REQUEST:
The Community Development Department requests the City Commission consider information
about the median opening at the entrance to Stone Gable.
PURPOSE:
The purpose of this agenda item is to advise that FDOT on July 3,2002 decided to move the SR
434 median opening in front of Stone Gable back to its original location in front of the Villagio
commercial property.
CONSIDERA TIONS:
. Several years ago the developer of Stone Gable, Cambridge Homes, entered into an
agreement with FDOT to relocate the median cut from its original location in front of
Villagio to its present location at the entrance to Stone Gable. The agreement specified
that the developer must provide direct cross-access from the Stone Gable entry road to
the Villagio property. Access has been denied by the Stone Gable HOA.

. The Stone Gable HOA was notified by phone and mail on June 21 st by Villagio that a
meeting was going to be scheduled at the DOT headquarters building in Deland to
discuss the matter and gave them the choice of July 3 or July 12. These were the only
dates available in July for FOOT engineering personnel. According to Villagio
personnel, the HOA did not respond and the July 3rd date was selected by FDOT. The
president and vice president of the Stone Gable HOA were given advance notice by
Villagio on June 26th of the July 3rd scheduled meeting by certified mail return receipt
requested. On July 2nd the president of the HOA sent an e-mail to Villagio's attorney
stating that he would not be able to attend. No response was received from the vice
president of the HOA.
. The meeting took place as scheduled and FDOT decided to move the SR 434 median
opening back to its original location in front of the Villagio commercial property. The
basis for the decision was that the commercial development will generate significantly
more traffic than the Stone Gable subdivision. Representatives of Stone Gable HOA
were not represented.
. The residents of Stone Gable will be able to make a right turn in or out of the subdivision
under this arrangement.
STAFF RECOMMENDATION:
None required.

Dear Mr. Kearney:
Thank you for following-up with us letting us know you would not be able to attend the meeting to
discuss the median opening on State Road 434 at the entrance to your subdi~ision. I hope your child is
feeling better and all is well at you, home.
We deal with many issues with respect to median openings, particularly when it comes. to new and
existing developments. The media.n opening currently in place at the entrance to your subdivision was
previously in front of your neighbor's property. Upon the development of the subdivision, we allowed
the opening to be moved, to align with your entrance roadway. However, this was done with the
understanding between the Department and the developer that this relocation was stipulated that cross.

would not have allowed the median opening to be relocated.
I now understand that the Stone Gable Homeowner's AssoCiation does not agree with allowing cross
access to the commercial development. This puts the Department in the position to rule on the location of
the IJledian opening and if we should ignore the commitments made in the past. We must make these type
decisions on traffic volume along with the type of tr~~. . ' '
The commercial development will generate significantly more ttaffic than the subdivision. Along with
the larger volume, delivery trocks will be needed to bring the products to the various shops in the "
corrunercial developmen~. With this in mind, along with the good faith effort made at the permitting of
the access to State Road 434 for the subdivision, we will be permitting the relocation of Ihe median
opening from its current location in front of the Stone Gable subdivision to the area near its original '
location. The developer of the adjacent land will modify their site plan to include'a connection through' .
their property should the homeowner's association so chose to connect in the future. In the meantime,
motorists wishing to turn left into Stone Gable will need to u-turn at the next median opening to the west.
