REQUEST: Public Works Department requesting Commission direction on modifications to the
approved site plan for the First Baptist Church.
PURPOSE: The purpose of this Agenda Item is to request that the Commission provide direction to
staff on the deletion of curbing and sidewalk from the first phase of the First Baptist
Church project.
APPLICABLE CODE:
Section 20-467. Off-street parking and driveway requirements
(a) Paved driveway and parking spaces.• All driveways and parking spaces shall be paved
with asphaltic concrete and/or concrete and shall be curbed.
Section 20-468. Landscaping
(23) A walkway with a minimum width of five (5) feet, shall be constructed to
connect the main public entrance door of a building to the public walkway along
rights of way....
Section 20-474. Development Agreement
Any developer may propose to enter into a development agreement with the city
designed to set forth terms and conditions appropriate to meet the circumstances of the
specific proposed development. Such development agreement shall be reviewed and
approved by the city commission. The city commission may vary the standards of this
division, including building or perimeter setbacks, parking standards, signage, and other
standards. ... Such consideration shall be based on building site constraints or physical
characteristics of the property; provided specifically, however, that any such concession
for a constrained site shall only be considered by the city commission in a development
agreement if enhanced perimeter landscaping or buffering is provided to assure that the
objectives of this article are achieved.

FINDINGS:
May 3, 2001 -the Board of Adjustment heard the First Baptist Church's petition for a
variance to the requirement for paved parking and curbing. The consultant for staff
erroneously referenced Sec. 9-278 General Provisions of off-street parking instead of the
New Development Standards for the 434 Corridor in Sec. 20-467(a). The agenda item only
referenced the request for grassed parking and the deletion of the curbing in the grassed
parking. The BOA approved the request. The petitioners intent was for all curbing to be
deleted on the site. The variance request was not forwarded to the City Commission for final
action.
2. May 14, 2001 -The City Commission approved the final engineering for the First Baptist
Church. The site plan included details for curbing and sidewalks.
October 29, 2001 -The City Manager notifies the church that the Commission approves the
request to delay the landscaping one year.
4. During the as-built inspection process the absence of curbing and sidewalks was noted.
CONSIDERATIONS:
Staff has no objection to deleting the parking lot curbing. The installation of the sidewalks to
meet the code could be established for completion at a time certain in a developer agreement. Section
20-474 provides for the use of a developer agreement to address deviations from the code. That would
make the variance request process through the BOA a moot point.
RECOMMENDATION:
Staff recommends that the City Commission direct the City Manager to create a developer
agreement with the First Baptist Church of Winter Springs incorporating the deletion of the
curbing, deferral of the sidewalk installation, and incorporating the extension for the landscape
installation.
