REQUEST:
The Community Development Department requests the City Commission consider information
about the Avery Park Architectural Review Board (ARB).
PURPOSE:
The purpose of this agenda item is to advise the City Commission of the Avery Park ARB, in
response to questions from the City Commission.
CONSIDERATIONS:
The City Commission approved the final subdivision plat and Declaration of Protective
Covenants and Restrictions for the Avery Park Homeowners' Association, Inc., on February 11,
2002. Article VI of these protective covenants established and set forth criteria for an
Architectural Review Board (ARB). The ARB shall consist of 3 members, initially to be
appointed by the developer. After the first meeting of the members of the homeowners'
association board of directors shall appoint the members of the ARB, with the developer or his
designee appointed to the ARB for as long as the developer owns any lots within the subdivision.
No decision can be binding without at least a 2/3 affirmative approval by the ARB members.

The ARB has broad powers over exterior construction or modifications within the subdivision.
The following are examples of the ARB's authority:
"No building, fence, wall or other structure shall be commenced, erected or maintained
upon the Property, nor shall any exterior addition to or change or alteration therein be
made until the plans and specifications showing the nature, kind, shape, height, materials,
and location of the same shall have been submitted to and approved in writing as to
harmony of external design and location in relation to surrounding structures and
topography by the Architectural Review Board as hereinafter defined.
Section 3.
DUTIES. The ARB shall have the following duties and powers:
(a) to amend from time to time the Planning Criteria. Any amendments shall
be set forth in writing, shall be made known to all members and shall be recorded in the
Public Records of Seminole County, Florida. Any amendments shall include any and all
matters considered appropriate by the ARB not inconsistent with the provisions of this
Declaration;
(b) to approve all buildings, fences, walls or other structures, which shall be
commenced, erected or maintained upon the Property, and to approve any exterior
additions to or changes or alterations therein. For any of the above, the ARB shall be
furnished plans and specifications showing the nature, type, shape, height, materials, and
location of the same and shall approve in writing as to the harmony of the external design
and location in relation to surrounding structures and topography.
Section 9.
ARCHITECTURAL REVIEW BOARD PLANNING CRITERIA.
(c) Exterior ColorlMaterial Plan. The ARB shall have final approval of all
exterior color plan [sic] and each builder must submit to the ARB a color plan showing
the color of the roof, exterior walls, shutters, trim, etc."
