REQUEST: Community Development Department, Current Planning Division, requesting
Commission approval for the acceptance of the improvements (potable water and
sanitary sewer systems) located at Parkstone, Unit Ill, to be dedicated to the City
for ownership and maintenance.
PURPOSE: The purpose of this Agenda Item is to request that the Commission accept the
portions of the potable water and sanitary sewer systems within Parkstone, Unit
Ill, for public ownership and maintenance. This site is located north of SR 434,
west of Central Winds Park.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on
lots; exceptions.
(c) Where the building official has an authoritative method of assurance that the
improvements will be completed in accordance with approved plans, such as
withholding occupancy, the building official may issue building permits upon
advising the developer that all or partial occupancy will be restricted until
satisfactory completion of the improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are
accepted by the city commission.

FINDINGS: 1) All City agencies have found the work to be acceptable.
2) The Engineering Division inspected and approved the site
improvements to be in substantial conformity with the improved final
engineering plans with the exception of those items addressed in City
Engineer Kimberley Hall's March 28, 2002, letter to project engineer David
Kelly, P. E., of Donald W. McIntosh Associates, Inc.
3) The potable water and sanitary sewer lines are to be dedicated to the City for
ownership and maintenance and a 2-year maintenance bond has been
received (original to City Clerk and copy to City Attorney).

The SURETY unconditionally covenants and agrees that if the PRINCIPAL fai~ to
nerform within the time specified, the SURETY, upon 30 days written notice: from
CITY " or its authorized agenT or officer, of the default will forthwith correct sp.ch
defect or defects and pay the cost thereof, including, but not limited to engineering. legal
and contingent cost. Should the SURETY fail or refuse to correct said defects, the

the consideration in approving and filing the said plat shall have the right to resort to any
and all legal remedies against the PRINCrP AL and SURETY and either, both at kw and

at its option, shall have the right 10 correct said defects resulting from faulty matelials or
workmanship, or, pursuant to public advertisement and receipt of bids, caused to be

and in the event the CITY should exercise and give effect to such riglt, the
PRINCIPAL and the SURETY shall be jointly and severally hereunder to reimburse the
CITY the total cost thereof, including, but not limited to, engineering, legal and
contingent cost, together with any damages either direct or consequent which nay be
sustaintXi on account. of the failure of the PRINCIPAL', to correct said defects.

I have received the "as-built" engineering and inspection fee including the
engineer's certification of completion for the above subject project. A review and an "as-
built site inspection (& re-inspection) found them in general conformance to the approved
engineering plans. Also, I have attached the sign-off checklist sheet with the signatures
of various departments accepting this phase of the development.
I recommend this phase ofthe project be forwarded to the City Commission for
final acceptance.

RE: Parkstone Subdivision Unit 3 Final Acceptance
Dear Mr. David:
I have recently visited the compensating storage pond in the Pakstone Subdivision Unit 3 for
final acceptance and have observed numerous "boils" which have continuously changed in
number and size during the last two weeks. I have concerns on how this will affect future
maintenance most particularly along the southwest bank of the pond. I have also referred this
issue to the SJRWMD for their input as it relates to groundwater.
I understand that this is the last remaining issue for the Final Acceptance for Unit 3 and
apologize for the last minute notice. I am approving the Final Acceptance for Unit 3 as it
relates to engineering and I am recommending that this be addressed during the Final
Acceptance process of Unit 4,
I am anticipating that Unit 4 is nearing their Final Acceptance process, in order to avoid
delays for Unit 4, this issue should be addressed with the SJRWMD and the City as quickly as
possible.

Dear Mr. Smith:
This acknowledges receipt of certification that the subject water distribution system extension has been
completed in accordance with the plans and related materials pennitted by this agency on Permit Number
WD59-0 125712-0 15 dated July 6, 2000 and that the system has passed the pressure and bacteriological
tests that were conducted in accordance with the A VV'\V A Standards.
Based on this certification and satisfactory bacteriological results, we are clearing the system for service.
The responsibility for the microbiological quality of the water at the time it ultimately reaches the
consumer's meter remains entirely with the utility ancl/or the owner/operator of the system who should
ensure that this quality remains as represented by the bacteriological test results presented, This letter of
clearance does not preclude the need for obtaining acceptance by other entities as may be required.

Subject: Parkstone Development Inspection
An inspection of the above listed development occurred on 02/05/2002 as regards to fire
protection hydrant system. The hydrants tested were on Stone Harbour Road, Seneca
Meadows Road, and Chester Hills Road per the attached map.
1. The fire hydrants have been inspected, and meet City Code requirements. Inspection
results are attached,
No additional comments are offered at this time, and no additional inspections will be
required in this development section by the Fire Department.
