ing culd zoning board may approve or approve with modifications tile
proposed chculge."
II. SUMMARY OF APPLICATION
A. Applicant:

The subject properties are individually owned by the owners of Lots 729 dlrough
741 of Oak Forest Unit 7 of Tuscawilla Plcu1l1ed Unit Development (PUD).
C. Requests:
1. Small-scale cOlpprehensive plCUl cunendment, from (Seminole County)
Medium Density Residential to (City of Winter Springs) Low Density
Residential 0.1 to 3.5 dwellings units per acre)
2. Zoning map amendment, from (Seminole County) A-I Agricultural to (City
of Winter Splings) PUD
3. PUD development plcUl amendment, which would incorporate the subject
property into the Tuscawilla PUD (Attachment H)
D. Purpose:
The purpose of this request is to adopt City-initiated Future Land Use Map
(FLUM) and zoning desihTnations for two (2) tracts totaling 1.24 acres and thus
incorporate them into the "Tuscawilla PUD.
E. Site fufonnation:
1. Parcels and PIN: Following the amendment of the FLUM, zoning map and
PUD development plan, the subject properties would be combined with
Lots 729 through 741 of Oak Forest Unit 7, as shown on Attachment G, in
a separate application for subdivision. Even though the properties have
never been ollicially subdivided, they are currently recorded by deed in the
Seminole County's Property Appraiser's Oflice with the following Property

6. Development Trends: The subject properties, including both the 0.81 acre
parcel and the 0.43 acre vacated right-of-way, arc undevelopcd. With the
exception of single-hunily development to the south, thc sUn"ounding arca is
either undeveloped or developed for agricultural uses. With the recent
adoption of the nearby Town Center future IcUld use and zoning
classifications, properties in cUld around the area are expcctcd to expcrience
greatcr development activity as supporting inli-astructure for the Town
Centcr is constructcd.
7. Petitions of Opposition and/or SUPfJOrt: A petition by the property owners
ofLoL'i 729 through 741 of Oak Forest Unit 7 was filed in the City Clcrk's
otficc supporting the application.
F. Considerations:
1. The subject propcrties are comprised of a 0.81 acrc tract that directly abuts
Lots 729 through 741 of Oak Forest Unit 7 to the nortll and a 0.43 acre
vacated right-of-way which directly abuts tlIC 0.81 acre tract to the nortl1.
2. Both tracts werc annexcd into tlle City in August 2000 but were never
assibll1ed City FLUM or zoning designations.
3. Following tllC vacation of the 0.43 acrc right-of-way in April 2001, half of it
rcverted to tlIe owner of tlle property nortll of its location (T'uscawilla
OtTice Park) and the other half revertcd to the owners of the 0.81 acre tract,
which abuts Tuscawilla Unit 7.
4. Botll tracts were acquired in May 2001 by the abutting property owners of
'T'uscawilla Unit 7 and rccorded by deed in the Seminole County Registry.
5. Following cumexation into tlIe City cUld acquisition by tlIC Oak Forest Unit 7
property owners, tlIe subject properties were never otTicially subdivided or
recombined witlI LoL'i 729 through 741.
6. The Seminole County Property Appraiser's OtTice has assigned individual
property identification numbers for each portion of tlle 0.81 acre tract tllat
has been partitioned by deed, as shown in Exhibit G and described under
lIE Site hl/0fllliltioJ1.
7. The incorporation of the subject property into the Tuscawilla PUD would
be pursuant to the future subdivision and recombination of the subject
properties into Lots 729 through 741 of Oak Forest Unit 7 as herein
described.
III. ANALYSIS
A. Justification for Amendments:
The subject properties adjoin Lots 729 through 741 of Oak Forest Unit 7, which
are developed for low density residential uses (approximately 1.2 to 3.5 units per
acre) and zoned PUD. The subject properties are depicted as Medium Density
Residential on Seminole County's FLUM and zoned A-I Ah'Ticultural District.
Now that both properties are within Ule City of Winter Springs, the zoning and
futllre land use maps should be amended to City designations to eliminate Ule
inconsistency between adopted future land use and zoning.
The sul~ject properties would benefit Ii'om Ule FLUM and zoning amendments.
The linear configuration of bOUI properties is currenUy preemptive to development.
'The adoption of a low density residential future hmd use for these properties, along
with UlCir combination with Ule adjoining lots of Oak Forest Unit 7, would not
lower Ule density beyond that which is established for low density residential and
would Ulerefore be consistent WiUI Ule FLUM established by Ule comprehensive
plan.
B. Public Facilities and Services:
'rhe subject properties would eventually be combined with Lot,> 729 ulrough 741 of
Oak Forest, which are already developed for low density residential use. Since no
othel" changes are being proposed to those existing single-family developments, the
proposed amendments would have no impact on public facilities and/or services.
C. Nuisance Potential of Proposed Use to Surrounding Land Uses:
The proposed amendments would not alter Ule character nor create Ule potential
for nuisances to surrounding land uses, since no additional land uses would be
created.
D. Consistency with the Comprehensive Plan:
The proposed amendments would make Ule FLUM and zoning map designations
consistent for the subject properties, while allowing for the continuation of Ule low
density residential future land use established by Ule comprehensive plan Jar Oak
Forest Unit 7 of Ule Tuscawilla PUD.
IV. FINDINGS
A. The request is consistent with all applicable goals, objectives and policies of the
City's adopted comprehensive plan.
B. Considering the type and location of uses involved cUld the general character of the
area, the request would not result in .my incompatible lcmd uses, including such
factors as height, bulk, scale, intensity, trallic, noise, drainage, dust, lighting,
appearance, and other similar applicable factors.
V. STAFF RECOMMENDATIONS
Stall' believes the proposed amendment to the PUD development plan is substantially
consistent with the approved final development plan and recommends that the planning
and zoning board approve the proposed change, in accord.Ulce with City Code Section 20-
359.
Stalr further recommends that the planning and zoning board approve the amendment of
the FLUM from (Seminole County) Medium Density Residential to (City of Winter
Springs) Low Density Residential and the amendment of the otlicial zoning map from
(Seminole County) A-I Ab1ricultural to (City of Winter Springs) PUD, subject to the
following condition:
A. Prior to the FLUM and zoning map amendments becoming effective, the owners of
the subject properties must obtain approval for the alteration of the final
subdivision plan as stated in City Code Section 20-386, in order to combine the
subject properties with Lots 729 through 741 of Oak Forest. Unit. 7 and legally
record the same.

We, the members of the North Cheoy Lee Circle Group, purchased extensions to our
property in May 2001. Shortly afterwards, a right of way was vacated by the City of
Winter Springs, giving each property owner an additional fifteen feet along the northern
boundary. We the propeI1y owners would like to request:
1, That the City of Winter Springs annex into the city our property extensions,
including the vacated right of way, ifit has not been done so to date. j
2. That the City of Winter Springs change the zoning of this property, including
the vacated right of way, from agricultural to residential.
