REQUEST:
City Manager requests the City Commission consider possible dates for a
Workshop dealing with Code Enforcement issues pertaining to animals.
PURPOSE:
During the August 13, 2001 Regular Meeting of the City Commission, a
Motion requested that the City Manager consult the City Commission for
available dates when a Workshop could be held which would contend with
animals in relation to enforceability and other related situations.
CONSIDERATIONS:
Over the last six months, there have been a number of comments made at
City Commission Meetings dealing with Residents' concerns with
animals, pet rescue operations, pet restrictions, and how the City's Code
Enforcement Division can handle such matters.
At the August 13, 2001 Regular Meeting of the City Commission,
discussion involved possible dates for such a Workshop. With only three
Commissioners present at the time, it first seemed that the first available
off-Monday to hold such a Workshop would be on Monday, September
17,2001,

However, as this date was a number of weeks off, the Commission favored
a date within the next three weeks. A Motion was made asking the City
Manager to work with the City Commission and set up a date for a
Workshop on this matter, preferably within the next three weeks.
IMMEDIATE CONCERNS:
In reviewing the next three weeks, it is quite apparent that in addition to a
Special Meeting and a Workshop scheduled for Monday, August 20, 2001;
a Regular Meeting scheduled for Monday, August 27,2001; a Meeting of
the City Commission being held at Winter Springs High School on
Wednesday, August 29, 2001; the Labor Day Holiday (a National and City
observed Holiday) being held on Monday, September 3, 2001; and on
Tuesday, September 4, 2001, a Special Election is being held throughout
Seminole County, with the City of Winter Springs having two additional
ballot questions on that same Special Election, the next three weeks are
already quite busy. Then, if you will consider that during these same three
weeks, a number of Meetings are being scheduled to present various
Homeowner Associations with information pertaining to the three
referendums for the September 4, 2001 Special Election, there are very
few evenings that may be available. (Note: As you have requested, L as
your City Manager, will be attending most of Homeowner Association
meetings).
Then of course, one must consider the myriad of obligations and meetings
that each individual member of the City Commission may already have
planned for the next three weeks.
Additionally, as the City Commission requested and approved in their
Motion to set up this Workshop, the discussion and ensuing Motion
requested that a number of different individuals, from a few different
governmental organizations be invited; therefore, if a later date were to be
agreed upon, this might make it easier for the invited attendees to work
this Workshop into their personal schedules.
FUNDING:
None required.

RECOMMENDATIONS:
It is recommended that as the above information and attached calendars
illustrate, the following three weeks are very "booked" and that the City
Commission review the following suggested dates for a Workshop on
issues dealing with animals, pets, and agree on the date that the City
Commission deems must suitable.
The following dates are offered to the City Commission for their review
and consideration:

Forest Wall And Beautification District Advisory Committee.
(This Agenda Item Was Previously Listed As Regular Agenda Item "C" On The July
23, 2001 Agenda, But Due To Time Constraints, It Was Not Heard).
COMMISSIONER GENNELL STATED, "I WOULD LIKE TO NOMINATE MR.
MIKE MASTERS FROM OAK FOREST, TO BE ON THE OAK FOREST WALL
AND BEAUTIFICATION DISTRICT ADVISORY COMMITTEE." MOTION BY
COMMISSIONER GENNELL. SECONDED BY COMMISSIONER MARTINEZ.

Presents The Results Of Legal Research And Requests Direction From The City
Commission Regarding The Preparation Of An Ordinance Which Would Regulate
The Number Of Animals At Each Residence Within The City Of Winter Springs.
(This Agenda Item Was Previously Listed As Regular Agenda Item "E" On The July
23,2001 Agenda, But Due To Time Constraints, It Was Not Heard).
Regarding this Agenda Item, Commissioner Gennell said, "I suggest that we do put this
on a Workshop, I think that gives more opportunity for more citizens pro and con and for
us to hear - and to gather information." Commissioner Gennell further stated, "I would
also suggest that the County Animal Control person..," Deputy Mayor McLeod said,

be present." Commissioner Gennell then said, "It is my recommendation that we handle
Item 'c' by scheduling a Workshop for it when the whole Commission is here that can
agree on a proper date." fC)/!j) .. .
Commissioner Gennell advised the Commission that "I have been advised by u~'Af:r
Carrington that you have a Special Meeting next Monday evening, Maybe you want to
work that Workshop around the Meeting somehow, Or a Special Meeting is requested, I
don't know how you are presenting this, Charles, it's consideration and approval of the
James Doran company site plan and elevations for the Publix grocery store and the
second item is working with the Planning and Zoning Board on the updated
Comprehensive Planning elements," Mr. DeMarie added, "I'm suggesting the Workshop
might be before or after."
Brief discussion followed on several meetings that have been planned that pertain to the
James Doran Company, Mr, Carrington then advised the Commission that there are two
(2) issues. One, the meeting with the StaffDRC on the loth which was Friday, dealt with
two issues. One, the site plan which must come on to this Board for final approval and
JDC has asked for accelerated review and approval, because they want to get under
construction because of deadlines with Publix; so that meeting was scheduled some time
ago, I understood, on the 20th, which is next Monday, And we also talked about the other
issue, is in connection with the update of the Comprehensive Plan and the Planning
Commission and this body wish to have a Workshop with the consultants on the elements
of the comprehensive plan."
Mr. Carrington then explained that the Special Meeting on the 20th would deal with two
issues, one, the site plan, The second issue would be the elevations or the facades for the
four sides of the grocery store, the Publix building," Mr. Carrington then said that a
"Third Item" on the 20th would be a Workshop "Dealing with the Comprehensive Plan
Elements."
Deputy Mayor McLeod then spoke of the planned meeting scheduled for August 16th
with Deputy Mayor McLeod and Commissioner Miller.
Deputy Mayor McLeod then said, "Do we have a date for this Workshop," Deputy
Mayor McLeod then explained that it would be a Workshop dealing with Item "C."
Dates were discussed, and it was suggested that this Workshop be held on "The first
Monday that is available" (not including the Labor Day holiday), but as the first available
Meeting date was Monday, September 18, 2001, members of the Commission felt that
this date was later than they would like. The Commission agreed with Mr. DeMarie's
suggestion that "The City Manager probably get with you individually and schedule it."
Deputy Mayor McLeod added, "And let's see if we can schedule it before the next three
(3) weeks," Deputy Mayor McLeod then said, "Is that agreeable with everybody?"
Commissioner Martinez stated, "Very good," Commissioner Gennell stated, "Yes."

COMMISSIONER MARTINEZ ADDED, "AND I WOULD SUGGEST THAT
MAYBE YOU CAN - INVITE MS. RAWLINS; THE PEOPLE THAT THE
ATTORNEY WAS REFERRING TO AND BRING THEM NOTES, AND GIVE
THEM TO US - OR WHATEVER THEY WANT TO PRESENT." /DJ 0 ..
DEPUTY MAYOR McLEOD ADDED, "I THINK WE - WOULD LIKE TOrR A/f7r
INSTRUCT CODE ENFORCEMENT OF ANY ISSUES THAT MAY BE OUT
THERE WITH RESIDENTS THAT THEY HAVE HAD RECENTLY OR MAYBE
EVEN BACK FOR THE LAST YEAR, ON DOGS, AND CATS, OR ANY OTHER
ANIMAL CONTROL PROBLEMS THAT THEY BE NOTIFIED AND LET
THEM KNOW THAT THERE IS GOING TO BE A WORKSHOP ON IT AND
LET'S GET THEIR INPUT. AND THAT'S PEOPLE THAT'S HAD THE
PROBLEM AS WELL AS THE OWNERS OF THE PETS." COMMISSIONER
MARTINEZ ADDED, "I THINK CODE ENFORCEMENT SHOULD BE READY
TO ANSWER ANY QUESTIONS REGARDING ANIMAL COMPLAINTS IN
PAST FEW YEARS."
FURTHERMORE, DEPUTY MAYOR McLEOD SUGGESTED THAT
MANAGER MCLEMORE HAVE THE SEMINOLE COUNTY ANIMAL
CONTROL INDIVIDUAL ATTENDS THIS WORKSHOP." DEPUTY MAYOR
McLEOD ALSO SUGGESTED, "I BELIEVE LONGWOOD ALSO THEIR OWN
ANIMAL CONTROL - IF WE COULD GET SOMEBODY REPRESENTING
THE CITY OF LONGWOOD, FROM THE STANDPOINT OF WHAT THEY DO
THERE, AND PERHAPS ORANGE COUNTY."
COMMISSIONER GENNELL THEN SUGGESTED, "I WOULD LIKE TO
SUGGEST FURTHER THAT IN STRUCTURING THE WORKSHOP, I AGREE
COMPLETELY WITH BRINGING IN OTHER EXPERTISE, AND IN AS MUCH
AS WE'RE BRINGING THESE PEOPLE IN, AFTER THEIR NORMAL WORK
DAY IN THEIR OWN BUSINESSES OR CAREERS, I WOULD RATHER HEAR
FROM THEM FIRST, AND LET THEM GO ON THEIR WAY, RATHER THAN
HAVE THEM SIT THROUGH, PERHAPS A COUPLE OF HOURS OF CITIZEN
INPUT, THEY HEAR IN THEIR OWN JOB EVERYDAY, ANYWAY." DEPUTY
MAYOR McLEOD AGREED AND SAID, "WE SHOULD TAKE THE
PROFESSIONAL SIDE OF IT FIRST." ADDITIONALLY, DEPUTY MAYOR
McLEOD SUGGESTED, "WE NEED TO OPEN THIS TO THE PUBLIC."

Requests That The City Commission Approve The 1 00% Vesting Of The
Mandatory 3% Of Employee Salary Contributions To The Pension Fund, From
Date Of Contribution.
Much discussion,
Commissioner Martinez inquired "Where the $25,000 was coming from?" Mr. DeMarie
stated that "It would either be an employer contribution of the total amount or some
combination of employer and employee contribution,"
Deputy Mayor McLeod stated, "So what you're really saying is the 3 percent is the
money that's by the employee, that put into the fund, At the end of three years that
employee leaves, where saying at that time, you did not have the right to take with you,
the money you vested?" Mr. DeMarie said, "That's exactly right."
With further discussion on the actuarial calculations, Deputy Mayor McLeod asked, "Our
consultants took all the profits and rolled those forward and took no consideration of -
