REQUEST: The Public Works Department requests the City Commission validate the staff
recommendation finding Barclay Reserve (Barclay Woods) built in substantial
accordance with the Final Engineering plans and to accept the potable water and
sanitary sewer infrastructure for ownership and maintenance.
PURPOSE: The purpose of this Agenda Item is to request the City Commission validate the staff
recommendation finding Barclay Reserve (Barclay Woods) to be built in substantial
accordance with the Final Engineering per Section 9-178 and to accept the potable water
and sanitary sewer infrastructure for ownership and maintenance in order for Certificates of
Occupancy to be issued. This site is located on the north side of S.R. 434, west of the
existing Barrington Estates subdivision.
APPLICABLE CODE:
Section 9-178. Required Improvements to be completed prior to building on lots; exceptions.
( c) Where the building official has an authoritative method of assurance that the improvements will
be completed in accordance with approved plans, such as withholding occupancy, the building
official may issue building permits upon advising the developer that all or partial occupancy will be
restricted until satisfactory completion of the improvements has be accomplished.
(d) ... Certificates of occupancy will not be issued until all improvements are accepted by the city
comnnSSIOn.
FINDINGS:
1) All City agencies have found the work to be acceptable.
2) The conditions of the Developer Agreement have been met.

3) The potable water and sanitary sewer improvements are to be dedicated to the City for
ownership and maintenance and separate 2-year maintenance bond.
4) The project will be subject to the reimbursement provisions for water and sewer lines contained
in Consent 201 if it is approved.
RECOMMENDATION:
Staff recommends that the City Commission validate the staff recommendation finding
Barclay Reserve (Barclay Woods) built in substantial accordance with the Final Engineering per
Section 9-178, and accept the potable water and sanitary sewer infrastructure for ownership and
maintenance, subject to the following conditions:
1) The exterior side of the retaining wall along the western and northern sides of the
property shall have a painted finish matching the exterior of the buildings. The painted
finish shall be approved by the City and shall be in place prior to the issuance of a
certificate of occupancy for the applicable buildings along the retaining wall.
2) Handrails shall be installed along the entire retaining wall in accordance with the
approved building permit prior to the issuance of a certificate of occupancy for any
buildings along the retaining wall. The temporary chain-link fencing in the common areas
at the retaining walls between buildings 3-4 and 4-5 shall be maintained until the
permanent handrail is in place.
3) Project will be subject to the water and sewer reimbursement provisions of the
Development Agreement Addendum with the developer of Barrington Estates.
IMPLEMENTATION:
Certificate of Occupancies for those units eligible can be issued after Commission
approval.
