REQUEST: Community Development Department requests that the Commission consider and
provide direction concerning the location of an Assisted Living Facility proposed
at 208 Almaden Court.
PURPOSE: The purpose of this agenda item is to request direction from the City Commission
regarding the establishment of an assisted living facility (ALF) for no more than
six (6) adult residents. The proposed location for this ALF is an existing home at
208 Almaden Court. This property is located in the Mt. Greenwood Planned Unit
Development (PUD). The City's Code of Ordinances does not provide for the
location of an ALF in a PUD.
APPLICABLE REGULATIONS:
City Comprehensive Plan - Housing Element - Objective 1.4 and Policies
1.4.1 and 1.4.5.
Objective 1.4: Special Nnds Hous~holds.The City shall enSU.Ie thatadequ.ate sites are
ayailab1e fO! special needs populations, such as the elderly and disabled.
Policy 1.4.1:
The City shall include in the land development regulations adequate
standards for the location of community residential homes and special
needs housing, including group homes, in accordance with applicable
law. Such standards shall ensuce compatibility and consistency uith
surrounding land nses.
Policy 1.4.2:
The City shall utilize the development review process to review any
proposed projects or City Code amendments that impact housing for
special need populations.

Policy 1.4.3:
The City shan continue to support organizations that assist eldedyand
handicapped citizens in fmding decent, accessible, and affordable
housing. Such supportIrulY include teclu1i.cal assistance and alternative
design standards and code reqt1i.t:ements.
Policy 1.4.4:
The City shall continue to ensure compliance \vith Federal and State la\vs
on accessibility.
Policy 1.4.5:
In an effort to ad<kess problems of housing for lower income elderly
residents and other households with special housing needs, the city shall
allow for the placement of retirement communities and elderly care
facilities in area.s of residential character as long as they are designed in a
manner that is compatible with the character of the neighborhood.
Chapter 419, Section 419.001, Florida Statutes.
(2) Homes of six or fewer residents which otherwise meet the definition of
a community residential home shall be deemed a single-family unit and a noncommercial,
residential use for the purpose of local laws and ordinances. Homes of six or fewer
residents which otherwise meet the definition of a community residential home shall be
allowed in single-family or multifamily zoning without approval by the local government,
provided that such homes shall not be located within a radius of 1,000 feet of another
existing such home with six or fewer residents. Such homes with six or fewer residents
shall not be required to comply with the notification provisions of this section; provided,
however, that the sponsoring agency or the department notifies the local government at
the time of home occupancy that the home is licensed by the department.
Chapter 400, Sections 400.401 through 400.454, Florida Statutes.
CONSIDERATIONS: The applicant has requested the City to complete an ALF Local Zoning
Form as part of her application to the Florida Agency for Health Care Administration for an
Assisted Living Facility. This form is a prerequisite for her formal application to the State.
Certain other group homes that are licensed by the Department of Children and Family Services
(DCF) are recognized as single family unit and a noncommercial residential use for the purpose
oflocallaws and ordinances. The same preemption over local laws with regard to ALF's is not
established in State Law. The ALF sought by this applicant falls into the latter category and is
not exempt from local law.
FINDINGS:
1) The requested use is not enumerated as a permitted use by the City's Code of Ordinances.

2. The City's Comprehensive Plan states that the City shall ensure that adequate sites are
available for special needs populations, such as the elderly and disabled. While the City's Code
does provide for congregate living facilities, the specific use of an ALF is not referenced as a
permitted use in PUD's.
RECOMMENDATION:
Staff recommends that the City Commission review the request and provide
direction as to whether the proposed use is permitted within the residential area of
a Planned Unit Development.
