REQUEST:
The Community Development Department requests the City Commission conduct a public hearing
for the second reading of Ordinance 2001- 58, which would change the zoning map designation of a
49.55-acre parcel from "Planned Unit Development (Seminole County) to "Planned Unit
Development" (Winter Springs).
The subject property is located on Dovera Drive, north of Red Bug Lake Road, within the Oviedo
Marketplace Development of Regional Impact (DR!).
PURPOSE:
The purpose of this Agenda Item is to request the Commission hold a public hearing for second
reading of Ordinance 2001-58 to assign a City zoning map designation of "Planned Unit
Development" to Parcel 14 of the Oviedo Marketplace DR!.
APPLICABLE LAW AND PUBLIC POLICY:
Section 20-102(e) of the City of Winter Springs Code of Ordinances states, "The city planner,
or... .such other individuals as may be designated to perform such duties by the City Commission,
shall maintain the official as well as the working zoning maps...."
Section 20-104 of the City's Code of Ordinances states, "The City Commission may from time to

time amend, supplement, change or repeal the regulations, restrictions or district boundaries and
designations as set out in this ordinance after a public hearing(s)...."
Section 20-355 outlines the procedure for approval of a "Planned Unit Development" and Section
20-356 describes the minimum identified exhibits and supporting materials that must be contained
on the accompanying Preliminary Development Plan.
CONSIDERATIONS:
1. The property was in the unincorporated portion of the County until it was annexed in 1995.
2. The property was never assigned a City zoning designation, as required by Chapter 20, Article III
of the City's Code of Ordinances.
3. This request was submitted concurrent with a request to change the future land use map (FLUM)
designation for the same property.
FINDINGS:
1. Article IV, Section 20-356 of the City's Code of Ordinances describes the requirements for PUD
zoning, based on a preliminary development plan. The preliminary development plan, as
submitted, meets the criteria defined by that chapter by demonstrating the following:
A. Shows the name, location, legal description, acreage and type of planned unit development;
B. Identifies the present owners of the land; a developer has yet to be determined;
C. Identifies all consultants involved in the preparation of the preliminary development plan;
D. Shows a vicinity map indicating the relationship between the planned unit development and
the surrounding area;
E. Shows existing topography and other natural features;
F. Shows a soil survey indicating the location and description of soil types;
G. Describes existing vegetation and which natural areas will be preserved, altered or
eliminated;
H. Shows a proposed land use plan; however, priority and phasing of development has yet to be
demonstrated; and
I. Shows proposed method of providing utilities and infrastructure;

2. On October 3, 2001, the Planning and Zoning Board recommended approval of the rezoning
request, subject to the conditions recommended by staff.
3, On November 12, 2001, the City Commission adopted Ordinance 2001-45, which would change
the future land use designation of the property from "Planned Development" and "Conservation
Overlay" (Seminole County) to "Mixed Use" (Winter Springs), should DCA find the large-scale
FLUM amendment in compliance
4. On November 12,2001, the City Commission approved the accompanying DR! development
order.
5. On November 19, 2001, the City transmitted the large-scale FLUM package to DCA for
compliance review; the proposed zoning is consistent with the proposed future land use
designation.
6. On December 10,2001, the City Commission approved the first reading of Ordinance 2001-58.
FISCAL IMPACT:
None.
IMPLEMENTATION SCHEDULE:
This rezoning request is being filed concurrently with a future land use map amendment for the
subject property. The City Commission conducted a public hearing to adopt the proposed future land
use amendment on November 12, 2001, and the adopted plan amendment was subsequently
transmitted to DCA for compliance review. Following this review, a Notice of Intent to find the
amendment in compliance or not in compliance will be issued within 45 calendar days by DCA.
Assuming there are no petitions to challenge the determination of compliance/non compliance within
21 calendar days after the date of publication, the Notice of Intent will become final agency action.
However, the City Commission can conduct a public hearing for the second reading of Ordinance
2001-58 prior to final agency action, which would approve the preliminary development plan and
assign a City zoning designation of "Planned Unit Development" to the subject property. The
adoption of Ordinance 2001-58 would then be contingent upon the approval of the future land use
amendment by DCA.
STAFF RECOMMENDATION:
Staff recommends that the City Commission approve second reading of Ordinance 2001-58 and
adopt the City zoning designation of "Planned Unit Development" for Parcel 14 of the Oviedo
Marketplace DR!.

LOCAL PLANNING AGENCY RECOMMENDATION:
On October 3,2001, the Planning and Zoning Board recommended that the property be rezoned
from "Planned Unit Development" (Seminole County) to "Planned Unit Development" (Winter
Springs), pursuant to the following conditions suggested by staff:
1. Parking by trucks, tractor trailers or similar vehicles shall be limited to 72 hours.
2. Outdoor sales shall not be permitted in vehicle accommodation areas.
3. The sales of goods and/or services from trucks, trailers, or similar equipment shall be
prohibited.

WHEREAS, On October 3,2001, the Planning and Zoning Board recommended approval
of this rezoning based on the testimony and information presented before the Board; and

WHEREAS, Based on the recommendation of City staff, the Planning and Zoning Board,
and review of the competent substantial evidence presented to the City Commission on this rezoning
application, the City Commission hereby finds that rezoning the subject real property as set forth
herein constitutes a legitimate public purpose; and
WHEREAS, the City Commission hereby finds that this Ordinance is in the best interests of
the public health, safety, and welfare of the citizens of Winter Springs.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:
Section 1. Zoning Designation Amended. The zoning designation of the real property legally
described and depicted on Exlubit "A," which is attached hereto and incorporated herein by this
reference, is hereby amended from Seminole County "Planned Unit Development" to City of Winter
Springs "Planned Unit Development." Upon the effective date of this Ordinance, City Staffis hereby
instructed to amend the Official Zoning Map of the City of Winter Springs to fully reflect this
amendment.
Section 2. Repeal oCPrior Inconsistent Ordinances and Resolutions. All prior inconsistent
ordinances and resolutions adopted by the City Conunissio~ or parts of ordinances and resolutions
in conflict herewith, are hereby repealed to the extent of the conflict.

". Section 3. Severability. Ifany section, subsection, sentence, clause, phrase, word or provision
of this ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, whether for substantive, procedural, or any other reason, such portion shall be deemed
a separate, distinct and independent provision, and such holding shall not affect the validity of the
remaining portions ofthis ordinance.
Section 4. Effective Date. This Ordinance shall become effective immediately upon Ordinance
No. 2001-45 becoming effective. If Ordinance No. 2001-45 does not become effective, then this
Ordinance shall be deemed null and void.
ADOPTED by the City Commission of the City ofWmter Springs, Florida, in a regular

APPLICABLE LAW AND PUBLIC POLICY

Chapter 20, Article IV C01J.tains the review requirements for PUD (planned Unit Development) zoning.
Section 20-355 requires that the staff Development Review Committee (DRe) review a PUD
application and submit a recommendation to the Local Planning Agency (LP A). The LP A is required to
conduct a public hearing to consider the change of zoning request, along with the preliminary
development plan required for PUD zoning. The LP A will recommend approval, approval with
modifications, or denial of the request to the City Commission, who will subsequently conduct a public
hearing to review the preliminary development plan and consider recommendations from staff and the
LP A. Based on the City Commission's decision, the applicant will submit a final development plan that
will be subject to staff review and LP A action, prior to final approval by the City Commission.

B. Request:
The applicants request an amendment to the City's Official Zoning Map, to change the
Future Land Use Classification on the subject property from (Seminole County) PUD and
Conservation Overlay to (Winter Springs) PUD. Prior to this request, the applicants
submitted a request to amend the Future Land Use Map (pLUM), along with a revision to
the adopted (Seminole County) Development of Regional Impact (DR!) Development
Order for Parcel 14 of Oviedo Marketplace. The comprehensive plan amendment is
currently under review by the Florida Department of Community Affairs (DCA).

C. Purpose:
The purpose of the request is to assign a City zoning classification to the site, similar to the
current Seminole County Planned Development designation, which would allow the site to
be developed in a manner consistent with the DRI Development Order and future land use
classification currently under review.

3. General Location - The site is located on Dovera Drive, near the intersection of
Red Bug Lake Road and the Central Florida Greeneway. The site corresponds to
Parcel 14 of the Oviedo Marketplace DR!.
4. Legal Description - See attachment C
5. Chronology of Subject Property - The subject property is part of the Oviedo
Marketplace DR!, which was approved in 1988. The DR! is currently located in
three jurisdictions, which include the City of Oviedo, the City of Winter Springs, and
Seminole County. When the subject property (parcel 14) was annexed into the City
of Winter Springs in 1995, neither a FLUM or zoning classification was assigned to
the property. For development purposes, the site is required to have City FLUM
and zoning categories.
6. Existing Land Use - The property is currently vacant. Adjacent existing land uses,

7. Development Trends - With the development of the Oviedo Marketplace, this area
of Red Bug Lake Road has developed into a combination of commercial, office and
medical uses. The applicant is planning to develop a mixture of retail and office uses
on the site, while leaving more than half of the property as open space. The
proposed land uses are consistent with the general character of the area.
8. Letters/Phone Calls In Favor Or Opposition - Prior to initiating the
comprehensive plan amendment and DRI Development Order requests, the
applicant held neighborhood meetings in May 2001 to explain the proposal to
neighboring residents. However, no residents attended the meetings.

II.
ANALYSIS
A. Official Zoning Map:
The applicant is requesting PUD zoning for the entire site. The site is currently shown as
PUD on the Seminole County Official Zoning Map. Asswning the Comprehensive Plan
Amendment is approved by DCA, the proposed PUD zoning, along with the Mixed Use
FLUM designation would allow flexibility and efficiency in the design of future
development.
B. Public Facilities:

1. Roads/Transportation - The subject property will be accessed from Dovera
Drive, which connects with the mall parcel to the north and Red Bug Lake Road to
the south. When the DRI was originally reviewed, the impact of the proposed uses
on the road network was analyzed in great detail. Monitoring and traffic impact
studies have also been prepared. The DRI development order lists transportation
improvements and mitigation measures that are required for the subject property,
prior to its construction as a part of Phase 3, They include the following:
· Red Bug Lake and S.R436: Prior to the development of Phase 3a, the developer is
required to pay a proportionate share for an intersection improvement study.

· S.R 434 and S.R 426: Prior to the development of Phase 3a, the developer is
required to extend Division Street from Michelle Hammock Road to C.R. 419 in
a 2-lane configuration. Also, the developer will be required to provide 5 acres
for wetland mitigation.
· S.R 426: Prior to the development of Phase 3b (subject site), the developer is
required to widen S.R.426 to four lanes, from Mitchell Hammock Road to
Winter Springs Boulevard.
The Oviedo Marketplace mall is currently served by LYNX Bus Route 4. The mp
for LYNX shows that new service and the re-alignment of routes are scheduled for
2002. At that time, there will be three routes serving the Oviedo Marketplace, which
will expand existing capacity.
2. Sanitary Sewer, Potable Water, Solid Waste, Stormwater Management -
· Sanitary Sewer and Potable Water. Seminole County currently provides water and
sanitary sewer service to Oviedo marketplace and is anticipated to be the
provider of these services to Parcel 14 as well, The Settlement Agreement states
that it may be possible for the services to be assigned to the City of Winter
Springs via a utility service agreement between Seminole County and the City of
Winter Springs. Based on the projected service demand for Parcel 14, there is
sufficient capacity to serve the development without lowering the County's
adopted level of service. The applicant has submitted a letter from the Seminole
County Environmental Services Department stating the County's ability to
provide water and sewer service to the subject property,

· Solid Waste: No hazardous wastes are expected to occur on the subject property.
However, the Development Order states, "the Developer shall prepare and
submit a Draft Hazardous Materials Management Plan to the Florida
Department of Environmental Protection (FDEP) for review and approval."
The FDEP ensures that adequate hazardous materials and waste management
and disposal procedures are implemented.
· Stormwater Management: The DRI has a master drainage system, designed and
permitted through the St. John's Water Management District (SJWMD) and
Seminole County, and is maintained by the Dovera Community Development
District (DCDD). The stormwater management for the subject property will
meet the standards of FDEP, SJRMWD and the level of service established by
the City.
3. Recreation and Open Space - The proposed development does not include a
residential component. Therefore, there is not a requirement for recreational
facilities. The development, however, will provide approximately 34 acres (over 50%
of the site) of open space, to be preserved through a conservation easement
dedicated to the DCDD.
4. Police and Fire - The proposed land use classification will not create a negative
impact on the current level of service for City Police and Fire facilities.

C. Nuisance Potential Of Proposed Use To Surrounding Land Uses:
The development of the site under the PUD zoning designation will not have an adverse
impact on surrounding properties. The City's Comprehensive Plan requires a minimum
buffer of 25 feet between adjacent residential and commercial uses, However, a Settlement
Agreement (August 1995) between the City of Oviedo, the City of Winter Springs and the
owner of the Oviedo Marketplace property, requires that development be no closer than 250
feet from the boundary of Ovideo Marketplace development and adjacent residential uses.
This includes roads, parking, buildings and active uses. There are also restrictions on
building height and a wall provided where existing natural vegetation does not exist along
the boundary. As noted above, over 50% of the site will be preserved as open space,
providing a natural and visual buffer between non-residential uses and residential uses to the
west and north. Also, the subject property will be accessed from a road that leads to the
Oviedo Marketplace mall, No commercial traffic will be directed toward or onto. any
residential streets.
D. Natural Lands Compatibility:
1. Soils - There are two distinct soil types on the subject property, which include
swamp and sand. Swamp corresponds to the wetlands to be preserved, and fine
sand comprises the developable portion of the site. These are generally associated
with transitional soils, and are often found in nearly level tracts, adjacent to wet areas
of flatwoods connected to low lands. The soils on the eastern portion of the site are
adequate for development.

2. Topography - The site is generally flat, with a variation of 5 feet between the lowest
and highest grades.
3. Flood Prone Areas - The subject site is not within the 1 DO-year flood prone area.
4. Natural Resources - The developer will be required to protect the wetlands on the
site. A conservation easement has already been dedicated to the DCDD. There are
no endangered plants on the property.
5. Wildlife - The bald eagle nest originally identified on the property was abandoned
for more than five years. The Florida Game and Fresh Water Cominission has
determined that the restrictions previously related to the nest no longer apply. The
proposed Development Order to be adopted by the City of Winter Springs does not
make any references to the nest. There are no other endangered, threatened or
species of special concern known to occur on the site. The Development Order
states,that if any other endangered, threatened or special concern species are found
on the site, development will cease, and the Florida Game and Fresh Water
Commission would be notified.
6. Historic/ Archaeological Resources - There are no known significant historical or
archaeological resources located on the site.

E. Consistency With The Comprehensive Plan:
The proposed PUD zoning classification is consistent with the Mixed Use large scale
Comprehensive Plan amendment previously considered and recommended for approved by
the LP A. The request to change the existing (Seminole County) PUD zoning designation to
the City's PUD zoning designation is also consistent with the goals, objectives and policies
of the City's comprehensive plan.
III.
FINDINGS
1. Article IV, Section 20-355 of the City's Code of Ordinances describes the requirements
for PUD zoning, based on a preliminary development plan. This application meets the
criteria defined by this chapter.
2. On June 6, 2001, the LP A recommended approval of the large scale comprehensive plan
amendment request for transmittal to DCA, which would change the FLUM designation
from (Seminole County) PUD and Conservation Overlay to (Winter Springs) Mixed Use
if approved. The requested zoning would be consistent with this recommendation.
3. On August 13, 2001, the City Commission followed the recommendations of staff and
the LP A and approved transmittal of the large scale comprehensive plan amendment
request to DCA for review.
IV.
STAFF RECOMMENDATION
(
Even though the request to change the zoning of the subject property is being reviewed
concurrent with a request to change the FLUM designation for the same property, final action
on the rezoning request would not precede DCA's fmal decision on the large scale

comprehensive plan (FLUM) amendment. Final approval of the rezoning request (by the City
Commission) could only occur after approval of the large scale comprehensive plan amendment
by DCA. In light of this information, staff recommends approval of the request to change the
zoning classification of Parcel 14 of the Oviedo Marketplace DRI from (Seminole County) PUD
to (Winter Springs) PUD, with the following conditions:
A. Parking by trucks, tractor trailers or similar vehicles shall be limited to 72 hours.
B. Outdoor sales shall not be permitted in vehicle accommodation areas.
C. The sales of goods and! or services from trucks, trailers, or similar equipment shall be
prohibited.

The Agenda Item was presented by Mr. Earnest McDonald, AICP, Advance Planning
Coordinator, Community Development Department. Mr. McDonald stated, "The request
is consistent with the recommendations of the Comprehensive Plan as well as the Future
Use Land Map Am~ndment approved by both this body and the City Commission. The
Development Review Committee had an opportunity to review this Preliminary
Development Plan apd recommends approval with the following conditions. Those
conditions are as follows: that parking by trucks, tractor truck or similar larger
commercial vehicles be limited to seventy-two (72) hours on site; that outdoor sales not
be permitted in parking areas; and lastly that the sales of goods and lor of services from
semi-trucks trailers or similar equipment be prohibited." Discussion.

The Board discussed the responsibility of emergency response.
Chairman Fernandez said, "My recommendation at least, whether it's in the minutes or
not, should be that the City Attorney ought to look over these Interlocal Agreements to
see what our exposure is and if we have any exposure to make sure we've got enough
adequate insurance to cover it and that of course there's something in those agreements
that says when they're in the City of Winter Springs and one of our representatives shows
up, that they've got to listen to us and they've got to take their orders from us. Because I
want their policemen and their safety employees and who ever else it is - listening to our
guys. And if we make a mistake we're responsible for it, but if they make a mistake and
they are going against what we want, then let their insurance pick it up. In any event I
think it's an issue that should be brought up and it's a legal issue and I think that ought to
be addressed to the City Attorney or our City Attorneys as to those agreements and if it
has not been previously addressed then it has to been addressed."

attended. Vice Chairman Brown requested that the homeowners be notified in the future

on. I think the City's got at least one (I) but I'm not sure that they have more, they've got
just the one, that's what I thought. And we've got at least the east half of the city and the
west half of the City and it can't be in two places at once. Is it appropriate for us as a
Board to be, through you [Mr. CarrringtonJ I guess suggesting that maybe the Police
Department consider getting more of those radar units?" Mr. Carrington replied, "I think

transportation system. Both cities agree that the tolls on the GreeneWay act to inhibit its use.
Consequently. the cities agree that they shall woric: together in order to eliminate or reduce the
tolls on the GreeneWay within the vicinity of each community.

(a) Psalftl!l 1 A Simultaneously with execution of this Agreement by all Parties (or earlier at
Viera's sole option), Viera shall prepare and execute a petition (hereinafter. the "Parcel

14 Petition") to voluntarily annex into the City of Winter Springs P~114 of the Project
together with an adjacent conservation area and a small adjacent upland parcel all as more
particularly shown on the DR! Master Development Plan attaehed hereto and incorporated
herein as F1l'hihit "R" The property which will be the subject of the Parcel 14 Petition
is refened to in this Agreement as "Parce114." Viera shall deliver the Parcel 14 Petition
to Kruppenbacher &. Associates. Inc.. 340 North Orange Avenue. Orlando. Florida 32801
(hereinafter. the "Escrow Agent") to be held in escrow. subject to the tenns and
conditions of this Section 9.

In consideration of Winter Springs' compliance with its obligations set out herein,
including but not limited to those set out in Paragraph 11 hereinafter. if Seminole County (
approves all the applications for the Land Use Approvals. then ninety (90) days after
Seminole Cowuy issues all such approvals and renders the Amended Development Order
to the Florida Depanment of Community Affairs and the East Central Florida Regional
Planning Council (and only then). Escrow Agent shall deliver the Parcel 14 Petition to
Winter Springs. Winter Springs and Viera shall take such action as is appropriate to
consummate the annexation and to consider such Land Use Approvals including the
Development Order required by Section 380.06 Fla. SW.. for Parc:e114 as is contemplated
by this Agreement and the applications for the Land Use Approvals being processed by
Viera. The panies acknowledge that WInter Springs has no rights and shall have no rights
with respect to approval of any portion of the Project except Parcel 14 (following the
completion of the annexation of Parcel 14 into Winter Springs),
Winter Springs may. but shall not be required to. provide municipal services to said

Exhibit 7, Soils, was derived from the D.L.I. Properties Application for
Development Approval (ADA) soils map. The map identifies two distinct
soil areas on the site: swamp, which makes up the wetland portion of the
site to be preserved, and fine sand, which makes up the upland portion of
the site. The soils identified on the site include:

These soil" are common to other developed areas of Seminole County.
The existence of these other developments, especially those in the

The Immokalee, Leon and Rutledge fine sand series dominate the upland
portion of the site, and are generally associated with transitional soils.
They are often located in nearly level tracts, as they are here, adjacent to
wet areas of flatwoods, and connected to low lands. This area of the site
has historically been used for farming and pasture.

(11) Public Facilities
Adequate public facilities are available for development of Parcel 14.
Roads:
Improvements and mitigations required in the DRI Development
Order prior to developing Parcel 14 are as follows:
Red Bug Lake and SR 436 - The Developer shall pay Developer's
proportionate share of the cost of a study of improvement needs for
the specified intersections, which proportionate share shall be based
on the ratio of Project traffic to total traffic. For purposes of this
Development Order, Developer's proportionate share shall be
deemed to be $75,000, which shall constitute Developer's mitigation
for the Project's impact upon the specified intersection. Within
thirty days after receipt of written notice from either the Florida
Department of Transportation or Seminole County that such study
has been authorized, Developer shall pay its proportionate share
directly to such party. (The Developer has met this obligation.)
SR 434 and SR 426 - As mitigation for any impact on the
intersection of SR 434 and SR 426, Division Street shall be extended
from Mitchell Hammock Road to CR 419 in a 2-lane configuration.
Pursuant to Rule 9j-2.045(7) a Florida Administrative Code, this
condition shall be deemed satisfied if such improvement is (i) in place
and operational, (ii) under actual construction for the entire
improvement, or (iii) committed for construction in the current
three years of the City of Oviedo's Capital Improvement Element.
In addition, Developer shall conveyor cause to be conveyed an
approximately 5.04 acre site as more particularly described on Exhibit
"D" attached hereto to the City of Oviedo for use as wetland
mitigation for South Division Street. This provision shall be
modified by Seminole County in the event that the City of Oviedo
modifies its comprehensive plan with respect to Division Street.
SR 426 must be widened to four lanes from Mitchell Hammock
Road to Winter Springs Boulevard. This improvement must be
committed for construction within the first 3 years of the FDOT 5
Year Work Program prior to commencement of Phase 3b
development. In the event that this improvement is not committed
for construction within the first 3 years of the FDOT 5 Year Work
Program, the Developer may proceed with construction of phase 3b
if Developer (i) advances the funds necessary for the construction of
such improvement, or (ii) conducts a final monitoring/modeling
program in accordance with th~ requirements of Paragraph 13(a)
above which demonstrates that such improvement is not required.
The status of these improvements is reported in the DRI Annual
Reports.
Sanitary Sewer:
As stated in the Amended Settlement Agreement, "Winter Springs
may, but shall not be required to, provide municipal services to said
Parcel 14; if it does not provide services it shall enter into an
interlocal agreement with another governmental entity which agrees
to provide such services; Viera and Rouse shall be third party
beneficiaries of the Agreem.ent."
Seminole County is currently p~oviding sanitary sewer service to
Oviedo Marketplace and is anticipated to be the provider of sanitary
sewer service to Parcel 14 as well. If Seminole County services the
parcel, treatment capacity will be provided at the Iron Bridge
Treatment Plant for wastewater generation from the project. Gravity
sewer system improvements exist to the property boundary.
Extension of the gravity sewer system improvements within the
parcel boundary will be constructed, owned and operated by the
parcel developer.

is 300 gallons per day per ERe (Equivalent Residential Connection).
The estimated wastewater flow of 0.0160 MGD for Parcel 14 is
equivalent to 53.3 ERC's. The proposed development therefore
does not exceed the adopted level of service.
Potable Water:
As stated in the Amended Settlement Agreement, "Winter Springs
may, but shall not be required to, provide municipal services to said
Parcel 14; ifit does not provide services it shall enter into an
interlocal agreement with another governmental entity which agrees
to provide such services; Viera and Rouse shall be third party
beneficiaries of the Agreement."
Seminole County is currently providing water service to Oviedo
Marketplace and is anticipated to be the provider of water service to
Parcel 14 as well. Existing Oviedo Marketplace infrastructure
improvements include a 10-inch looped water main within the
internal road rights-of-way connecting to a 12-inch water main
along Red Bug Lake Road. The 10-inch water main is adjacent to
the Parcel 14 boundary and is fitted for service to the subject parcel.
Parcel 14 is projected to have a potable water demand of 0.0160
MGD (million gallons per day). This estimate was calculated
assuming all 160,000 square feet of approved development area is
retail services. If the proposed mix of uses is built, the potable water
demand may differ.
The adopted level of service standard for potable water service in
Seminole County is 350 gallons per day per ERC (Equivalent
Residential Connection). The estimated potable water demand of
0.016 MGD for Parcel 14 is equivalent to 45.7 ERC's. The
proposed development therefore does not exceed the adopted level
of service.
Stormwater Management:
The Dovera Community Development District (CDD) was formed
to assure the accomplishment of the intended objectives of the
proposed stormwater management program and compliance with the
objectives set forth in Chapter 29-F-19.001, Florida Administrative
Code. The DRI Development Order states, "The CDD is
responsible for implementing an inspection and maintenance
program for all components of the surface water management system
for the Project site to assure that the components continue to operate
at their design capacities for the life of the Project. The CDD shall
be responsible for all applicable permit conditions imposed with
respect to the surface water management system by the St. johns
River Water Management District." The CDD has been established
and is in place to maintain common areas in Parcel 14.
The master drainage system for all of Oviedo Marketplace was
designed and permitted through the St. johns River Water
Management District and Seminole County and meets the City of
Winter Springs 25 year, 24-hour storm event LOS standard.
Fire Protection:
Fire protection will be provided by the City of Winter Springs.
(12) All exhibits indicate the title, date of submittal, and dates of any
subsequent revisions. Additionally, the exhibits are at a graphic scale
of one (1) inch per two hundred (200) feet.
