REQUEST: City Manager advising the Commission of a serious issue related to the Town
Center and requesting appropriate direction.
PURPOSE: This agenda item is needed to make the Commission aware of a serious issue
related to the Doran project and providing the Commission with an opportunity to provide any
direction it deems appropriate.
CONSIDERA TIONS:
In violation of previously approved lighting plans and permit requirements the lighting poles and
fixtures installed by Doran represent irreparable harm to the design of the Town Center and
cannot be tolerated.
Relatedly, I have advised Shane Doran in the attached letter that, CO's will be withheld until an
appropriate resolution can be found.
In direct contradiction to the approved plans and everything we have done to prevent the parking
lot from looking like a traditional strip mall parking field, the installation of high, modem poles
creates, in fact, the look of a typical strip mall parking field.
A resolution involving shorter ornamental poles must be found if we are to maintain a Town
Center design theme.
FUNDING: Unknown
RECOMMENDATION:
It is recommended that the Commission confirm the City Manager's decision to withhold the
CO's on the Doran project until such time a resolution to the lighting issues is resolved.

Dear Shane:
In all of our previous discussions you and your staff have represented that the lighting
fixtures in the Doran project would be compatible with the design of the city's lighting
poles and fixtures, and the theme of the Town Center. In fact, in one meeting Lee Colyer
stated to me that you would be adopting the same Washington style pole and acorn
lighting fixture chosen by the city for the Town Center which have a maximum height of
15 feet. Moreover, your landscape architectural plans submitted to and approved by the
Commission on October 22, 2001 along with your final engineering plans clearly
provided for HADCO R51 BCNA Acorn Style Lighting on 12 and 16 foot ornamental
poles.
None of the lighting installed is consistent with the approved plans.
On Tuesday evening, September 3, 2002, on my way out of town to attend a Wednesday
funeral in Fort Lauderdale, I visited the site and noticed that high 30-foot modem poles
and fixtures incompatible with the Town Center design theme, incompatible with poles
and fixtures being utilized by the city and the approved plans for the project, had been
erected. Wednesday I called your architect in Atlanta and advised him that this was not
in keeping with our agreement, that I was not aware of the city approving a revised
lighting plan, and that other arrangements would have to be made. Your architect
advised that he had to use these high poles and modem fixtures to meet Publix minimum
lighting levels.
On Thursday, September 4, 2002, when I returned to the city from Ft. Lauderdale I
checked with staff to detemline if the plans had been revised. In my review I determined
the following:
I. Revised lighting plans were received by the city on Thursday, August 29,
2002 from your Architect Randall Paulsen.
2. On September 5, 2002 the city received an application for a permit to install
the revised lighting plan.
In conclusion, your company has installed revised lighting poles and fixtures before
you provided the city with revised plans and before you applied for a permit for
installation. Secondly, the revised lighting plans you have submitted are
inconsistent with the design theme of the Town Center and the lighting plans
approved by the city on October 22, 2001.
Therefore, I am putting you on notice that you have not complied with the city
regulations and requirements in this matter and must cease and desist with any additional
installation of lighting poles and fixtures.
I want to point out that the intensity of the light required by Publix is not of concern to
the city. What the city anticipated was a plan that would be representative of street
lighting on Main Street, USA, with ornamental metal or concrete poles and acorn style
fixtures consistent with the plans approved on October 22, 2001. Instead, what you have
installed without appropriate plans and permits, and submitted in the form of revised
plans is representative of a strip mall parking field lighting plan. What is of particular
concern is the height of the lighting poles and the modem design of the poles and
fixtures. Furthermore, I am familiar with multiple ornamental fixtures including as many
as five fixtures on 20-foot ornamental poles that would provide intensive lighting of the
level required by Publix. I don't understand why you could not have chosen this type
fixture. Additionally, the shorter fiberglass poles while workable, are disappointing.
I have no alternative but to bring this matter before the Commission sitting as the DRC
Monday night recommending disapproval of the plan and that the CO's for Publix be
withheld until such time that this issue is resolved,

with him this past Friday. This plan introduces the high 35-foot poles but is
significantly different from the plan submitted on August 28,2002.
As shown below, the number of light poles was dramatically reduced from the
original plan adopted on October 22, 2001 to the recent plan submitted on
August 28, 2002 that has been built but not approved.

In response to your question regarding the parking lot lighting poles and fixtures for your
Town Center development in Winter Springs, please be advised of the following:
The typical high pole 5 foot candle light fixture will not be permissible in the Town
Center. There is a pending ordinance that will be adopted within the next thirty days
requiring parking lot lighting to have not more than .5 foot candle light bleed over into
areas adjacent to the parking area. This standard will have to be met in your client's
parking lot.
Additionally, the city has adopted a street lighting ~tandard for the Town Center and
intersections along State Road 434 that will be permissible in the parking lot. I have
attached two poles and fixtures that meet this standard.
Furthermore, we prefer the glass globes rather than the poly carbonate due to the fact that
the heat and sunlight in this area causes the poly carbonate to rapidly discolor, causing
numerous blends of color. I don't think your client would be happy with.this-either:'-' - --,- --.

Ref: Doran Project Lighting Plans and Inspection

On August 27, 2002 I was performing building inspections on the Doran Project in the
Town Center when I was approached by Doran Project Manager John Bates who
requested that'I inspect light pole footings while I was on site due to the possibility of
delays that might result from expected rainfall. I agreed to accommodate Mr. Bates as a
courtesy, but cautioned Mr. Bates that I didn't have an approved set of plans to inspect
with, and noted on the plans "POUR AT YOUR OWN RISK. NOT FINAL APPROVED
BY THE CITY 8/22/02 (Initialed) I then performed a footing inspection on nine (9) light
pole footings. NOTE: I mistakenly dated the note 8/22/02, when it was actually 8/27/02
when I did these inspections.
On 8/29/02 an unidentified permit runner submitted a copy of a revised site lighting plan
and clock tower to the City Permit Specialist indicating they were for Plans Examiner,
Davis Alamina., ,Pennitting Division Manager, .Max ,Epstein routed, the revised, copy of ,'....,
the Clock Tower Plans to Inspector Scheraldi and the revised Site lighting Plans to City
Manager, Ron McLemore.
On 8/30/02 I inspected six (6) more light pole footings as a courtesy.
On 9/4/02 I inspected 1 more light pole footing as a courtesy.
On 9/5/02 the City received a permit application for the construction of the Site Lighting
Plan submitted on August 29,2002.

Dear Shane:
In all of our previous discussions you and your staff have represented that the lighting
fixtures in the Doran project would be compatible with the design of the city's lighting
poles and fixtures, and the theme of the Town Center. In fact, in one meeting Lee Colyer
stated to me that you would be adopting the same Washington style pole and acorn
lighting fixture chosen by the city for the Town Center which have a maximum height of
15 feet. Moreover, your landscape architectural plans submitted to and approved by the
Commission on October 22, 2001 along with your final engineering plans clearly
provided for HADCD R5l BCNA Acorn Style Lighting on 12 and 16 foot ornamental
poles.
None of the lighting installed is consistent with the approved plans.
On Tuesday evening, September 3,2002, on my way out of town to attend a Wednesday
funeral in Fort Lauderdale, I visited the site and noticed that high 30-foot modem poles
and fixtures incompatible with, the Town Center design theme, incompatible with, poles
and fixtures being utilized by the city and the approved plans for the project, had been
erected. Wednesday I called your architect in Atlanta and advised him that this was not
in keeping with our agreement, that I was not aware of the city approving a revised
lighting plan, and that other arrangements would have to be made. Your architect
advised that he had to use these high poles and modem fixtures to meet Publix minimum
lighting levels.
On Thursday, September 4, 2002, when I returned to the city from Ft. Lauderdale I
checked with staff to determine if the plans had been revised. In my review I determined
the following:
I. Revised lighting plans were received by the city on Thursday, August 29,
2002 from your Architect Randall Paulsen.
2. On September 5, 2002 the city received an application for a permit to install
the revised lighting plan.
In conclusion, your company has installed revised lighting poles and fixtures before
you provided the city with revised plans and before you applied for a permit for
installation. Secondly, the revised lighting plans you have submitted are
inconsistent with the design theme of the Town Center and the lighting plans
approved by the city on October 22, 2001.
Therefore, I am putting you on notice that you have not complied with the city
regulations and requirements in this matter and must cease and desist with any additional
installation of lighting poles and fixtures.
I want to point out that the intensity of the light required by Publix is not of concern to
the city. What the city anticipated was a plan that would be representative of street
lighting on Main Street, USA, with ornamental metal or concrete poles and acorn style
fixtures consistent with the plans approved on October 22, 200 I. Instead, what you have
installed without appropriate plans and permits, and submitted in the form of revised
plans is representative of a strip mall parking field lighting plan. What is of particular
concern is the height of the lighting poles and the modern design of the poles and
fixtures. Furthermore, I am familiar with multiple ornamental fixtures including as many
as five fixtures on 20-foot ornamental poles that would provide intensive lighting of the
level required by Publix. I don't understand why you could not have chosen this type
fixture. Additionally, the shorter fiberglass poles while workable, are disappointing.
I have no alternative but to bring this matter before the Commission sitting as the DRC
Monday night recommending disapproval of the plan and that the CO's for Publix be
withheld until such time that this issue is resolved.

In response to your comments regarding a set of plans submitted in November 200 I. Several
members of my staff and I worked Saturday in an attempt to locate copies of any plans
constituting a revision to the lighting plans approved on October 22, 200 I by the City
Commission.
We have been unable to find any plans, or other forms of documents giving evidence of staff
or Commission action on a revised set of lighting plans other than those submitted to the City
on August 29,2002, which have not been approved.
Furthermore, it is difficult to understand how a set of plans printed on June la, 2002, sealed
on August 8, 2002, and submitted for approval on August 29, 2002 could have been approved
sometime in November 200 I.
I need your help. If you or your representatives have any documentation of staff action on
any revised set of lighting plans please provide them to me as early as possible on Monday,
September 9, 2002.
In regards to your comments regarding the withholding of CO's, please be assured that no
one here desires to take this action. However, we must get quickly to an acceptable
resolution of this problem. Withholding of a CO would be the very last course of action that
the City would take in this matter and only if all other alternatives failed to produce an
acceptable resolution to the problem.

Doran Development Lighting Issues
This date the building department acquired a revised lighting plan that was
not approved by the City from Doran's Construction Manager dated
November 30, 01. This is apparently the plan he referred to when I spoke
with him this past Friday. This plan introduces the high 35-foot poles but is
significantly different from the plan submitted on August 28, 2002.
As shown below, the number of light poles was dramatically reduced from the
original plan adopted on October 22, 2001 to the recent plan submitted on
August 28, 2002 that has been built but not approved.

Although the reduction of poles mayor may not have saved the developer a
