PURPOSE: To inform and seek the consent of the Commission to renew the School Resource Officers inter-agency agreement for Winter Springs High School, Indian Trails Middle School, Winter Springs and Highlands Elementary. CONSIDERATIONS: The City and Seminole County School Board have a yearly inter-agency agreement that provides for School Resource Officers at Winter Springs ~ High School and Indian Trails Middle Schoor. This agreement now includes the School Resource Officer shared between both Winter Springs and Highlands Elementary. This position was previously reimbursed to the City from each of the school's separately. This agreement is based on Seminole County School Boards fiscal year commencing July I, 2002 and expiring on June 30, 2003. Seminole County School Board agrees to compensate the City for all three School Resource Officers during the term of this agreement. The City will be compensated in the amount of $57,507.00 to begin October 1,2002 in equal payments of $ 7,188.37 through May 2003. August 12,2002 Consent Agenda A Page 2 of2 Federal and State law requires that this agreement must be authorized by the Commission of the City during one of its regularly scheduled ~ee.tings. FUNDING: None required. RECOMMENDA TION: Approve the renewal of School Resource Officer inter- agency agreement. IMPLEMENTATION SCHEDULE: Immediately upon approval by Commission. COMMISSION ACTION: SEMINOLE COUNTY PUBLIC SCHOOLS SCHOOL RESOURCE OFFICER AGREEMENT THIS AGREEMENT, is made and entered by a~d ?etween the SCHOOL BOARD OF SEMINOLE COUNTY, FLORlDA, whose address is 400 East Lake Mary Blvd., Sanford, Florida 32773, hereinafter referred to as "School Board" and the City of Winter Springs, Florida, a municipal corporation, hereinafter referred to as "The Agency". WITNESSETH: WHEREAS, the parties desire to implement the provisions of 230.2318, Florida Statutes, School Resources Officer Program, by entering into an inter-agency agreement; and, WHEREAS, the SCHOOL BOARD has requested that the Agency provide law enforcement personnel in certain Seminole County Public Schools for service as a School Resource Officer; and, WHEREAS, the Agency has agreed to provide law enforcement personnel to perform the duties and responsibilities of a School Resource Officer in certain Seminole County Public Schools; NOW, THEREFORE, in consideration of the mutual considerations, understandings and convenants set forth herein, the parties agree as follows: 1. TERM: The term of this Agreement is one fiscal year commencing July 1, 2002, and continuing until June 30, 2003, the date of signature by the parties notwithstanding. This agreement may be renewed for successive terms of like duration by mutual agreement of the parties and upon such terms as they shall agree. 2. PURPOSE: The purpose of this Agreement is to foster better relations between students and law enf<:>rcement personnel; to deter -crime on or about school premises by the presence of a law enforcement officer; to enforce local, state, and federal laws; and to have law enforcement officer available for presentations to the students, faculty, and parents concerning law enforcement and various law enforcement related subjects. 3. TERMINATION: This Agreement may be terminated by any.partY at any time, with or without cause, upon not less than thirty (30) days written notice delivered by Certified Mail, Return Receipt Requested, or in person to the other parties. 4. SERVICES: (a) The CITY agrees to provide the SCHOOL BOARD Three (3) full time School Resource Officer's whose duties are described in Exhibit A attached hereto. (b) The SCHOOL BOARD agrees to compensate the CITY for the services of the School Resource Officer, as set forth herein after, by paying to the CITY the agreed upon compensation. 5. COOPERATION: It is agreed that the CITY shall have all reasonable and necessary cooperation and assistance from the SCHOOL BOARD, its officers, agents, and employees so as to facilitate the performance of this Agreement. 6. LIABILITY FOR SALARIES: The SCHOOL BOARD shall not be liable .. for the payment of any salaries, wages, or other compensation to any School Resource Officer performing services pursuant to the Agreement. 7. LIABILITY FOR INJURY OR SICKNESS: The SCHOOL BOARD shall not be liable for the payment of any sums or indemnification to the CITY, or any of its employees, for injuries or sickness arising out of performance of duties of a School Resource Officer hereunder and the CITY hereby agrees to hold harmless the SCHOOL BOARD against such claims. For all purposes pursuant to this provision specifically and to this Agreement in general~ the School Resource Officer shall be deemed an employee solely of the CITY and shall at all times be deemed to be acting within the course and scope of his employment as a CITY of Winter Springs Police Officer. 8. INDEMNIFICATION: The CITY, its officers, agents, and employees shall not be deemed to assume any liability for the intentional or negligent acts or omissions of the SCHOOL BOARD or any of its officers, agents, or employees, and said SCHOOL BOARD agrees to hold harmless, indemnify, and defend the CITY COMMISSION, its officers, and employees from any and all claims for damages arising therefrom. The SCHOOL BOARD, its officers and employees shall not be deemed to assume any liability for the intentional or negligent acts or omissions of the CITY, or any of its officers, agents, or employees, and said' CITY agrees to hold harmless, indemnify, and defend the SCHOOL )30ARD, its officers and employees, from any and all claims for damages arising therefrom. 9. EMPLOYEE STATUS: It is understood and agreed by the parties that no School Resource Officer shall be deemed an employee of the SCHOOL BOARD. 10. COMPENSATION AND PAYMENT: (a) The SCHOOL BOARD hereby agrees to compensate the CITY for all services provided hereunder by the CITY the sum of Fifty-Seven Thousand Five Hundred Seven Dollars and 00/1 00 ($57,507.00) in accordance with the following schedule of payments: Initial payment: Amount $7,188.37 Date of Payment: Oct. 1, 2002 All subsequent payments shall be in equal amounts of $7, 188.37 and shall be payable on or before the 5th day of each month thereafter through May, 2003. 11. The Chief of Police, City of Winter Springs, IS hereby designated by the CITY as its employer charged with the responsibility to administer this contract. The Superintendent is hereby designated by the SCHOOL BOARD OF SEMINOLE COUNTY, FLORIDA, and charged with the responsibility to administer this contract. 12. ENTIRE AGREEMENT: (a) It is understood and agreed that the entire Agreement of the parties is contained herein and that this Agreement supersedes all oral agreements and negotiations between the parties relating to the subject matter hereof, as well as any previous agreements presently in effect between the parties, relating to the subject matter hereof. (b) Any alterations, amendments, deletions or waivers of the provisions of the Agreement shall be valid only when expressed in writing and duly signed by the parties. 13. NOTICES: Whenever any party desires to give notice unto the other notice may be sent to: FOR THE SCHOOL BOARD FOR THE CITY Dr. Paul J. SCHOOL RESOURCE OFFICER DUTIES AND RESPONSIBILITIES: In addition to the routine duties and responsibilities of the Winter Springs City Patrol Officer, the School Resource Officer will have the following specific duties and responsibilities: (a) The Officer will be under the supervision of and accountable directly to the Winter Springs Police Chief. (b) The Officer will be responsible for reporting for hislher tour of duty properly attired, and shall possess the necessary equipment to fulfill his/her daily assignments. (c) The School Resource Officer's primary responsibility shall be his/her assigned school (Indian Trails Middle School and Winter Springs High School.) (d) The Officer will have the responsibility of originating the proper event report on any incident of a police nature, and follow the existing procedures that apply to this investigation. (e) The Officer will be required to be familiar with the operation of audio- visual equipment necessary in the presentation of programs. (f) Upon arrival at the school, the Officer should report to the principal or staff member appointed by the principal. (g) The Officer will coordinate all activities at the school with the principal or his/her agent. (h) The Officer will be required to perform other police duties which are assigned by a supervis?r, such as, special investigations, special assignments, etc. Exhibit A
