REQUEST: Community Development Department presents to the City Commission, the
preliminary engineering and site plan for the Highlands Apartments, Phase II.
PURPOSE: The purpose of this agenda item is to present to the Commission the preliminary
engineering and site plan for 42 apartments on 2.069 acres, located within the
Highlands Planned Unit Development (PUD), along the west side of Sheoah
Boulevard and immediately north of the existing Seville on the Green Apartments.
This site was originally approved for blocks 5 and 9 of the Seville~ the Green
Apartments, but these units were not constructed and the un-developed site was
eventually obtained by another party.
APPLICABLE LAW:
Sec. 9 - 26. Maps, engineering plans and plats to be submitted in
preliminary and final form.
Sec. 9 - 46. Filing and contents of preliminary map and plan.
Sec. 9 - 47. Action on preliminary plan by city council.
Sec. 9 - 49. Approval of preliminary plan to be construed only as authority
to submit final plan.

. April 3, 2002 - Preliminary plan received P& Z recommendation of approval.
FINDINGS:
1) The proposed site plan is consistent with the approved master plan in terms of the number of
units, setbacks, number of bedrooms, height, and number of parking spaces (please see
information block at lower right-hand column of site plan sheet C004).
2) The proposed site plan is consistent with the City Code and Comprehensive Plan, subject to
the following modifications, which are to be made as part of the final site/engineering plan
submittal:
a. a handicap accessible sidewalk must be provided from the public street or sidewalk to the
accessible building entrances (Sec. 4.3.2 of the "Florida Accessibility Code for Building
Construction,)) October 1997 Ed.)~
b. sheet C007 must be corrected to depict a 24-foot wide driveway (2-way) with at least 18-
foot long parking spaces~
c. the applicant must document authorization from the owner of the existing apartments to
service the dumpster through the adjacent parking lot~
d. a 15-foot wide utility easement must be depicted (to be provided prior to Certificate of
Occupancy) over each of the on-site utility lines to be accepted and maintained by the
City~ and
e. a marked and striped fire lane must be adequately depicted on sheet C006 (NFPA 1,3-5,
3-5.2, and 3-5.4) - this to include a free-standing sign with language prescribed by the
Fire Marshal.
PLANNING AND ZONING BOARD:
At its regularly scheduled meeting of April 3, 2002, the City of Winter Springs Planning and
Zoning Board voted 3-0 to recommend approval of the Highlands Apartments, Phase II,
preliminary site plan, subject to the conditions set forth in the "findings,)) above.
RECOMMENDATION:
The Planning and Zoning Board and Staff recommend approval of the Highlands Apartment,
Phase II, preliminary site/engineering plan, subject to the conditions set forth, above, in the
findings section, items 2 a-e.

CONCLUSION
I
This study was conducted to estimate the traffic impact from the proposed Highlands Apartme11ts
located in the City of Winter Springs, Florida. The results of the study are summarized below:

. The proposed development will generate approximately 278 new daily trips with 21 and 26
trips occurring during the AM and PM peak hours, respectively.
o
. The signalized SR 434 and Sheoah Boulevard intersection currently operates at a satisfactory
level of service and will continue to operate at an acceptable level of service at project build-
out.
I
. The arterial road segments currently operate at satisfactory levels of service in the peak-
hour/peak-direction and will continue to operate at acceptable levels of service in the peak-
hour/peak-direction at project build-out.
II
I
. With 3 and 17 vehicles entering the sites at the AM and PM peak-hours, respectively. The
site will not warrant the construction of turn lanes at the site entrance. No capacity
improvements to the road network are required as a result of the proposed Highlands
Apartments.

. The project meets Concurrency Standards required by the State of Florida, Growth

Our review of this data finds the study to be in accordance with standard transportation
engineering procedures and ITE. The study is approved based on the information submitted
with the exception of Table 4 which needs to be revised to the correct intersection to match the
text of that section.

The Planning And Zoning BoardILocal Planning Agency Regular Meeting was called to
order Wednesday, April 3, 2002, at 7:06 p.m. by Vice Chairman Tom Brown in the
Commission Chambers of the Municipal Building (City Hall, 1126 East State Road 434,
Winter Springs, Florida 32708).

Mr. John Baker, AICP, Current Planning Coordinator, Community Development
Department introduced the Agenda Item and stated, "In the findings there are five (5)
conditions of things to be done with the Final Engineering."
Mr. Amr T. Gawad, True Engineers & Architects Inc., 1836 Woodward Street, Suite 101,
Orlando, Florida: briefly spoke of the history of the land and parking spaces.
Mr. Gawad answered the Board's questions pertaining to access roads; when construction
could begin; the playground; the agreement with Seville On The Green; and the school
zonmgs.

B. Wagner's Curve Preliminary Subdivision Plan.
The Agenda Item was introduced by Mr. Baker. Referring to the findings Mr. Baker said,
"Staff recommends approval however we do note and bring to your attention that through
this Development Agreement there are some areas that are inconsistent with the Code.
That is perfectly legal, perfectly acceptable and normal but we do list here under the
finding areas where this is different than the Code." Mr. Baker then reviewed the
inconsistencies.
A Memorandum from Ms. Jimette Cook, Code Enforcement Manager, Community
Development Department and Mr. Mike Mingea, Environmental Inspector/City Forester,
Code Enforcement Division, Community Development Department was distributed to the
Board Members.
Vice Chairman Brown commended Staff on the thorough information presented in the
Agenda Item and stated, "I think you have done a very good job and knowing what we've
been trying to do - that it is evident. We put our confidence in you to handle,ell that."

Mr. Tom Daily, Daily Design Group, 861 West Morris Boulevard, Winter Park, Florida:
addressed the Board regarding the history of the project; the Development Agreement
allowing the project to blend with the Town Center; and the construction time line.
Discussion followed regarding the Zoning; the project having Town Center features;
common ownership and maintenance; the placement of the townhouses in relationship to
State Road 434; that Pinal Engineering Plans would only come before the Board if there
were significant changes; the location of the entrance; and there is a provision in the
Developer's Agreement regarding road maintenance.
Mr. Daily was asked by the Board how the project would impact traffic on State Road
434 and how the schools will be effected. Mr. Daily advised that the "Property is
currently zoned and approved for a shopping center and so the amount of traffic that
would be from that shopping center is greatly more than what the traffic would be for
townhomes and so it is actually a deduction in traffic." Additionally, Mr. Daily said
traffic reports were submitted not only to the City but also to the Department of
Transportation and that he did not know what schools children would attend. Discussion.

THE DEVELOPMENT AGREEMENT AND THE FINDINGS, THE LOCAL
PLANNING AGENCY RECOMMENDS APPROVAL BY THE CITY

Mr. McDonald spoke of the City Commission's concern of certain permitted and
conditional uses being permissible in the Greeneway Interchange District and reviewed
the Staffs report with a PowerPoint presentation.

Board Members and Staff discussed the differences between community shopping centers
and strip malls; "big box retailers"; the location of the Greeneway District; the procedure
for removing billboards; "How immediate is this issue"; and the need to differentiate and
further distinguish the percentages of allowed uses in the future.
Mr. Charles Carrington, AICP, Community Development Department Director reiterated
the purpose and requested the Board's Recommendation.

Mr. Carrington distributed documents to the Board - Members while Mr. McDonald
explained that they were proposed changes to the current C-2 (Commercial District) and
the creation of a new Industrial District. Mr. McDonald said that no action was expected
tonight and in fact would be coming before the Board at the Board's next Regular
Meeting. -.
Members of the Board questioned whether the City would allow adult entertainment. Mr.
Carrington explained that under "State Statutes you must allow it" but the City can
determine the location. Brief discussion.

Mr. Carrington reported that the developers and applicants have complained of the time
delay of going before the City Commission by waiting for approval of Planning and
Zoning Board/Local Planning Agency Meeting Minutes. Mr. Carrington explained that
"The Commission discussed this at length last night and elected to try for a year with the
following procedure that I will describe to you. Instead of having attached approved
minutes, they would have attached Minutes that have been typed up by the City Clerk's
Office from your Meeting that had not been back before the Board for approval but had
been reviewed and initialed by the Chairman or Vice Chairman."
Next, Board Member Joanne Krebs suggested delaying Election Of Officers until which
time the City Attorney's Opinion has been received: and again asked that the City
Attorney give the Board an Opinion "On whether that Ordinance regarding the Boards
and the absence and all that other stuff applies to those Boards not having any other
information - in their By-Laws or - if it repeals those." The Board agreed not to hold the
Elections at the May Regular Meeting. Brief discussion.

1. Hydrostatrc tests consisting of pressure test and leakage test
shall be conducted on all newly installed water distribution system
pressure pipes and appurtenances. The tests shall be in accordance
with the latest provisions of ANSI/AWWA C600 or M23 as applicable.
2. Disinfection of the water distribution system shall be performed in
accordance with the latest provisions of ANSI/ AWWA C651
disinfecting water mains prior to any portion of the water main
being placed into service. The bacteriological tests shall be
conducted in accordance with .Standard Methods for Examination of
Water and Wastewater. for the cOIi-aerogenes group, by an approved
laboratory, acceptable by the Engineer, the Deportment of
Environmental Protection, and the Health Department having
jurisdiction. The contractor sholl provide the Engineer with copies of
the results within one (1) week of tests far submittal to the various
agencies.
3. In 011 cases where sanitary sewer mains crass under water mains
with less than 18 inches of vertical clearance, and in all cases where
sanitary sewer mains cross aver water mains, the sewer the water
main shall be ductile iran pipe far a distance of 20 feet, centered
on the point of crossing. In all cases where the water main or
sanitary sewer crosses under or over the storm sewer main less
than 18 inches vertical clearance, the water main shall be ductile
iron pipe for a distance of 20 feet, centered on the point of
crossing.
A horizontal separation of 10 feet shall be maintained between 011
water, storm and sanitary sewer mains. Where conditions do not
permit the 10-foot separation, the sewer main must be laid in a
separate trench or the same trench divided by a bent of undisturbed
earth, and the sewer main must be 18 inches below the invert of
the water main. If separation between water/sewer can not be
maintained, the water main must be upgraded to ductile iron pipe
until the specified trenches can not be dug or the separation is
provided. Unless otherwise specified by City of Winter Springs, the
requirements above shall dictate.
4. All PVC pipes shall bear the approval seal of the National
Sanitation Foundotion (NSF) for potable water pipe.
5. There sholl be no detectable level of infiltration or exfiltration
from sanitary sewer system at the time of inspection. Any evidence
of leakage must be corrected prior to acceptance by the Owner.
6. Gravity sewer pipe shall be green SDR 35 PVC conforming to the
requirements of ASTM D3034.
7. Plug valve to be installed vertically and tapping valve to be
installed horizontally and abandoned in the open position.
8. All meters 2 inches and under shall be installed by City.
9. All Reduced Pressure Backflow Preventors (RPZ) shall be installed
by the Contractor.
10. A minimum of 3 feet of cover sholl be provided over all
proposed lines unless otherwise noted hereon.
11. EMERGENCY WASTEWATER SPILL AND WATER MAIN BREAK
PROCEDURES:
a. Excavate Cautiously - the Contractor shall exercise extreme
caution when excavating in proximity of wastewater force mains and
gravity sewers. Force moin and sewer locations shown on pions are
not exact or guaranteed. Contractor is responsible for field
verification.
b. Telephone Notification - the City of Winter Springs dispatch
operator shall be gravity sewer or water main break or damage at
(407) 327-1800.
c. Repair Immediately - All damage to City's mains shall be repaired
immediately by the Contractor at the Contractor's expense. If the
repair is not made in a timely manner, as determined by the City's
Inspector, City moy perform repairs and the Contractor will be
charged for repairs.

e. Advance Notification of Construction - the City of Winter Springs
Utilities Construction Section (407) shall be notified at least seven
(7) days prior to any construction activity.
f. Advance Notification of Pending Connection - the City of Winter
Springs Water Division (407) and the City of Winter Springs
Wastewater Division (407) shall be notified at least seven (7) days
in advance to schedule main tie-ins and valve operations.
g. Operation of City of Winter Springs Valves - water, wastewater.
and reuse valves are to be operated only be City of Winter Springs
Utilities Inspector (407). All valves being installed are to remoin
closed during construction.
h. Operation of City of Winter Springs Pump Stations - the
Contractor shall coordinate all pump station operations and shut
downs with an City of Winter Springs Utilities Inpspector (407) .
12. On site water distribution system is privately owned and
mointained.
13. On site wastewater collection system and pump station is
privately owned and maintained.
