REQUEST: The City Attorney requests that the City Commission provide direction regarding the
use of a portion of Tract 15, Parcell-C ofthe Tuscawilla PUD (behind the former Kash & Karry)
as a V eterinarian Office/Animal Hospital.
PURPOSE:
The purpose of this Ordinance is to provide direction as to whether a V eterinarian Office/Animal
Hospital is an authorized land use on a portion of Tract 15, Parcell-C of the Tuscawilla PUD.
APPLICABLE LAW AND PUBLIC POLICY:
1. Florida Municipal Home Rule Powers Act.
2. City of Winter Springs Comprehensive Plan
3. Binding Settlement Agreement, dated September of 1990 (O.R.B. 2277, Page 0464), covering
Tract 15, Parcell-C and other Parcels of the Tuscawilla PUD. ("Settlement Agreement")
4. Binding Development Agreement, dated December of1999 (O.R.B. 3574, Page 0529), regarding
the subject property. (''Development Agreement")

CONSIDERATIONS:
1. The subject property is located behind the former Kash & Karry site along Vistawilla Drive.
2. The subj ect property is designated "commercial" on the City's Comprehensive Plan, Future
Land Use Map. The subject property is zoned "PUD."
3. The permitted land uses for the subject property are controlled by a Settlement Agreement,
dated September of 1990, and a Development Agreement, dated December of 1999.
4. Although the Settlement Agreement has an extensive list of potential "commercial uses" for
properties designated "commercial" under the Settlement Agreement, the subsequently
recorded Development Agreement specifically states that the land uses for the subject
property shall be restricted to "office use only."
5. Notwithstanding, the issue of which land uses are permitted on the subject property is
clouded by the fact that the 4th recital "whereas clause" of the Development Agreement states
that to the extent of any conflict between the Settlement Agreement and the Development
Agreement, the Settlement Agreement shall prevail and control. Further, it is not clear by
examining the Settlement Agreement whether the subject property is designated
"commercial" on the map attached to the Settlement Agreement.
6. For information purposes only, "Animal hospitals and veterinary clinics (with no outside
kennels)" is a permitted use in the C-l Neighborhood Commercial zoning district.
"Veterinarian and accessory kennels" is a permitted use in the C-2 General Commercial
zoning district.
7. Dr. Paul Williams, owner of the Veterinarian Office! Animal Hospital currently located in the
former Kash & Karry shopping center, has entered into a contract to purchase the subject
property. Dr. Williams has indicated that he desires to build an office building on the subject
property. The office building may consist of two offices. If constructed, Dr. Williams
intends to move his V eterinarian Office/Animal Hospital to the subject property and occupy
the office on the northern most portion of the subject property. Dr. Williams current
Veterinarian Office/Animal Hospital is located approximately 50 yards to the north of the
subject property on Vistawilla Drive.
8. Dr. Williams has also indicated that he does not board animals beyond that required to
medically treat the animals under his care. No animal boarding will occur on the subject
property if purchased by Dr. Williams.

The City Attorney recommends that the City Commission take anyone of the following three
potential actions:
1. Make a finding that the V eterinarian Office/Animal Hospital constitutes an "office" as
contemplated in the Development Agreement. Therefore, the Veterinarian Office/Animal
Hospital is an allowable use on the subject property; OR
2. Make a finding that the V eterinarian Office/Animal Hospital does NOT constitute an
"office" as contemplated in the Development Agreement. However, take one of the
following positions authorizing said use:
a. Direct the City Attorney to prepare an amendment to the Development Agreement
permitting a Veterinarian Office/Animal Hospital on the subject property; or
b. Make a finding that the list of "commercial uses" set forth in the Settlement Agreement
prevails over the "office use" limitation in the Development Agreement. Therefore, a
Veterinarian Officel Animal Hospital is a permitted commercial use on the subj ect property;
OR
3. Make a finding that a Veterinarian Office/Animal Hospital is not a permitted use on the
subject property under the Settlement Agreement as amended by the Development
Agreement.

3. The acreages described within eacb Parcel are '

foregoing, WSOJV shall have the right to request minor 'revisions
to such allocations and redistribute units within such parcels to
accommodate sound land planning techniques, provided the ~verall
units and commercial acrea~es on a gross basis ,do not exceed
those set forth above, subJect to the applicable provisions of
the City Codes.

of this Agree~entl provided, however, no boundary of any such
parcel shall be expanded by more than one hundred (100)
additional feet. The parties agree that Exhibits .C" and "0"
shall co~lectivelY constitute the certified map and plan of the
Remaining property in the Tuscawilla POD. AecesS points and
roadways show the number and approximate location of 'such
matters, which location will.be finally determined at the,time of
site plan approval and/or plat approval of the respective .
property such minor adjustments and revisions shall be permitted,
provided such changeS shall not result in an increase in the
co~ercial acreage or units on such parcel, except as otherwise
permitted be~ein or by City Codes.
8. WsoJV agrees to dedicate a one and one-half (1.5) usable
acre site for a fire station located adjacent to State Road 4~4
in the residential section of parcellS, at the location depicted
on Exhibit "C".
9. wsoJV shall be entitled to transportation impact fee and
other impact fee credits for the dedication, planning,
development and construction of Tuscora Drive and vistawilla
Drive, which road are deterWined to be collector roads and other
public dedications in a~ amount equal to.the impact fee credits
permitted under the ~ransportation Impact Fee Ordinance or, other
applicable ordinances adopted or to be adopted by the City, for
right-of-way, planning, design, development and 'construction of
such roadways.
