I. CALL TO ORDER
The Special Meeting of Monday, October 7, 2002 of the City Commission was called to
order by Deputy Mayor Cindy Gennell at 6:36 p.m. in the Commission Chambers of the
Municipal Building (City Hall, 1126 East State Road 434, Winter Springs, Florida
32708).

A. Public Works Department
Requests That The City Commission Review And Approve Proposed Improvements
For Fisher Road.
Mr. Kipton D. Lockcuff, P.E., Public WorkslUtility Department Director introduced this
Agenda Item and the Consultants familiar with the proposed project.
Mr. Ian Lockwood, Civil Engineer, Glatting Jackson, 33 East Pine Street, Orlando,
Florida: addressed those in attendance and reviewed some of the key points planned for
this project.

Commissioner Robert S. Miller spoke of the type of curbing planned and stated that "Part
of the impact of people deciding to exceed the speed limit down that roadway, and if they
have a large vehicle and they fail to negotiate the roundabout correctly, then they just ride
right over it, and an additional incentive to me would be to have a curb which would be -
five inches (5") - whatever the standard curb is." With further discussion, Commissioner
Miller suggested, "I am just asking you to consider a curb - a vertical curb." Mr.
Lockwood then said, "We can make these a little more aggressive if you would like - I
think this would be adequate," Furthermore, Mr. Lockwood stated, "I think the point is
well taken, we will discuss that - to make it more forgiving."
Deputy Mayor Gennell opened the "Public Input" portion of this Agenda Item,
Mr. Richard Bercini, 124 Seville Chase Drive, Winter Springs, Florida: showed
photographs and asked about the affect of lots of rain; percability; and drainage.
Discussion.
Mr. Eugene F. Stone-Romero, 2002 Alegre Court, Winter Springs, Florida: spoke in
favor of the paving and voiced his concern with speeding vehicles on Bird Road and a
bus stop at the intersection of Seville Chase Drive and Morton Lane; and Bird Road and
Fisher Road; and asked if Traffic Calming measures could be considered for Bird Road.
Mr. Lockwood then suggested, "You may be wise to do a couple of speed studies and
traffic volume counts and just for your own research, before and after - in case you do
other roads like this out there, you will know if you want to decrease the space here,
increase the space there or whatever." Deputy Mayor Gennell said, "I am sure that we
have probably already got all those don't we Kip [Lockcuff]?" Mr. Lockcuff stated, "I
don't know that we do or not. I am not sure those measures would be valid anyhow."

Commissioner Michael S. Blake inquired, "What do we need to do as far as moving
forward on this?" City Manager Ronald W. McLemore responded, "Accept the concept."
Commissioner Blake then asked, "So we are going to have final drawings coming back to
us?" Manager McLemore then said, "If you accept this concept, we will move forward
with the design - engineering." Mr. Lockcuff added, "I hadn't planned to bring final
back, but if you want to see them, that would be fine."
Ms. Jan Seldin, 207 Alegre Court, Winter Springs, Florida: stated "On behalf of the
Homeowner's Asso,ciation - if we could obtain a hard copy of the draft plan of the paved
road, and in particular, the plan and profile sheets and the cross sections of the road?"
Mr. Lockcuff said, "We could have CPR [Engineers, Inc.] provide those - we will get
them to you."

Manager McLemore spoke for record about the engineering community and Traffic
Calming measures.
Mr. Michael Myers, 540 Fisher Road, Winter Springs, Florida: noted that his driveway
is in the middle of the planned Traffic Calming measures; and inquired about the
proposed landscaping; traffic enforcement; and lighting.
With discussion, Mr. Lockwood spoke of the Traffic Calming measures and stated, "It's
not mandatory at all." Further, Mr. Lockwood said, "It can be removed if you would like
it removed. It is not necessary as part of the plan - we can simply pull that further south
with no difficulty whatsoever."
Mr. Myers added, "If whoever is making notes, would note that I would like to have that
moved over one way or the other."
Discussion ensued on potential traffic enforcement procedures.
Deputy Mayor Gennell said to Mr. Lockcuff, "You have Mr. Myers' address and
telephone number I am sure - take note of his comments please."
Commissioner Edward Martinez, Ir. stated, "We have to wait and see how the folks out
there handle the new road and if there are complaints and if they feel they need some
striping, then all they have to do is call the City Manager or call Kip [Lockcuff] and
speak to them and they can bring it up before the Commission."
The "Public Input" portion of this Agenda Item was closed.
Deputy Mayor Gennell stated, "I am looking for a Motion to approve the proposed
improvements for Fisher Road."
"SO MOVED." MOTION BY COMMISSIONER MARTINEZ. SECONDED BY
COMMISSIONER MILLER. COMMISSIONER MARTINEZ THEN SAID, "I
WOULD LIKE TO ADD THAT IAN [LOCKWOOD] AND CPH [ENGINEERS,
INC.] CONSIDER SOME OF THE REQUESTS BY SOME OF THE CITIZENS
HERE WHEN THEY BRING THIS BACK FOR FINAL ENGINEERING THAT
THEY EITHER BE INCORPORATED, AND IF THEY ARE NOT - THE
REASON WHY THEY ARE NOT." DISCUSSION.
DEPUTY MAYOR GENNELL SUMMARIZED, "SO THE MOTION IS TO
APPROVE THE~PROPOSED IMPROVEMENTS GIVING CONSIDERATION
TO THE COMMENTS HERE TONIGHT."

Deputy Mayor Gennell said, "The improvements are approved and in sixty (60) days you
will have the plans back, right?" Mr. Lockcuff said, "Yes." Deputy Mayor Gennell
added, "And they can expect to get a copy and so on, so forth."

Requests The City Commission Consider Setting A Workshop On October 14th For
The Review Of The Draft Cost Allocation Plan Prepared By Government Services
Group.
Manager McLemore addressed this Agenda Item. Brief discussion followed whether this
should be done as a Workshop, or at a Regular Meeting. With discussion, Commissioner
Martinez stated, "I am not ready to do anything after the Agenda." Deputy Mayor
Gennell suggested, "Put it on the Agenda," Commissioner Blake stated, ""Sounds like a
- paper to me." Deputy Mayor Gennell summarized, "So I am hearing that it goes on the
Agenda. "

G. Commission Seat One - Robert S. Miller
Commissioner Miller read a document into the record. Discussion.
Secondly, Commissioner Miller spoke of Moss Park and stated, "I would like to have the
City Manager bring back some kind of a recommendation on how we can have a fence
around that park in the coming fiscal year." Deputy Mayor Gennell said, "Is the
Commission in agreement to ask the City Manager to bring forward some suggestions to
relieve that situation with some kind of fencing."

Commissioner Blake stated, "We had discussions on the records, no fewer than three (3)
di fferent times on the question of a barrier between the parks - that park in particular and
the property surrounding it and I would recommend that Staff go back to the record and
bring that to us. We have already made a decision on this more than once."
Commissioner Miller stated, "Fine." Commissioner Martinez said, "The only way that I
would agree to look at this any further - it has already been looked at, is ifthere is money
available to possibly handle that because I understand the budget is tight." Commissioner
Martinez added, "I don't think we should spend money on a fence - when there are
greater needs in our community, than a fence at the present time. Maybe down the road,
if there is money, I wouldn't have any objection." Deputy Mayor Gennell stated, "I
would agree with Commissioner Blake - have the Staff bring us back the results of what
the discussion was when we last dealt with it and see if we have reached the point that we
were supposed to reach or if we have some left to do - then we can look at it again."
Commissioner Miller then said to Manager McLemore, "Dumpsters, around the Fire
Station, Public Works and the dumpsters around the fourplexes - we have put an
Ordinance into effect which is not going to require anything be done in that area - until
twenty-four (24) months from now. Has there been any contact at all with the people that
own those properties - to ask them to try to do something - and if there hasn't, I think
you need to." Commissioner Miller added, "I would like to get something back from you
that at least we have tried. It continues to be an eyesore."
Regarding this issue, Manager McLemore commented briefly on some discussions that
have taken place. Commissioner Miller added, "Along Dolphin Road, going between
Hayes [Road] and Moss [Road] - there is a Homeowner's Association in there on the left
hand side of the road. They have one location in the center of that complex. Everybody
hauls their stuff to that one location, it is fenced. If we had one fenced-in area, then the
people would have to take their refuse to that one area rather than have individual
dumpsters - because there are three (3) of them on the street where Richard's Barber
Shop is, in a line. Anyway, something needs to be done. I do not want to wait two (2)
years."
Parking on George Street was discussed next. Commissioner Miller stated, that regarding
"Putting in some parking across from those houses so they didn't have to park on their
sidewalks - I haven't heard a thing here." Manager McLemore pointed out, "All the
Commission needs to do is approve our recommendation." Commissioner Miller then
said, "Would you bring it back?" Manager McLemore spoke of some current discussions
with Ian Lockwood [Civil Engineer with Glatting Jackson] and stated, "Ian [Lockwood]
is absolutely emphatic about his position on this as the right answer, and so we are
packaging it up to b'ring back to you at the next Meeting or so."
Commissioner Miller then commented about the Village Walk project and asked, "Could
we get an Informational Item on this that everything is still on track, and maybe even
something in the Newsletter." Manager McLemore added, "I need to give you an update
on that."

Lastly, Commissioner Miller stated, "Whoever is doing our median and entranceway
lawn service, they need to start picking up the trash before they run the mowers down the
road." Commissioner Miller further stated, "If it is not in their contract - perhaps you
ought to put it in there."
Commissioner Blake spoke of power easements and inquired, "Do we have the right or
the ability to require that any additional lines that are added through the City, must be
underground?" Manager McLemore said, "I know we do in subdivision type
developments, now whether or not we can control those, I would have to look and see,"
Commissioner Blake added, "Could we do that." Further Commissioner Blake said, "I
think it would be something we should look into."
Commissioner Martinez thanked Manager McLemore and Mr. Lockcuff for "The
excellent job that they did on Greenbriar Lane. They excelled. They did more than I
thought they would do and I brought some pictures of the conditions of that half mile
stretch, before it was repaired." The photographs were then placed into the record,
Commissioner Martinez then spoke of not having been able to make his appointment to
the Tree (Arbor) Ordinance Review Advisory Committee.
Discussion.

Commissioner Blake stated, "Whatever the rules, 1 think Commissioner Martinez ought
to have an Appointment on that." Deputy Mayor Gennell stated, "I agree."
MOTION TO "AMEND - THE RESOLUTION TO BE EIGHT (8). ONE (1) FOR
EACH COMMISSIONER, ONE (1) FOR THE MAYOR, TWO (2) FOR THE
CITY MANAGER." MOTION BY COMMISSIONER MILLER. SECONDED BY
COMMISSIONER BLAKE. COMMISSIONER MILLER ADDED,
[RESOLUTION] "2002-24." DISCUSSION.
DEPUTY MAYOR GENNELL SUMMARIZED, "TO THAT RESOLUTION - TO
INCREASE THE MEMBERSHIP ON THAT COMMITTEE FROM SEVEN (7)
TO EIGHT (8)."

Commissioner Martinez spoke of Colt Drive, located near the 7-11 and stated "I believe
it is high time that we took some action and corrected the condition there somehow,"
Manager McLemore stated, "Our intent was to use our one cent sales tax to re-build Colt
[Drive]. Why don't you just direct me to start the engineering." Commissioner Blake
inquired, "Isn't Colt [Drive] a private road? You better find out." Commissioner
Martinez added, "Why don't you find out and bring it back as an Agenda Item."
IV. ADJOURNMENT
Deputy Mayor Gennell asked, "Is there a Motion to adjourn?"
"SO MOYED." MOTION BY COMMISSIONER MILLER. SECONDED BY
COMMISSIONER MARTINEZ. DISCUSSION.
