REQUEST:
The City Clerk requests that Commissioner David W. McLeod make one (1)
Appointment to replace a Board of Trustees (Pension Plan) Member who has been
removed as a result of exceeding the permitted number of absences, in accordance
with the Code of Ordinances.
PURPOSE:
A vacancy currently exists on the Board of Trustees (pension Plan) as a result of a
Board Member who recently was removed due to exceeding the permitted number
of absences. This vacancy needs to be filled.
CONSIDERATIONS:
A Memorandum dated October 11, 2002 was submitted to the City Commission
with information pertaining to one (1) Advisory Board Member that was being
removed for excessive absences.
The following Appointment needs to be made:

Appointment:
Commissioner David W. McLeod is requested to make an Appointment to the
Board of Trustees to replace Mr. Mark Sardo who is no longer serving on the
Board of Trustees.
If this Appointment is not made at this Meeting, this matter will be placed on
subsequent Agendas, until the vacancy has been filled, or as otherwise suggested
by Commissioner David W. McLeod.
FUNDING:
None.
RECOMMENDATIONS:
Commissioner David W. McLeod is requested to make an Appointment to the
Board of Trustees to replace Mr. Mark Sardo.

funds for the contribution of the city, and the city

ARTICLE III. PENSION PLAN
Sec. 14-51. Adopted. .
. (a) The city does hereby elect to provide for its
employees a. money P\lrcha~e pension pl~ii and
. trust, such plan!illd trust.. to be known. as the
"Pension PI~ fQr the Employees of the City of
Winter Springs, Florida", (hereafter referred to.as
"the plan"). The. plansh1l11 .be administered by a
board of trustees as appointed' in section 14~52'.
(b) The city does hereby approve and adopt the
plan, a copy of which is on fiie in the City clerk's
office and authorizes the mayor and dty manager
to execute the plan on behalf of the city. The plan
may be amended from time to .tiII1-e by res.olution'
of the city conlnrission.' . .
(c) The cost of the plan shall be paid entirely
by the city from the general fund.
(d) The city shall be bound by the terms and
conditions of the. plan.

Sec. 14-52. Board of trustees.
(a) There is hereby created and established a
board of trustees consisting of.five (5) members
who shall be appointed for a term of three (3)

years by resolution of the city commission: Each
commissioner shall have OIie(1) appointment to
the board. The successors of the original appoin~
tees shall be appointed for terms ofthree (3) years
by resolution of the city commission. Vacancies in
the board shall be filied by the City commission for
the unexpired term of such. vacancy.
(b) The board of trustees shall meet no less
than quarterly toteview the performance of the
pension plan and conduct such' other business as
the board deems appropriate and necessary.
(c) Any member of the board of trustees may
beremqved at a.IW time duririghis term upon a
. majority voteofthe city commission. Any member
of the board of trustees who IS absent from more
than two (2) consecutive meetings shall auto:rD:at-
iCally forfeit his position on the board.
(d) The board of trustees shall adniinister the
city's . pension plans pursuant to theP!bvisions
containedtherein.as .adopted by the Cityc?mmis-
sion. ,
